REQUEST:
The Community Development Department - Planning Division requests the City Commission
hold a public hearing for second reading of Ordinance 2001-24 to adopt the large scale
comprehensive plan amendment (LS-EM-CPA-I-2001) that would change the Future Land Use
Map designation of properties with multi-family apartment complexes in and around the
intersection of Moss Road and S.R. 434 from "Commercial" to "Medium Density Residential"
(6.6 - 9.0 DU per acre).
PURPOSE:
The purpose of this Agenda Item is to request the Commission hold a public hearing for second
reading of Ordinance 2001-24 to change the Future Land Use Map designation to allow the City
and Wyman Fields Foundation to move ahead with a program to rehabilitate 188 multi-family
units around the Moss Road & S.R. 434 area. Inappropriate Future Land Use Map designation
has made it difficult to secure title insurance, land acquisition and development loans and end-
loans to homeowners.
APPLICABLE LAW AND PUBLIC POLICY:
The provisions of 163.3187(1 )(a) F.S. which state: "In the case of an "emergency",
comprehensive plan amendments may be made more often than twice during the calendar year if
the additional plan amendment receives the approval of all of the members of the governing body.
"Emergency" means any occurrence or threat thereof whether accidental or natural, caused by
humankind, in war or peace, which results or may result in substantial injury or harm to the
population or substantial damage to or loss of property or public funds."

The provisions of Florida Statutes Chapter 163.3184(15)(b) F.S. which state: "The local
governing body shall hold at least one advertised public hearing on the proposed comprehensive
plan or plan amendment as follows:
1. The first public hearing shall be held at the transmittal stage pursuant to subsection
(3). It shall be held on a weekday at least 7 days after the day that the
advertisement is published.
2. The second public hearing shall be held at the adoption stage pursuant to
subsection (7). It shall be held on a weekday at least 5 days after the day that the
second advertisement is published."
The provisions of 166.041(3)(a) which state in part: "Except as provided in paragraph (c), a
proposed ordinance may be read by title, or in full, on at least 2 separate days and shall, at least 10
days prior to adoption, be noticed once in a newspaper of general circulation in the municipality."
CONSIDERA TIONS:
· The subject property is experiencing a gradual degradation of the apartment structures and
the land is not being maintained.
· This is an emergency large scale comprehensive plan amendment. No ORC Report has
been issued on this proposed plan amendment.
· The Local Planning Agency at its March 7, 2001 meeting reviewed the ORC Report and
the Response to the ORC Report and made its recommendation to the City Commission.
· On March 21, 2001, the Commission held a public hearing for first reading of of
Ordinance 2001-24 to adopt the large scale comprehensive plan amendment (LS-EM-
CPA-I-2001) that would change the Future Land Use Map designation of properties with
multi-family apartment complexes in and around the intersection of Moss Road and S.R.
434 from "Commercial" to "Medium Density Residential" (6.6 - 9.0 DU per acre).
FINDINGS:

The City and Wyman Fields Foundation are in a partnership to rehabilitate the multi-family
units in and around the Moss Road and S.R. 434 intersection.

The Future Land Use Map designations for the area under consideration are not reflective
of the actual built environment, which are multi-family structures.
FISCAL IMPACT:
None.
IMPLEMENTATION SCHEDULE:
A public hearing for second reading and adoption of Ordinance 2001-24 is scheduled for
March 26, 2001.
STAFF RECOMMENDATION:
Staff recommends the City Commission hold a public hearing for second reading and adoption of
Ordinance 2001-24 to change the Future Land Use Map designation of properties with multi-
family apartment complexes in and around the intersection of Moss Road and S.R. 434 from
"Commercial" to "Medium Density Residential" (6.6 - 9.0 DU per acre), incorporating the City
staff and the Local Planning Agency's Findings, as the basis for the adoption of the emergency
plan amendment.
LOCAL PLANNING AGENCY RECOMMENDATION:
The Local Planning Agency at its March 7, 2001 meeting recommended the City Commission
approve the change of Future Land Use Map designation of properties with multi-family
apartment complexes in and around the intersection of Moss Road and S.R. 434 from
"Commercial" to "Medium Density Residential" (6.6 - 9.0 DU per acre), incorporating the City
staff and the Local Planning Agency's Findings, as the basis for the adoption of the emergency
plan amendment.

WHEREAS, section 163.3161 et Seq., Florida Statutes (1987) established the
Local Government Comprehensive Planning and Land Development Regulation Act; and
WHEREAS, section 163.3167, Florida Statutes, requires each municipality in the
State of Florida to prepare and adopt a Comprehensive Plan as scheduled by the Florida
Department of Community Affairs; and
WHEREAS, the City and Wyman Fields Foundation are currently in a private/public
partnership to rehabilitate 188 multi-family units around the Moss Road and State Road 434 area;
and
WHEREAS, Wyman fields has currently rehabilitated some of the units and is currently
in the process of selling some units, however, the existing "Commercial" future Land Use Map
designation on the property has made it difficult to secure title insurance, land acquisition and

