V IDEPT @ Authorization REQUEST: It is requested that the City Commission provide direction In appointing legal counsel to advise the Code Enforcement Board. PURPOSE: This agenda item is offered to request the Commission's input and direction on how to satisfy the request of the Code Enforcement Board Chairman who has requested that counsel be provided for the Board's benefit in handling code enforcement matters. CONSIDERATIONS: At the August 13, 2001, Commission meeting, the Chairman of the Code Enforcement Board, Joanna Krebs, requested that the Board be assigned legal counsel to provide advise, recommendations, and case review services for the Board. Mrs. Krebs stressed that board members often do not understand the nuances of cases before them, nor are they comfortable with making determinations that they feel are sometimes outside the scopc of their lcgal expertise. Under Florida statutcs, the City Attorney cannot serve as both counscl to the City Commission and counsel to the Code Enforcement Board, thereby necessitating the appointment of outside counsel. Fees for counsel to the Board were not anticipated in the FY 2000/2001 budget, and a supplemental appropriation of an undetermined amount would have to be made if counsel is provided immediately. If counsel is provided beginning on October 1, 2001, budgetary allowances for attorney fees will have to be adjusted in the proposed FY 2001/2002 budget now under consideration. ,:) ""~ ".. ~ August 27,2001 City Commission Regular Agenda Item "A" FUNDING: To Be Determined. RECOMMENDATION: Staff recommends that the Commission provide direction for staff in supplying legal counsel to the Code Enforcement Board, and if such counsel is approved, determine with some certainty an estimated cost to be raised through a supplemental appropriation for this fiscal year, or an adjustment in the proposed FY 2001/2002 budget.
