HomeMy WebLinkAbout2005 01 24 Consent 204 Resolution 2005-05, Cross Seminole Trail Connector RESOLUTION NUMBER 2005-05 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, FLORIDA, RESPECTFULL Y REQUESTING SEMINOLE COUNTY, FLORIDA TO DELAY CONSTRUCTION OF THE CROSS SEMINOLE TRAIL CONNECTOR WITHIN WINTER SPRINGS; PROVIDING FOR SEVERABILITY, REPEAL OF PRIOR INCONSISTENT RESOLUTIONS, AND AN EFFECTIVE DATE. WHEREAS, the City Commission has enthusiastically supported the construction of the Cross Seminole Trail and the passage of the County-wide bond issue to construct the trail, and WHEREAS, the trail was envisioned to be a safe and positive experience for trail users, allowing trail users to interact with points of interest in our communities, and WHEREAS, alignment 3B of segment 3 of the Cross Seminole Trail Connector Project plan along the southwest border of the Lake Jesup preserve would have provided trail users the opportunity to experience and enjoy the pristine beauty and environmental significance of the Lake Jesup wetlands, and WHEREAS, unanticipated costs have resulted in a proposed realignment of the trail south of the 3B alignment through the center of an industrial park, and WHEREAS, the proposed realignment is located adjacent to unsightly and unsafe heavy industrial large scale uses, including wrecker and salvage operations, congested heavy truck and construction equipment traffic, and hazardous materials, and WHEREAS, the City Commission further desires to notify Seminole County that these uses have recently caused multiple alarm industrial fires, involving wide spread toxic and obnoxious odors and hazardous materials, and WHEREAS, the proposed realignment is not consistent with the desired safety and experience of trail users, and a dramatic departure from the trail experience offered in the preferred alignment, and WHEREAS, development of a funding strategy to finance the unforeseen cost of the preferred alignment could take as long as two years to facilitate the coordination of Federal, State, and Local funding sources. The City Commission strongly recommends that construction of the Cross Seminole Trail Connector within Winter Springs be delayed until such time that all efforts have been exhausted to develop a funding strategy to finance the preferred 3B of Segment 3 alignment of the Cross Seminole Trail Connector. SECTION 2. Severability. If any section, clause, phrase, word, or provision of this Resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction, whether for substantive or procedural reasons, such portion shall be deemed a separate, distinct, and independent provision, and such holding shall not affect the validity of the remaining portions of this Resolution. SECTION 3. Reveal of Prior Inconsistent Resolutions. All prior inconsistent Resolutions adopted by the City Commission are hereby repealed. SECTION 4. Effective Date. This Resolution shall become effective immediately upon passage by the City Commission of the City of Winter Springs, Florida, and pursuant to the City Charter.
