REQUEST: Utility Department Requesting the City Commission Adopt Resolution
#2001-09 Implementing Water Shortage Restrictions.
PURPOSE: The purpose of this Board item is for the City Commission adopt Resolution
#2001-09 implementing Water Shortage Restrictions as provided for in Ordinance-
#2001-11.
CONSIDERA TIONS:
This resolution is needed to implement water shortage restrictions that are
necessary to protect the water resources that have been negatively impacted by the lack of
rainfall the last two years. This resolution enables staff to enforce the water restrictions
implemented on January 15, 2001 by the St. Johns River Water Management District. It
exceeds SJR WMD restrictions by the fact that residential reclaimed water usage is
proposed to be included in the ordinance.
It is our intent to exclude reclaimed water irrigation by the golf courses and parks
in the proposed resolution. The golf courses and our Parks Director have indicated that
they will work to voluntary comply with the restrictions for rough areas, practice fields,
passive areas, and other non-play areas. The irrigation restrictions issued by the
SJRWMD order declaring a severe water shortage within Seminole County have been
previously distributed and this resolution mimics those restrictions with the addition of
reclaimed water.
Staff is recommending the inclusion of reclaimed water for the following reasons:

. Reclaimed water should also be considered a resource
· Reclaimed demand exceeded supply 19 times in 2000 (ran out)
· Uniformity of enforcement
· If we utilize the well on the golf course to augment the reclaimed water
supply, the SJRWMD requires reclaimed water irrigation to also
follow the restrictions. In 2000, we augmented with 81 million gallons
from the well.
Police, Code Enforcement and Utility staff will conduct enforcement of the
restrictions.
FUNDING:
No funding is needed at this time. It is anticipated that any revenues collected
from fines would go to the General fund to cover enforcement costs.
RECOMMENDATION:
It is recommended that the City Commission adopt Resolution #2001-09
Declaring an Emergency Water Shortage and Implementing the Restrictions
included in the Resolution.
IMPLEMENTATION:
Notification of the restrictions will included in the water bill, newsletter and a press
release. Enforcement will be by Utility, Code Enforcement and Police staff

A RESOLUTION OF THE CITY COMMISSION OF
WINTER SPRINGS DECLARING AN EMERGENCY WATER
SHORTAGE CONDITION AND IMPLEMENTING THE
RESTRICTIONS DEFINED HEREIN; PROVIDING coFOR
REPEAL OF PRIOR INCONSISTENT RESOLUTIONS; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Winter Springs has received below average
rainfall for the last two years resulting in significantly lower groundwater levels; and
WHEREAS, conditions are such that there is a possibility that insufficient
good quality water will be available to meet user demands and a reduction in total
water use within the area is necessary to protect water resources from serious harm;
and
WHEREAS, City Ordinance #2001-11, Section 19-203, authorized the
implementation of water restrictions by adoption of a resolution; and
WHEREAS, the St. Johns River Water Management District issued an
Order Declaring A Severe Water Shortage effective January 15, 2001; and
WHEREAS, Chapter 40C-21, Florida Administrative Code is the
SJRWMD's Water Shortage Plan; and
WHEREAS, the SJRWMD imposed Phase II Severe Water Shortage
Restrictions in accordance with 40C-21.631, F.A.C. as part of the Order;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF WINTER SPRINGS, FLORIDA, AS FOLLOWS:
SECTION I - The City Commission of the City of Winter Springs hereby
declares that an emergency water shortage condition exists affecting Winter Springs
said emergency and the water restrictions set forth hereunder shall continue in full
force and effect until such time the City Commission adopts a resolution declaring the
emergency has ceased to exist.
SECTION II - Landscape irrigation for all water sources, including
reclaimed water, is limited to two days per week and shall not occur between the hours
of 10:00 A.M. and 4:00 P.M. Irrigation of existing landscape with even or no addresses
is only allowed on Thursday and Sunday; odd addresses are limited to Wednesday and
Saturday. New landscape is authorized to be irrigated on any day between the hours
of 4:00 P.M. and 10:00 A.M. during the first 30 days following its installation.
Reclaimed usage by golf courses and public parks shall be voluntarily reduced and
exempt from these provisions. Personal vehicle washing and hand watering are
permitted using a handheld hose equipped with an automatic shut off nozzle.
Agricultural, nursery, and commercial car washing restrictions are in accordance with
F.A.C. 40C-21-631 - Phase /I Severe Water Shortage, a copy of which is attached
hereto and fully incorporated herein by this reference.
SECTION III - The water restrictions set forth hereunder shall be
enforced by the City as provided for in Ordinance #2001-11.
SECTION IV - All prior inconsistent resolutions of the City Commission
are hereby repealed in their entirety to the extent of the conflict with this resolution.
SECTION V - This Resolution shall take effect immediately upon adoption
by the City Commission.

40C-21.631 Phase IT Severe Water Shortage. The folhwing restrictions shall apply when a
Phase II watff shortage is declared by the District.
(1) EssEntial/DomesticIU tility /ComIrercial
(a) EsSEntial Use
1. The use of watff for flfefighting. and health or medtal purposes will not be
restricted.

