CITY OF WINTER SPRINGS MINUTES CITY COMMISSION SPECIAL MEETING MARCH 21,2001 I. CALL TO ORDER The Special Meeting of March 21, 2001 of the City Commission was called to order by Deputy Mayor David W. McLeod at 5:07 p.m. in the Commission Chambers of the Municipal Building (City Hall, 1126 East State Road 434, Winter Springs, Florida 32708). ROLL CALL: Mayor Paul P. Partyka, arrived at 6:28 p.m. Deputy Mayor David W. McLeod, present Commissioner Robert S. Miller, arrived at 5:12 p.m. Commissioner Michael S. Community Development Department - Planning Division Requests The City Commission Hold A Public Hearing For First Reading And Consideration Of Ordinance 2001-18 To Adopt The Large Scale Comprehensive Plan Amendment (LS-CPA-I-00) That Would Change The Future Land Use Map Designation Of The Elizabeth Morse Foundation Property From (County) "Suburban Estates" (1 DU Per Acre) To (City) Designation "GreeneWay In terchange." CITY OF WINTER SPRINGS MINUTES CITY COMMISSION SPECIAL MEETING - MARCH 21.2001 PAGE 2 OF 14 City Attorney Anthony A. Garganese read Ordinance 2001-18 by "Title" only. Mr. Tom Grimms, AICP, Comprehensive Planning Coordinator introduced this Agenda Item to the Commission. Deputy Mayor McLeod opened the "Public Input" portion of this Agenda Item. Mr. Scott Henderson, Henderson Planning Group: advised the Commission that they were representing the Elizabeth Morse Foundation and spoke about this property. Commissioner Robert S. Miller arrived at 5: 12 p. m. Deputy Mayor McLeod stated, "At this time would the record show, that Commissioner Miller has joined us." Ms. Terry Scarlata, 1006 Nancy Circle, Winter Springs, Florida: spoke on concurrency management in relation to parks and recreation. Deputy Mayor McLeod asked about several references by Ms. Scarlata to "settlement." Attorney Garganese explained that, "Ms. Scarlata challenged a Comprehensive Plan Amendment that this Commission adopted, maybe about a year and a half ago, and it is part of her challenge, we had worked out a proposed settlement which will be coming before the City Commission for consideration, probably if not your next meeting, the meeting after that, and all that stipulated settlement agreement would do is obligate the City Commission to consider an Ordinance setting forth a concurrency management system addressing parks and recreation, so that whenever future developments come into the City, they would have to go through the concurrency management Ordinance procedures. " Mr. Grimms was asked, "Has the City satisfied their requirements for parks and recreation based on population." Mr. Grimms answered by saying, "The problem is that we don't have a development proposal before us right now." City Manager, Ronald W. McLemore was asked, "For the amount of residents we have, the amount of park space we presently have, are we complying with our Comprehensive Plan?" Manager McLemore replied, "We believe that the amount of acreage as provided in your current plan actually supercedes what your current need is based on your Comprehensive Plan." PUBLIC HEARINGS B. Community Development Department - Planning Division Requests The City Commission Hold A Public Hearing For First Reading And Consideration Of Ordinance 2001-19 To Adopt The Large Scale Comprehensive Plan Amendment (LS-CPA-4-00) That Would Change The Future Land Use Map Designation Of The Springs Land/Jesup Shores Property From "Mixed Use" To The "Town Center" Designation. Manager McLemore stated "I think it is fair to state that this Commission is on the record over and over and over again, relative to its willingness to spend money to develop parks in the city. Our problem has been the lack of willingness on the part of neighborhoods to do it. And I just want that on the record." Further discussion. Manager McLemore stated, "What I am saying to you, is I think is what these people want to hear, is we acknowledge their concerns and that they are willing to work with them to come up with a ~ product that will represent, to the public a good transition into the core area of your Town Center, and at the same time, recognizing that if we were to apply the rules purely, it may create some real hardship in trying to make this a feasibly developable piece of property." Manager McLemore further stated, "I need to point out one other thing to you. What I passed out to you just a moment ago was a list of items that was presented to me, late this afternoon, and I need to tell you that we don't agree with everything that is in that, but it represents at least the kind of discussion we need to be having, in order to work with Centex and making this a development that would be a credit to the Town Center, if not, follow the guidelines, purely." Deputy Mayor McLeod stated, "I would like to point out at this time, that Centex is a client of mine also - however, not in this particular matter, or with this particular group of people, in anyway, shape or form. I primarily deal with Centex - out of Osceola. So I just wanted to make that clear for the record." Discussion. Attorney Garganese read Ordinance 2001-19 by "Title" only. Mr. Ed Leerdam: explained to the Commission how he has already lost a buyer, and asked that a different approach