development loans and end-loans to homeowners because the property consists of multi-family
housing and lenders and insurers are concerned that the "Commercial" designation could someday
undermine the residential nature of the multi-family project; and
WHEREAS, the Local Planning Agency of the City of Winter Springs held a duly noticed
public hearing, in accordance with the procedures in Chapter 163, Part II, Florida Statutes, on the
proposed Comprehensive Plan amendment and considered findings and advice of staff, citizens,
and all interested parties submitting written and oral comments and has recommended adoption to
the City Commission; and
WHEREAS, pursuant to section 91-11.006, Florida Administrative Code, this
Comprehensive Plan amendment will not cause the City to exceed its twice yearly submittal
allowance for comprehensive plan amendments; and
WHEREAS, on March 26, 2001, the City Commission of the City of Winter Springs held
a duly noticed public adoption hearing on the proposed "emergency" plan amendment set forth
hereunder and considered findings and advice of the Land Planning Agency, staff, citizens, and all
interested parties submitting written and oral comments and supporting data and analysis, and after
complete deliberation, hereby finds the requested change consistent with the City of Winter
Springs' Comprehensive Plan and would promote the continuing public/private partnership
between Wyman Fields and the City to develop affordable owner occupied housing on the Property
which is subject to this Ordinance; and
WHEREAS, the City Commission hereby finds that this Ordinance is in the best interests
of the public, health, safety, and welfare of the citizens of Winter Springs.

NOW, THEREFORE, THE CITY COMMISSION OF THE CITY OF WINTER
SPRINGS HEREBY ORDAINS, AS FOLLOWS:
Section 1. Recitals. The foregoing recitals are true and correct and are fully incorporated
herein by this reference.
Section 2. Authority. This Ordinance is adopted in compliance with, and pursuant to, the
Local Government Comprehensive Planning and Land Development Regulations Act.
Section 3. Purpose and Intent. It is hereby declared to be the purpose and intent of this
Ordinance to change the Future Land Use Map designation of the approximate 36.21 acre parcel
ofland generally located in and around the intersection of Moss Road and State Road 434 as shown
in "}" of this Ordinance.
Section 4. Adoption of Amendment to the Future Land Use Map. The City of Winter
Springs' Comprehensive Plan, Future Land Use Map, is hereby amended by designating the real
property depicted on Exhibit "}" from the future land use map designation of "commercial" to the
future land use map designation of "medium density residential". Exhibit "}" is attached hereto
and fully incorporated herein by this reference.
Section 5. Transmittal to the Department of Community Affairs. The City Manager
or his designee is hereby designated to sign a letter transmitting the adopted Comprehensive Plan
Amendment to the Florida Department of Community Affairs, in accordance with Section
163.3187(l)(c)(4), Florida Statutes, and the corresponding provisions of the Florida
Administrative Code.
Section 6. Repeal of Prior Inconsistent Ordinances and Resolutions. All prior

inconsistent ordinances and resolutions adopted by the City Commission, or parts of ordinances
and resolutions in conflict herewith, are hereby repealed to the extent of the conflict.
Section 7. Severability. If any section, subsection, sentence, clause, phrase, word or
provision of this Ordinance is for any reason held invalid or unconstitutional by any court of
competent jurisdiction, whether for substantive, procedural, or any other reason, such portion shall
be deemed a separate, distinct and independent provision, and such holding shall not affect the
validity of the remaining portions of this Ordinance.
Section 8. Incorporation into Comprehensive Plan. Upon the effective date of the
Comprehensive Plan Amendment adopted by this Ordinance, said Amendment shall be
incorporated into the City of Winter Springs' Comprehensive Plan and any section or paragraph
number or letter and any heading may be changed or modified as necessary to effectuate the
foregoing.
Section 9.
Effective Date ~nd Legal Status of the Plan Amendments. The effective
date of the Comprehensive Plan Amendments adopted by this Ordinance shall be the date a final
order is issued by the Florida Department of Community Affairs, or the Administration
Commission finding the Amendments in compliance with section 163.3184, Florida Statutes. No
development orders, development permits, or land use dependent on these Amendments may be
issued or commenced before it has become effective. If a final order of noncompliance is issued
by the Administration Commission, the Amendments may nevertheless be made effective by
adoption of a resolution affirming its effective status. After and from the effective date of these
Amendments, the Comprehensive Plan Amendments set forth herein shall amend the City of

Winter Springs Comprehensive Plan and become a part of that plan and the Amendments shall
have the legal status of the City of Winter Springs Comprehensive Plan, as amended.
ADOPTED by the City Commission of the City of Winter Springs, Florida, in a regular

1. REQUEST:
For a change of Future Land Use Map designation from "Commercial" to "Medium
Density Residential" (6.6 - 9.0 DU per acre).
2. PURPOSE:
The City is sponsoring a program to rehabilitate 188 multi-family units around the Moss
Road & S.R. 434 area. Wyman Fields, the City's partner in the venture is experiencing
difficulty in securing title insurance, land acquisition and development loans and end-loans
to homeowners because the land is improperly designated "Commercial" on the Future
Land Use Map. These institutions are resisting approving the loans until the City ensures
that the land or buildings will not be used for commercial purposes at some time in the
future.
A. SITE INFORMATION:
1. PARCEL NUMBER:

2. ACREAGE:
Approximately 36.21 acres are proposed to be redesignated from Future Land Use
Map "Commercial" to "Medium Density Residential".
3. GENERAL LOCATION:
The area to the north of S.R. 434 on the west side of Moss Road starting behind
the commercial buildings on the northwest corner of Moss Road and S.R. 434 and
extending northward to the police station and westward to include most of the area
to North Fairfax Ave. Also, the apartment complexes on the east side of Moss
Road north of S.R. 434 along Corry Lane, Rhoden Lane and the office building on
Excelsior Parkway.
4. CHRONOLOGY OF SUBJECT PROPERTY:
~J'he property has been built with apartment complexes since around 1986. The
City began a program of rehabilitation commencing in 1999.

5. DEVELOPMENT TRENDS:
The subject property is experiencing a gradual degradation of the apartment
structures and the land is not being maintained. The surrounding area is relatively
stable with Hacienda Villas manufactured home community next to Kristi Ann
Court apartments, an older single family neighborhood built in the 1960s. Along
S.R. 434 around the intersection with Moss Road there are long established
commercial retail operations.
6. EXISTING LAND USES ON THE SUBJECT PROPERTY:
The properties proposed to be redesignated on the Future Land Use Map as
"moderate Density Residential" are developed with apartment complexes, the
City's fire station and public works buildings and a professional office building and
some undeveloped land.

II. COMPREHENSIVE PLAN AMENDMENT ANALYSIS:
A. CONSISTENCY WITH THE COMPREHENSIVE PLAN:
Much of the area proposed to be changed from "Commercial" to "Medium Density
Residential" (6.6 - 9.0 DU per acre) is already built with such density apartment
complexes. The "Commercial" Future Land Use Map designation does not reflect the
built environment which is expected to remain as multi-family structures for the
foreseeable future. This inconsistency between the FLUM designation and the existing
built environment should be corrected to more accurately reflect the built environment,
which is a FLUM designation of "Medium Density Residential".
B. NUISANCE POTENTIAL OF PROPOSED USE TO SURROUNDING LAND USES.
The proposed future land use change from "Commercial", "Moderate Density
Residential", and "Urban Density Residential" to "Medium Density Residential" will not
negatively impact adjacent land uses, for the multi-family complexes have existed for years
at those sites. A change ofFLUM designation simply to more accurately reflect the multi-
family structures and density will have no actual change on the immediate surrounding
area.
C. CHANGE IN CHARACTER OF THE SURROUNDING AREA:
There has been no change in character of the subject properties and the immediate
surrounding properties, since most of the existing land uses have been long established.
D. ECONOMIC DEVELOPMENT:
The City's partnership with Wyman Fields Foundation to rehabilitate the existing multi-

family units will have a positive impact though not necessarily a substantial economic
impact on the City.
IV. FINDINGS:
· The City and Wyman Fields Foundation are in a partnership effort to rehabilitate
the multi-family units in and around the Moss Road and S.R. 434 intersection.
· The Future Land Use Map designations for the area under consideration are not
reflective of the actual built environment, which are multi-family structures.
· A more appropriate Future Land Use Map designation for the area under
consideration for this large scale comprehensive plan amendment would be
"Medium Density Residential" (6.6 - 9.0 DU per acre).
v. STAFF RECOMMENDATION:
Staff recommends the Local Planning Agency make the following recommendation to the
City Commission:
That the City Commission approve the request by Wyman Fields to redesignate the
area under consideration as shown in Attachment A "Medium Density Residential"
(6.6 - 9.0 DU per acre).

A RESOLUTION OF THE CITY OF WINTER SPRINGS, FLORIDA,
DESIGNATING THE MOSS ROAD AREA DEPICTED ON THE
ATTACHED LOCATION MAP AS A REDEVELOPMENT AREA IN
ORDER TO QUALIFY FOR FEDERAL AND STATE FUNDS.
WHEREAS, Objective B of the housing element of the Comprehensive Plan for Winter
Springs supports and encourages efforts to reclaim the livability of neighborhoods and to restore
the area as a desirable homesite~ and
WHEREAS, The City of Winter Springs supports and encourages the efforts of
community organizations to create a better environment through locally initiated partnerships
between the public and private sectors; and
WHEREAS, The City of Winter Springs and other community organizations propose to
undertake a number of activities related to redevelopment in targeted areas throughout the Moss
Road area; and
WHEREAS, The action taken herein is authorized by law and serves a public purpose.
NOW, THEREFORE, BE IT RESOLVED, BY THE CITY COM1\1ISSION OF
THE CITY OF WINTER SPRINGS, FLORIDA:
SECTION I - That the above recitals are hereby adopted as findings of fact and
conclusions oflaw as if fully set forth in this operative part of this Resolution.
SECTION n - That the projects proposed for the redevelopment of the Moss Road area,
Winter Springs, Florida are consistent with local plans and regulations, including the Winter
Springs Comprehensive Plan.