1. Initial pressure at the point of use (meter) will be reduced by 15% where it is
operationally feasible to do so. Prior to the reduction of pressure, the utility will notify the
appropriate fife-fighting agencies and make arrangements for diroct comrrunicatbn when additional
pressure is required.
2. New watff line flushing and disinfection will be restricted to the hours of 9:00 p.m.
to 7:00 a.m. seven days per week
3. As appropriate the utility should institute additional voltmtary conservation
measures such as redaimingof backwash wate-, improving and accelerating leak detoction surveys
and repair progams, installing and calibrating mete-s, and stabilizing and equalizing system
pressures.
(d) POWff Production Use
Wate- used for powe- production should be voltmtarily reduced.
(e) COIl1Irercial and Industrial Proress Use
1. COIl1Irercial car washes will be restricted as folbws:
a. for washes servicing passenger vehicles and mobile equipment weiEfling less than 10,000
pounds,
i. use in excess of 75 gallons per wash will be prohibited and
ii. use equal to or less than 75 gallons per wash should be vohmtarily reduced;
b. for washes servicing mobile equipment weiEfling 10,000 pounds or more,
i. use in excess of 150 gallons per wash will be prohibited and
iii. use equal to or less than 150 galbns per wash should be vohmtarily reduced.
2. Watff use for cOIl1Irercial and industrial proresses should be vohmtarily reduced.
(2) Agrtulture
(a) Agrtultural Use
1. Ovemead irrigation, including portable volume guns, will be restricted to the hours of
2:00 p.m. to 10:00 a.m.
2. Low vohune irrigation hours will not be restricted.
3. Flood and seepage irrigation will not discharge tai1waters from the property.
4. All irrigation systems will be operated in a manner that will maximize the percentage
of wate- withdrawn and held whim is plared in the root zone of the crop and will minimize the
amount of wate- whim is witlxlrawn and relmsed or lost to the user but is not immaiiately available
for othe- users. ,
5. Users having access to more than one source Class will maximize the use of i'he lesser
or least restricted source class.
(b) Livestock Use
Livestock wate- use should be voluntarily reduced.
(c) Aquocultural Use
Aquocultural watff use should be vohmtarily reduced.
(d) Soil Flooding
1. Soil flooding for pest control or soil preservation will be prohibited.
2. Soil flooding to permit harvestingof sod should be voluntarily reduced.

(e) Freeze Protection
Watff' use for freeze protection will be restricted to situations in which official weather
forecastingservices predict temperatur<5 likely to cause permanent damage to crops and when the
wet bulb temperature drops to 43 Fahrenheit or lOWEr.
(3) NurserylLandscape Irrigat iorvRecre<t ion
(a) Nursery Use
1. Low voh.nne irrigation uses and low volwne hand watEring should qe vohmtarily
reduced.
2. Ovemead irrigation uses will be restricted as follows:
a. insne - 8:00 am. to 8:00 p.m., seVEn days per week
b. outside - 7:00 p.m. to 7:00 a.m., on odd numbered days.
3. Flood irrigation systems will be restricted to 6 days per month.
4. Applications of fertilizers. herbicides and pesticides should be coordinated with
irrigation schErlules.
(b) Landscape irrigation - New Installation
1. For iristallations which have been in p lare for less than 30 days and
a. less than 5 acr<5 in size, wate- use for irrigation shall be restricted to the hoUl~ of 2:00 a.m.
to 8:00 am., Monday, Wedresday and Friday,
b. 5 acr<5 or greater in size, watEr use for irrigation shall be restricted to the hours of
12:01 a.m. to 8:00 a.m., Monday, Wednesday, Thursday and Friday.
2. Low volwne hand wate-ing of new landscap ingshould be voluntarily reduced.
3. Cleaning and adjusting of new irrigation systems will be restricted to 10 minutes per
zone on a one time basis.
(c) Landscape Irrigation - Existing Installation .
1. For existing installations less than 5 acr<5 in size, watff' use for irrigation will be
restricted to the hours of 4:00 a.m. to 8:00 a.m., two days per week.
a. Installations with odd addresses will be permitted to irrigate on Wednesday and
Saturday.
b. Installations with even addresses or no address will be permitted to irrigate on
Thursday and Sunday.
2. For existing installations 5 acres or greaer in size. water use for irrigation will be
restricted to the hours of 12:01 a.m. to 8:00 a.m., two days per week.
a. Installations with odd addresses will be permitted to irrigate on Wednesday and
Sat urday .
b. Installations with even addresses or no address will be permitted to irrigate on
Thursday and Sunday.
3. Applications of fertilizers. herbicides and pesticides should be coordinated with
irrigation schErlules.
(d) Recreation Area Use
Existing and new recreation area watff' use will be restricted as provided in paragraphs ( b)
and (c) respectively.
(e) Golf Course Use
1. Irrigation of greEns and tees should be voluntarily teduced and will be accomp lishoo
during nondaylight hours.