be considered. Mr. Tom Daly, Daly Design Group: representing Mr. Leerdam and Centex, and discussed some renderings and plans for the property. Discussion. The first specific item discussed was the location of garages. Mr. Daly stated that "Ron and Charles both requested that we look and see if there was a way we could put the garages to the back, so that it is all front facing with front porches and all, and Centex went through their 30 or 40 different townhouses that they do nationwide. They looked at the product, the marketplace that they would be trying to fulfill and are unable to have a product that would be exclusively with - garages coming in the rear. And so one of the items on here, I think it is the fourth one down, talks about garage doors facing the front, strictly only for the units that come along the front, limited to one (1) car garages." Manager McLemore stated that their approach would be that, "We will take their people and sit down with our consultant and see how we can marry the various ideas into something that we think will work." Commissioner Michael S. Blake stated that "The front garage doors cause me great concern. It doesn't mean no, it just means great concern." Commissioner Blake further asked, "What steps can we take to mitigate those garage doors on the front, if in fact we get to a point where that is something that we would want to allow it." Furthermore, Commissioner Blake added, "Your second item where it discusses Town Center standards meeting the intent, but not being held in a strict interpretation of the architectural standards. And what I read into that one is an intent to cheapen, if you will, and please excuse me for using that word, but that's really how it comes across to me, in all frankness, is to cheapen the visual appearance, the quality of the development, and that I would tell you is precisely what we have worked against in trying to put this Town Center deal together, so I would direct Staff to pay special attention in discussions to that CITY OF WINTER SPRINGS MINUTES CITY COMMISSION SPECIAL MEETING - MARCH 21, 2001 PAGE 5 OF 14 particular item as well as the front garage doors. I think there may be ways that I haven't thought of to mitigate the garage door on the front of some units; I would prefer to have them in the back." Mr. Daly replied, "We have talked about the mitigation of the garages and there are some things architecturally, if we can't get it to a rear garage - that would look less like a - big white door." Tape I/Side 8 Commissioner Miller was also concerned with garages on the front. Deputy Mayor McLeod added, "If you look at your complex setting, on the south side of your drawing, on the southeast, those buildings. The buildings themselves are facing the water. The parking lots are back to back with the front side of the other buildings facing the wetlands. Why couldn't you take the first three (3) buildings on your - Northeast side of the property and flip those and do the same thing, which therefore would put three (3) of the main buildings back to the roadside, the frontages, and give you access - and give the residents that would be in these buildings, would have a much better view of the water, than what they would of the parking lot, on the back side." Deputy Mayor McLeod further suggested that "The back could also be built to look like the front." Mr. Daly stated, "That's what we were talking about, and that is something we would be very interested in doing. We could still even put in a frontage road, if it made i't look and feel like a Town Center." Deputy Mayor McLeod added, "I don't know that you would have to necessarily put a frontage road in there, because you're eating up more green space, and I think I would rather see some green space in the parking lot, even an island, or whatever if you could between that and the road, therefore I would be much less objectionable to only two of the buildings that may have to face the roadway to the north, unless you were able to move that section of the road back toward the water, and actually move those forward. And I think your project then would work, at east from our perspective, or my perspective. I have a real problem, like Commissioner Blake did, and Commissioner Miller with the garages facing - if you somehow can work out to have a design that makes it look - the back of the house kind of look like the front, from the roadway, and I've seen that done before. I would have no problem working anything else out with you, through the City Manager and Staff that needs to be done, within reason, on the project. I think that would be a real strong, good faith effort, for everybody to try to make it work." Mr. Daly replied, "And we would be more than willing, and I've had that discussion specifically with Centex, and they have indicated that they would be more than willing to do just what you are talking about." Deputy Mayor McLeod added, "I would be just more favorable to look at this thing, getting the - front, to become the back, and flip them around. Manager McLemore added, "I just wanted to say in appreciating what you said, CITY OF WINTER SPRINGS MINUTES CITY COMMISSION SPECIAL MEETING - MARCH 21, 2001 PAGE 6 OF 14 that you would