REQUEST: The Community Development Department requests the City Commission consider releasing two building permits for additions to residential structures within the Tuscawilla PUD upon approval of these permits by the Building Department. Release of these permits is being requested before finalization of the text amendment facilitating review of these additions for neighborhood compatibility Issues. PURPOSE: To approve the release of building permits for the following addresses: A. 733 Bear Creek Circle - Bathroom renovation and 2-story addition B. 1211 Deer Run - Closing in garage This agenda item is to request the City Commission's approval to release these permits once all reviews are finalized. The release of these permits will precede the finalization of the text amendment for Section 6-84, Accessory Buildings of the City's Code of Ordinances. CONSIDERATIONS: Staff has proposed a text amendment to Section 6-84 ofthe City's Code of Ordinances to provide a process for reviewing accessory buildings and additions for compatibility with the principal structure and with the surrounding neighborhood and adjacent structures. This text amendment is on the May 8, 2006 City Commission meeting for first reading. The proposed construction at 733 Bear Creek Circle received a variance from the City Commission on July 26, 2004 (Agenda Item 505) to encroach three (3') feet into the twenty (20') foot side building setback. The proposed construction at 1211 Deer Run is to enclose a section of the house that was built out as a garage some years ago. This construction also addressed some structural damage to the roof assembly (rotted roof structure, etc.) The applicant at 1211 Deer Run is proposing to build a new garage March 13, 2006 Regular Item 301 Page 2 of 2 in the rear of the house. Plans for that garage are in process and the home owner will apply for a separate permit to construct the garage. The subject permits are being reviewed by the Community Development Department and will be ready for issue before the proposed text amendment is finalized. These permits are being reviewed in accordance with the proposed language for Section 6-84 of the Code of Ordinances. This review is in keeping with the Notice of Pending Ordinance document that has been posted at the front counter and in the lobby of City Hall since April 12, 2006. This Notice of Pending Ordinance covers all permit applications submitted after April 10, 2006. Continued delay of these permits until the text amendment is finalized may cause undue hardship on the applicants. RECOMMENDATION: Staff recommends that the commission approve the release of the two permits referenced above pending finalization of all applicable reviews by City staff. ATTACHMENTS: A.
