HomeMy WebLinkAbout2006 02 27 Regular Item 301 Police Department Code Enforcement COMMISSION AGENDA ITEM 301 REGULAR X February 27.2006 Meeting MGR / DEPT Authorization REQUEST: The Police Department-Code Enforcement Bureau presents to the City Commission the request of Mr. Able Gailbort to park an oversized recreational vehicle at his residence located at 1315 Deer Run, Winter Springs, Florida. PURPOSE: This agenda item is needed to request the City Commission to consider Mr. Gailbort's request for a yearly permit to store his recreational vehicle at 1315 Deer Run. CONSIDERATIONS: The Code Enforcement Bureau received a complaint for an oversized RV at 1315 Deer Run. Mr. Able Gailbort's recreational vehicle was measured and is approximately 40' in length and 12' in height. Mr. Gailbort was issued a warning for oversized R V and instructed the R V must be removed from a residentially zoned district. Currently, the RV has been removed and Mr. Gailbort is in compliance with City Code. However, the City Code allows for the City Commission to issue a 1 year permit, renewable each subsequent year thereafter. We have not had any request for this type of permit as of August 8, 2002 at the Police Department. A search of our records provided that the only approved request granted by the city commission under this Code was on September 27, 1999 for Mr. Wimberly of 1105 Ermine Avenue and was not renewed the following year. In Mr. Wimberly's request there were no complaints from the neighbors presented and in fact were there to speak in behalf of Mr. Wimberly. We have however received complaints from the neighbors in this request for permit. APPLICABLE LAW AND PUBLIC POLICY: Under current City Code Section 20-431(1) f. No recreational vehicle in excess of (28) feet in length in overall measurements shall be parked or stored in a residentially zoned district without a permit issued by the city commission and renewed annually by such commission. In the case of a truck camper, the length measurement will include truck and camper. FUNDING: None. February 27,2006 Regular Agenda 301 Page 2 of2 RECOMMENDATION: Staff has reviewed the request from Mr. Gailbort and there are no extenuating circumstances in this request and we have received several complaints. Our recommendation is to deny the request ofMr. Able Gailbort for permitting his oversized recreational vehicle. IMPLEMENTATION SCHEDULE: Immediately upon approval by Commission. COMMISSION ACTION: 1315 Deer Run Drive City Commissioners Winter Springs, FL 32708 February 10, 2006 Captain Glen Toleson City of Winter Springs I, Abel Gailbort and Maria Gaibor and Family, bought this property knowing at the time of purchase there were no restrictions with the deed, according to the Broker. All of a sudden these violations are coming in in the mail and at my front doors. We paid $400,000 for this house knowing if I could park it on my property. We are disappointed about having to remove our RV off our property. We are seeking from the Commissioners to have this permit approved and also to let you know that the RV cost us $350,000 and right now we are paying lots of money for storage when I have my own house. This was my last wish when buying this RV. We're looking forward to be placed on the City's Agenda to discuss the matter. Thank you for your assistance in this matter.
