HomeMy WebLinkAbout2001 03 26 Public Hearings H Second Reading - Ordinance 2001-14 Reece Property Future Land Use Map COMMISSION AGENDA ITEM H Consent Informational Public Hearing X Regular March 26, 2001 Meeting I~ .L Mgr. / Attor / Authorization REQUEST: The Community Development Department - Planning Division requests the City Commission hold a public hearing for second reading of Ordinance 2001-14 to adopt a small scale comprehensive plan amendment (SS-CPA-2-2001) that would change the Future Land Use Map designation of a 6.2 acre property from (County) "Commercial", "Industrial" and "Low Density Residential" to "Industrial" on 6.2 acres located on Nursery Road on the east side of U.S. 17/92. PURPOSE: The purpose of this Agenda Item is to request the Commission hold a public hearing for second reading of Ordinance 200] -14 to change the Future Land Use Map designation to allow the property owner to build additional structures for industrial operations. APPLICABLE LAW AND PUBLIC POLICY: The provisions of 163.3187(l)(c) F.S. which state in part: "Any local government comprehensive plan amendments directly related to proposed small scale development activities may be approved without regard to statutory limits on the frequency of consideration of amendments to the local comprehensive plan. . . " CONSIDERATIONS: · The area on the north, south, and west have commercial and industrial operations. CDD/March 19,2001/3:54 PM MARCH 26, 2001 PUBLIC HEARING AGENDA ITEM H Page 2 . The property was in the unincorporated portion of the county until it was annexed on January 22, 2001. . On March 14, 2001, the Commission approved the first reading of Ordinance 2001-14 to adopt a small scale comprehensive plan amendment (SS-CPA-2-2001) that would change the Future Land Use Map designation of a 6.2 acre property from (County) "Commercial", "Industrial" and "Low Density Residential" to "Industrial" on 6.2 acres located on Nursery Road on the east side of US. 17/92. FINDINGS: . The proposed Future Land Use Map designation "Industrial" for development of commercial/industrial activity, is compatible with the commercial/industrial nature of US. 17/92. . The proposed future land use change from (County) "Commercial", "Industrial" and "Low Density Residential" to (City) "Industrial" will not negatively impact adjacent land uses, since on the north and south sides of the subject property there are existing commercial/industrial operations and on the west side by more commercial activity within Longwood, across from US. 17/92. Therefore, the designation of the subject property as "Industrial" would be consistent and compatible with the City's Comprehensive Plan. . The City is willing to extend sewer, water, and other urban services to the subject property and adjacent parcels that it provides to other areas of the City when the trunk lines are extended in the near future. . The proposed use of the property for commercial/industrial activity will have a positive, significant economic impact on the City. . The traffic generated from a commercial activity on 6.5 acres will not cause any significant reduction in the Level of Service Standard or threaten the Level of Service of U.S. 17/92. The applicant has not determined specifically what commercial/industrial activity he may want to develop on the subject property. The property owner is subject to the land development requirements found in Chapter 9 of the City Code. The amendment request would not be in conflict with the Metropolitan Planning Organization (now called MetroPlan) Plan or the Florida Department of Transportation's 5 Year Plan. STAFF RECOMMENDATION: Staff recommends the City Commission hold a public hearing for second reading and adoption of Ordinance 2001-14 to change the Future Land Use Map designation of a 6.2 acre property from (County) "Commercial", "Industrial" and "Low Density Residential" to (City) "Industrial". LOCAL PLANNING AGENCY RECOMMENDATION: The Local Planning Agency at its March 7,2001 meeting recommended the City Commission approve the change of Future Land Use Map designation of a 6.2 acre property from (County) "Commercial", "Industrial" and "Low Density Residential" to ( City) "Industrial". Seq., Florida Statutes (1987) established the Local Government Comprehensive Planning and Land Development Regulation Act, and WHEREAS, section 163.3167, Florida Statutes, requires each municipality in the State of Florida to prepare and adopt a Comprehensive Plan as scheduled by the Florida Department of Community Affairs, and Ordinance 2001-14 City of Winter Springs WHEREAS, the Local Planning Agency of the City of Winter Springs held a duly noticed public hearing, in accordance with the procedures in Chapter 163, Part II, Florida Statutes, on the proposed Comprehensive Plan amendment and considered findings and advice of staff, citizens, and all interested parties submitting written and oral comments and has recommended adoption to the City Commission; and WHEREAS, pursuant to section 9J-11.006, Florida Administrative Code, tins SMALL SCALE Comprehensive Plan amendment will not cause the City to exceed its twice yearly submittal allowance for comprehensive plan amendments; and WHEREAS, on March 26, 2001, the City