leave us the full latitude to explore a number of different alternatives, not just that one." Deputy Mayor McLeod agreed with Manager McLemore. Commissioner Cindy Gennell asked, "I wanted to know the property in front of Winding Hollow, along 434, is that all wetlands, or can that be developed eventually?" Manager McLemore agreed that it was wetlands. Mr. Daly added, "I think that runs all the way to the wetland on our property boundary." Commissioner Gennell further inquired, "So if there were an access road there, it could only go for just a little ways anyhow. I would just as soon see, you be able to take advantage of that to enhance your project a little bit, and get those garages off the road - perhaps turn your buildings or something." In discussing the "proposed commercial piece" of property on the eastern edge, Commissioner Blake advised Manager McLemore that regarding the discussion to possibly "Allow a convenience store, a small market or something perhaps that would serve gasoline to vehicles, Ron, I would want any development of that sort to strictly comply with the Town Center." Manager McLemore agreed. Deputy Mayor McLeod opened the "Public Input" portion of this Agenda Item. No one spoke. The "Public Input" portion of this Agenda Item was closed. "MOTION TO MOVE ITEM 'B' TO SECOND READING." MOTION BY COMMISSIONER MARTINEZ. SECONDED BY COMMISSIONER MILLER. DISCUSSION. "MR. MAYOR, I WOULD LIKE TO AMEND THE MOTION TO - ADD THE DIRECTION TO HAVE STAFF CONTINUE DISCUSSIONS WITH THE LANDOWNER AND THE PROPERTY DEVELOPER TO EMBODY THE DISCUSSIONS WE'VE HAD THIS EVENING." MOTION BY COMMISSIONER BLAKE. SECONDED BY COMMISSIONER MILLER. DISCUSSION. MANAGER McLEMORE ADDED, "WHICH INCLUDE EXPLORING A NUMBER OF DIFFERENT KINDS OF ALTERNATIVES." SEVERAL COMMISSIONER STATED, "YES." DEPUTY MAYOR McLEOD ADDED, "IS THERE A TIME FRAME IN THAT?" MANAGER McLEMORE STATED, "I WOULD SAY THE INCENTIVE IS ON BOTH OUR PARTS TO GET THEM MOVING AS QUICKLY AS POSSIBLE." COMMISSIONER BLAKE STATED, "I THINK THERE IS INCENTIVE CERTAINLY ON THE DEVELOPER'S PART TO DO THIS AS QUICKLY AS POSSIBLY, SO I THINK WE WILL BE THERE." Community Development Department - Planning Division Requests The City Commission Hold A Public Hearing For First Reading And Consideration Of Ordinance 2001-20 To Adopt The Large Scale Comprehensive Plan Amendment (LS-CPA-S-OO) That Would Change The Future Land Use Map Designation Of The Property From (County) "Medium Density Residential" (Max. 10 DU Per Acre) To (City) Designation "Town Center", On Property Located On The West Side Of Tuskawilla Road And Adjacent On The South Side Of Milky Way Avenue. "MOTION TO READ BY 'TITLE' ONLY." MOTION BY COMMISSIONER BLAKE. SECONDED BY COMMISSIONER MILLER. DISCUSSION. Attorney Garganese read Ordinance 2001-20 by "Title" only. Commissioner Blake stated, "Mr. Grimms, there were three (3) different parcels, three (3) different sections - in my packet, it says that one of those was removed. 1 thought two (2) of those were removed." Mr. Grimms replied, "I talked to the developer's representative, he said that the little sliver, shall we say, the very south part of the property that borders Oak Forest, was removed also." Commissioner Blake asked CITY OF WINTER SPRINGS MINUTES CITY COMMISSION SPECIAL MEETING - MARCH 21, 2001 . PAGE 8 OF 14 Attorney Garganese, "Does the Ordinance as drafted, reflect that?" Attorney Garganese responded, "We have two (2) legal descriptions, one for a 29.6655 acre parcel and one for a 5.644 acre parcel. I do not have a survey to review." Commissioner Blake added, "The part that I am particularly concerned with that was omitted was, I believe it's .836 acres, defined as - property three (3), and I just want to make absolutely certain that any action we take tonight does not include that property three (3)." Mr. Grimms added, "The request of the developer is that only property two (2) be considered." Manager McLemore stated, "We could take that direction into the second reading and make sure what we bring back, is consistent with that." Discussion. Ms. Sandy Bierly, CHC Development: advised the Commission that "The property is 38.37 acres." Commissioner Blake further inquired, "And what does that include, in terms of defining it by the parcel or property numbers." Ms. Bierly stated, "Parcel two (2) only." Commissioner Blake then stated, "That's only property two (2)." Ms. Bierly stated, "That's correct." Attorney Garganese stated, "For the purposes of the first reading, why don't we just attach as the exhibit, that a small Bower-Singleton property boundary map that identifies property one (1), property two (2), and property three (3), it is in your package. We'll just for first reading purposes take this map and state that this amendment is just for property two (2), and then we hope we can get a legal description cleared up for the next reading, and attach it - to the Ordinance." COMMISSIONER BLAKE STATED, "I WILL HAVE TO VOTE AGAINST THIS UNLESS WE AMEND THE MOTION, SO IT IS AS WE DISCUSSED, WHICH INVOL VES PROPERTY TWO (2), WHICH IS DIFFERENT THAN WHAT THE ITEM IS, BECAUSE THE ITEM HAS THE WRONG ACREAGE IN IT, AND DISCUSSES A DIFFERENT SOUTHERN BOUNDARY THAT WOULD INCLUDE PROPERTY THREE (3)."
