REQUEST: The Community Development Department presents to the City Commission a
request to hold a public hearing to consider a Special Exception to allow an automobile repair
shop for only routine service, as set forth in the City's Town Center District Code.
PURPOSE: The purpose of this agenda item is to consider a request of Mr. Joseph Miranda,
the applicant, for a Special Exception to allow an automobile repair (routine service) at 1135 East
S.R. 434, within the Town Center zoning district. This would allow the applicant to proceed
with preliminary and then final site plans for the project - both of which would be subject to the
public scrutiny at public hearings with the City Commission.

. .. In granting a special exception, the City Commission must find by substantial
competent evidence that:
1. The proposed development contributes to, promotes and encourages the
improvement of the Winter Springs Town Center and catalyzes other
development as envisioned in the Winter Springs Town Center regulations.
2. The proposed development will not have an unfavorable effect on the
economy of the Winter Springs Town Center.
3. The proposed development abides by all rules in this code other than those
specifically excepted, ...

4. The proposed development meets any reasonable additional conditions,
restrictions or limitations deemed necessary by the City Commission in order
to preserve and promote the intent of the Winter Springs Town Center Master
Plan.
Procedure for Special Exceptions:
1. Approval may be granted only after a minimum of two discretionary reviews.
The first review shall be before the Development Review Committee, at which
time the Development Review Committee shall review the project and provide
to the City Commission an advisory recommendation regarding approval,
approval with conditions, or disapproval. The second review shall be a public
hearing held before the City Commission and shall be held no sooner than
seven calendar days following the Development Review Committee hearing.
2. Requests for special exceptions under this ordinance shall include each exhibit
required in the Administrative Review Process per section II, part B of this
code. In addition, the City Commission may within reason require additional
exhibits and may defer approval of the special exception application or
schedule an additional public hearing or hearings to review those exhibits.
3. Special exceptions shall not be unreasonably withheld, but the City
Commission shall have authority to require that the applicant satisfy any
additional conditions it deems necessary to fulfill goals of the master plan,
including reasonable offsite improvements directly related and proportionate
to the specific impact of the request, or further review(s) and approval by the
Development Review Committee.
4. The City Commission may grant the approval of an application for special
exceptions from the code in whole or in part upon a majority vote of its
members.
B. City Code of Ordinances:
Section 20 - 83. Procedures.
(c) All meetings for consideration of a variance, special exception or conditional
use shall be noticed for at least seven (7) days prior to the date of the meeting in
the following manner:
(1) Posting the affected property with a notice of the meeting which
indicates the matter to be considered.
(2) Posting in city hall a notice of the meeting which indicates the
property affected and the matter to be discussed.

(3) At least seven (7) days prior to the meeting, the board of adjustment
shall also notify all owners of property adjacent to or within one hundred
fifty (150) feet of the property to be affected of the time, date and place of
the meeting. Such letter must also indicate the variance, special exception,
or conditional use requested, and must require proof of delivery.
(d) All interested persons shall be entitled to be heard as such meetings or to be
heard by written statement submitted at or prior to such meeting.
(e) In the event a special exception, variance or conditional use is not authorized
by ordinances of the city, the person requesting the unauthorized action must
submit an application pursuant to section 20-28.
(h) Any variance, special exception or conditional use which may be granted by
the council shall expire six (6) months after the effective date of such action by
the city commission, unless a building permit based upon and incorporating the
variance, special exception or conditional use is obtained within the aforesaid six-
month period. However, the city commission may renew such variance, special
exception or conditional use for one (1) additional period of six( 6) months,
provided good cause is shown and the application for extension shall be filed with
the board at least thirty (30) days prior to the expiration of the six-month period.
Any renewal may be granted without public hearing, however, a reapplication fee
may be charged in an amount not to exceed the amount of the original application
fee. It is intended that provisions contained within this subsection are to be
retroactive to the extent that any variance, special exception or conditional use
previously granted shall become void if a period of time in excess of twelve (12)
months shall have lapsed, and a building permit based upon and incorporating the
variance, special exceptions or conditional uses has not been issued prior to
expiration of such time limit.
CHRONOLOGY:
May 31, 2001 - Special Exception application and fee received by City
June 11, 2001 - Winter Springs annexed the 1.36-acre site
Representatives from Dover, Kohl & Partners, the City's Town Center consultant,
worked with the applicant and his team to prepare a conceptual site plan and
conceptual architectural renderings for the site
June 27, 2001 - Future Land Use designation is amended to Town Center District