Commission of the City of Winter Springs held a duly noticed public adoption hearing on the proposed plan amendment set forth hereunder and considered findings and advice of staff, citizens, and all interested parties submitting written and oral comments and supporting data and analysis, and after complete deliberation, approved and adopted the proposed Comprehensive Plan amendment set forth hereunder, and WHEREAS, the emergency Comprehensive Plan amendment adopted by this Ordinance complies with the requirements of the Local Government Comprehensive Planning and Land Development Regulation Act and the amendment is in the best Ordinance 2001-14 City of Winter Springs 2 interests of the public health, safety, and welfare of the citizens of Winter Springs, Florida and serve a legitimate governmental interest. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, SEMINOLE COUNTY, FLORIDA, AS FOLLOWS: Section 1 Recitals. The foregoing recitals are tnle and correct and are fully incorporated herein by this reference. Section 2 Authority. This Ordinance IS adopted in compliance with, and pursuant to, the Local Government Comprehensive Planning and Land Development Regulations Act, sections 163.184 and 163.187, Florida Statutes. Section 3 Purpose and Intent. It is hereby declared to be the purpose and intent of this Ordinance to clarify, expand, correct, update, modify and otherwise further the provisions of the City of Winter Springs' Comprehensive Plan. Section 4 Adoption of Amendment to the Future Land Use Map. The City of Winter Springs' Comprehensive Plan, Future Land Use Map, is hereby amended by designating the real property depicted on Exhibit 1 as "lndustriall". Exhibit 1 is attached hereto and fully incorporated herein by this reference.. Any real property with a "Conservation" future land use designation depicted on the City or County Ordinance 2001-]4 City of Winter Springs 3 Future Land Use Map on the effective date of this Ordinance shall maintain its "Conservation" designation. Section 5 Transmittal to the Department of Community Affairs. The City Manager or his designee is hereby designated to sign a letter transmitting this adopted Comprehensive Plan amendment to the Florida Department of Community Affairs, in accordance with section 1633187(l)(c)(4), Florida Statutes, and section 9J-11, Florida Administrative Code. Section 6 Repeal of Prior Inconsistent Ordinances and Resolutions: All prior inconsistent ordinances and resolutions adopted by the City Commission, or parts of ordinances and resolutions in conflict herewith, are hereby repealed to the extent of the conflict. Section 7 Severability: If any section, subsection, sentence, clause, phrase, word or provision of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, whether for substantive, procedural, or any other reason, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions of this Ordinance. Ordinance 2001-14 City of Winter Springs 4 Section 8 Incorporation into Comprehensive Plan. Upon the effective date of the Comprehensive Plan amendment adopted by this Ordinance, said emergency Amendment shall be incorporated into the City of Winter Springs Comprehensive Plan and any section or paragraph number or letter and any heading may be changed or modified as necessary to effectuate the foregoing. Section 9 Effective Date: The effective date of this Ordinance shall take effect immediately upon adoption, in accordance with 166.041(4) Florida Statutes and Section 4.l5(c) of the City Charter. The response time to the subject property would be: Emergency response time is 3.5 minutes. Non-emergency response time is 4.5 minutes. The average is 4.3 minutes over the whole City. B. CONCURRENCY MANAGEMENT: The request is for a small scale comprehensive plan amendment which is viewed as a preliminary development order (where no approval for construction is made) is not subject to Concurrency. Concurrency review has been deferred until application for a final development order for the subject property, in accordance with the Concurrency Management System established in the City's Comprehensive Plan Volume 2 of 2. C. LAND USE COMPATIBILITY: 1. TOPOGRAPHY: The subject property and surrounding area have slight grade. 2. -FLOOD PRONE AREA: A review of the FEMA National Flood Insurance Program Rate Map (12117CO 155-E; April 17, 1995) indicates the subject parcel is not within the 100 LOCAL PLANNING AGENCY March 7, 2001 SS-CP A-I-200 1 Pagc 7 of 10 year flood prone area, but within Zone "X - Other Areas" which states areas determined to be outside 500 year floodplain. 3. NATURAL RESOURCES, HISTORIC RESOURCES. No natural or historic resources have been found at this time. 4. WILDLIFE AND SPECIES DESIGNATED AS ENDANGERED, THREATENED OR SPECIAL CONCERN: No federally listed endangered plants are known to exist in the county. The traffic generated from a commercial activity on 6.5 acres will not cause any significant reduction in the Level of Service or threaten the Level of Service of U.S. 17-92. Applicant has not determined specifically what commerciaVindustrial activity he may want to develop on the subject property. Property owner is subject to the land development requirements found in Chapter 9 of the City Code.
