HomeMy WebLinkAbout2006 02 27 Public Hearing Item 201 Approve Resolution 2006-10 COMMISSION AGENDA ITEM 201 Public Hearing X MGR./DEPT Authorization FebruaIy 27,2006 Meeting REQUEST: The Public Works Department requests the City Commission approve Resolution 2006-10 allowing for on street parking on George Street by resolution. PURPOSE: The purpose of this request is to for the City Commission to approve Resolution 2006-10 authorizing on street parking on George Street as provided for in Chapter 12-65 of the Code of Ordinances. APPLICABLE LAW AND PUBLIC POLICY See. U-65. General prohibitions Except when necessary to avoid conflict with other traffic or to comply with law or the directions of a police officer or official traffic control device. no person shall: (1 ) Stop, stand, or park a vehicle: a. On any roadway, except as follows: (A) Parking of vehicles on roadways may be expressly authorized by city code within a particular Zoning district. (B) The city commission may on a case-by-case basis establish site specific parking zones on roadways for vehicles, Such parking zones shall be established by resolution at a public hearing. A parking zones shall become effective upon the chief of police erecting a sign(s) or marker(s) identifying the parking zone in accordance with the traffic signage requirements of this chapter and state law and any conditions set forth in the resolution adopted by the city commission. CONSIDERATIONS: This resolution approval is needed to allow on-street parking on George Street. The homes on George Street generally have single car driveways with multiple cars. This has led to parking on the sidewalks which is a pedestrian hazard and reduces the aesthetic appeal of the neighborhood. 022706_ COMM _Public _ Hearing_ 201_ Resolution _ 2006-10_ George_Street _ On_Street _Parking Public Hearing Agenda Item 201 February 27, 2006 Page 2 The parking would be allowed on the west side of George Street adjacent to the homes. All sidewalks would be repaired after the on-street parking was implemented. The on-street parking would be effective when the Police Chief approved signage was installed. RECOMMENDATION: Staff recommends that the Commission approve Resolution 2006-10 to allow on-street parking on George Street. IMPLEMENTATION SCHEDULE: The Police Chief approved signage would be installed within 21 days. Sidewalk repairs would be complete within 60 days. ATTACHMENTS: 1. WHEREAS, the City Commission adopted Ordinance 2005-18 pursuant to Florida Municipal Home Rule Powers Act, section 316.018, Florida Statutes, and Chapter 12 of the city Code; and WHEREAS, the City Commission of the City of Winter Springs, Florida, has previously determined that it is in the best interest of the safety, health, and welfare of the citizens of the City of Winter Springs to regulate on-street parking; and WHEREAS, the City Commission hereby finds that the continued regulation of on-street parking is necessary for purposes of ensuring adequate vehicular access for police and fire protection, enhancing the visual appearance of neighborhoods, and reducing traffic congestion and on-street accidents; and WHEREAS, the City Commission of the City of Winter Springs, Florida, deems it appropriate to evaluate the need and/or benefit relating to on-street parking on a case-by-case basis at a public hearing; and WHEREAS, there is inadequate off-street parking for the residences on George Street; and WHEREAS, the lack of off-street parking on George Street creates a sidewalk pedestrian hazard and detracts from the visual appearance of the neighborhood; and WHEREAS, the approval of on-street parking on the residence side of George Street will improve pedestrian safety and improve the visual appearance of the neighborhood. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF WINTER SPRINGS, FLORIDA, AS FOllOWS: SECTION I - The City Commission of the City of Winter Springs hereby designates an on-street parking zone on George Street to be signed accordingly as determined by the Chief of Police. SECTION II - All prior inconsistent resolutions of the City Commission are hereby repealed in their entirety to the extent of the conflict with this resolution.