September 10,2001 - Zoning is changed to Town Center District
FINDINGS: The Staff Development Review Committee, at its July 17, 200 I, meeting, found
the concept of an automobile repair shop, for routine service only, in the Town
Center District, to be consistent with the general zoning and with the public
interest. This finding did not address specific site-plan issues. Those issues will
be addressed during the site-plan review process.
Dover, Kohl & Partners, the City's consultant for the City Center, has worked
with the applicant to ensure that the project is consistent with the Town Center
theme. Please see the attached Dover, Kohl & Partners memorandums in
Attachment "F."
STAFF RECOMMENDATION:
That the City Commission approve the Special Exception to allow an automobile
repair shop for routine service in the Town Center District at 1135 East S.R. 434,
subject to the following conditions (please also see Dover, Kohl & Partners
memorandum in Attachment "F"):
1. Noise: Activities producing noise, audible from surrounding properties
shall be prohibited from 10:00 P.M. until 7:00 A.M. and daytime noise levels
must be restricted.
2. Signage: Signage must conform to the Town Center requirements.
3. Vehicle Storage: Vehicles waiting for repair must be stored in the rear of the
site, not visible from the public rights-of-way. Garden walls, fences, or hedges
may be used to screen vehicles from the public view. A 6-foot tall masonry wall
must be provided across the rear of the facility. The site is not to be a towing
storage area - there will be a reasonable limit to the time a vehicle may be kept at
the site. On-site work shall be limited to minor automobile repairs and express
lube. There shall be no retail sales of automobile parts or accessories.
4. Pollution and other environmental concerns: Existing rules governing
noxious fumes, disposal of waste materials etc., must be observed. Fumes and
obnoxious odors generated by the automobile repair shop must not affect the
surrounding properties.

Dear Mr. Baker,
In response to your request regarding the Winter Springs Automotive facility, I offer you
the following description.
Winter Springs Automotive will be a five bay light repair shop with three bays for sman
automobile repairs and two bays for express lube. It will be open to the general public of
Winter Springs and the surrounding neighborhoods.
Only cars needing to be towed in for minor repairs Will be dropped off at this location,
Any cars needing major engine work or wrecked cars will not be dropped off nor worked
on in this facility.
There will be no retail sales of automotive parts in this facility.
I have talked to Mr. Joe Miranda and am writing this to you at his request and to state his
given intentions as to this facility.

Subject: Occupancy standards for the S.R.434 Automobile Repair Shop
Charles,
Below are some recommendations for ways to deal with some of the typical problems
with automobile repair shop uses within mixed-use areas:
Noise: Activities producing noise audible from surrounding properties could be
prohibited during certain hours (i.e. from 10pm to 7am.)
Signage: 1 think the code already covers signage issues pretty comprehensively.
Temporary signs should be subject to the same standards as permanent signs.
Vehicle Storage: Vehicles dropped off for repair should only be stored to the rcar of the
facility. They should not be stored where visible from public streets. Garden walls,
fences or hedges may be used to screen vehicles from view.
Pollution and other environmental concerns: Existing rules governing noxious
fumes, disposal of waste materials etc., should of course be foHowed. Fumes and smells
generated by the automobile repair shop should not be allowed to impact surrounding
properties.

Dear Adjacent Property Owner:
The Winter Springs City Commission will consider a request, on September 24,
2001, by the property owner, Mr. Joseph Miranda, for a Special Exception to allow an
automobile repair shop at the 1.36 acre site, located at 1135 East S.R. 434. The Town
Center District Code allows automobile repair shops, for routine service, as a special
exception, which requires a pubic hearing before the City Commission. The applicant is
proposing only routine service be performed at the site. If the special exception is
approved, the applicant must submit a specific site plan for review by City Staff before it
too is approved or denied at a public hearing by the City Commission.

1.36-acre site at 1135 East S.R. 434; A Special Exception is required for an automobile repair
(routine service) shop in the Town Center zoning district. Reasonable conditions may be attached
to a Special Exception to fulfill the goals of the Town Center district. Special Exception approval is
a prerequisite for site plan approval.

Dear Commissioners:
We reside at 1130 E, SR434. We are presently out of the state. and have asked
Mr. Carrington to read this Jetter at the hearing.
We have two concerns regarding this proposed exception, its location and the
viability of such an enterprise.
) . Granting this special exception will be a devastating embarrassment to the city aDd its
commissioners. Imagine; after spending 6 million dollars on planning, landscaping,
and hours of hard work. the first construction as a result of the vast effort will be a
tbree.stall auto repair shop on the main highway through the city. Let us hope the
loW papers do not pkk up that one. In May of this year we, the owners of property
across the street, spent $5,000 demolishing a building no less handsome than the one
proposed to be erected.
Our desite is to have a bank building, a library, or perhaps a regional headquarters fur
a national corpc:tl'ation. or an attractive. campus-style office complex. A repair shop with
crippled vehicles littering the view wiJJ not enhance the prospects, -
2. Preliminary sketches show a two-sto,ry building fronting fur a three-stan repair shop
in the back. You can put aU the restrictions imaginable upon this fledgling business,
but you can.oot repeal the Jaws of nature. In less than a year you will be asked to
allow putting an old auto body atop a 2Q-ft. pole to help advertise the business, There
is no demand for a back yard repair shop even though the front is on 434.
