HomeMy WebLinkAbout2005 03 28 Regular 501 David Drive Right-of-Way in the City of Winter Springs COMMISSION AGENDA ITEM 501 CONSENT INFORMATIONAL PUBLIC HEARING REGULAR X H-A9c+\ )~- ~2005 Meeting MGR IV IDEPT~ Authorization REQUEST: Police Department Code Enforcement Bureau requests the Commission to review information regarding the David Drive Right-of-Way in the City of Winter Springs. PURPOSE: This agenda item is needed to provide information to the Commission as it relates to the Right-of-Way known as David Drive in the City of Winter Springs. CONSIDERATIONS: The Code Enforcement Bureau was directed to investigate the issue of structures that have been built on the Right-of-Way known as David Drive. During our investigation we found that this Right-of Way (David Drive) is a Seminole County Right-of-Way. . The length of David Drive is +/- 4,656 feet x 25 feet in width, un-opened right-of- way, extending in a north-south direction that starts at SR 434 and ends connecting to Belle Ave. through the City of Casselberry Public Works compound. . The northern most section +/- 978 feet is surrounded by the City of Winter Springs. . With the remaining 3,678 feet surrounded by either the City of Winter Springs or the City of Casselberry with one parcel still in Seminole County that is an enclave. The owners of this enclave would have to apply through Seminole County for access from the right-of-way, as well as would be responsible for all improvements made connecting to the nearest paved road at their expense. There are statutory conditions that favor the ownership of this roadway by the surrounding jurisdictions; however, a formal govemment-to-govemment (Jurisdictional transfer of property) process is required for this to happen. April!!, 2005 Regular Agenda 50 I Page 2 of 5 Mr. JR Ball, P.E. of Seminole County Engineering has confirmed that David Drive is still in Seminole County jurisdiction and no formal process between governments is on file. He has also forwarded this information to Seminole County Road Operations and Code Enforcement with the Commissions concerns about the right-of-way. RECOMMENDATION: It is recommended that the Commission provide staffwith whatever direction it deems appropriate. IMPLEMENTATION SCHEDULE: Immediately upon approval by Commission.
