REQUEST: The Community Development Department presents to the City Commission a
request by the WS Town Center Auto to remove this item from the "table" and hold a public
hearing to consider a special exception to allow an automobile repair shop for only routine
service, as set forth in the City's Town Center District Code and as recommended by the City's
Town Center consultant.
PURPOSE: The purpose of this agenda item is to consider a request of the W S Town Center
Auto to remove from the "table" a special exception to allow an automobile repair (routine
service) at 1135 East S.R. 434, within the Town Center zoning district. A special exception
would allow the applicant to proceed with preliminary and then final site plans for the project -
both of which would be subject to public hearings with the City Commission.

. .. In granting a special exception, the City Commission must find by substantial
competent evidence that:
1. The proposed development contributes to, promotes and encourages the
improvement of the Winter Springs Town Center and catalyzes other
development as envisioned in the Winter Springs Town Center regulations.
2. The proposed development will not have an unfavorable effect on the
economy of the Winter Springs Town Center.

3. The proposed development abides by all rules in this code other than those
specifically excepted. ...
4. The proposed development meets any reasonable additional conditions,
restrictions or limitations deemed necessary by the City Commission in order
to preserve and promote the intent of the Winter Springs Town Center Master
Plan.
Procedure for Special Exceptions:
1. Approval may be granted only after a minimum of two discretionary reviews.
The first review shall be before the Development Review Committee, at which
time the Development Review Committee shall review the project and provide
to the City Commission an advisory recommendation regarding approval,
approval with conditions, or disapproval. The second review shall be a public
hearing held before the City Commission and shall be held no sooner than
seven calendar days following the Development Review Committee hearing.
2. Requests for special exceptions under this ordinance shall include each exhibit
required in the Administrative Review Process per section II, part B of this
code. In addition, the City Commission may within reason require additional
exhibits and may defer approval of the special exception application or
schedule an additional public hearing or hearings to review those exhibits.
3. Special exceptions shall not be unreasonably withheld, but the City
Commission shall have authority to require that the applicant satisfy any
additional conditions it deems necessary to fulfill goals of the master plan,
including reasonable offsite improvements directly related and proportionate
to the specific impact of the request, or further review( s) and approval by the
Development Review Committee.
4. The City Commission may grant the approval of an application for special
exceptions from the code in whole or in part upon a majority vote of its
members.
B. City Code of Ordinances:
Section 20 - 83. Procedures.
(c) All meetings for consideration of a variance, special exception or conditional
use shall be noticed for at least seven (7) days prior to the date of the meeting in
the following manner:
(1) Posting the affected property with a notice of the meeting which
indicates the matter to be considered.

(2) Posting in city hall a notice of the meeting which indicates the
property affected and the matter to be discussed.
(3) At least seven (7) days prior to the meeting, the board of adjustment
shall also notify all owners of property adjacent to or within one hundred
fifty (150) feet ofthe property to be affected of the time, date and place of
the meeting. Such letter must also indicate the variance, special exception,
or conditional use requested, and must require proof of delivery.
(d) All interested persons shall be entitled to be heard as such meetings or to be
heard by written statement submitted at or prior to such meeting.
(e) In the event a special exception, variance or conditional use is not authorized
by ordinances of the city, the person requesting the unauthorized action must
submit an application pursuant to section 20-28.
(h) Any variance, special exception or conditional use which may be granted by
the council shall expire six (6) months after the effective date of such action by
the city commission, unless a building permit based upon and incorporating the
variance, special exception or conditional use is obtained within the aforesaid six-
month period. However, the city commission may renew such variance, special
exception or conditional use for one (1) additional period of six( 6) months,
provided good cause is shown and the application for extension shall be filed with
the board at least thirty (30) days prior to the expiration of the six-month period.
Any renewal may be granted without public hearing, however, a reapplication fee
may be charged in an amount not to exceed the amount of the original application
fee. It is intended that provisions contained within this subsection are to be
retroactive to the extent that any variance, special exception or conditional use
previously granted shall become void if a period of time in excess of twelve (12)
months shall have lapsed, and a building permit based upon and incorporating the
variance, special exceptions or conditional uses has not been issued prior to
expiration of such time limit.

Representatives from Dover, Kohl & Partners, the City's Town Center consultant,
worked with the applicant and his team to prepare a conceptual site plan and
conceptual architectural renderings for the site
June 27,2001 - Future Land Use designation is amended to Town Center District
July 17,2001 - Development Review Committee review
September 10,2001 - Zoning is changed to Town Center District
September 24, 2001 - City Commission "tabled" the item indefinitely
CONSIDERATIONS:
The applicant and his representative, Ronald Wilson, met with City Staff in an attempt to
address the concerns. The applicant requests that the project be removed from the table and
reconsidered on October 22, 2001. Staff advised that the following is required pursuant to
Section II Part B of the Town Center District Code:
1. Current site survey - see attachment "E"
2. Current tree survey - see attachment "E"
3. A site plan, drawn to scale, which shall indicate:
a. building locations and orientations, and landscape areas - see attachment "B";
b. parking locations and number of spaces - see attachment "B" for location - 45
spaces depicted;
c. paved surfaces, materials, and location(s) - see attachment "B" for location-
Ron Wilson states materials will be asphalt;
d. site location diagram & legal description - see attachment "A"; and
e. signage - see attachment "B."
4. Building elevations illustrating all sides of structures facing public streets or
spaces - see attachment "B" for building rendering from SR 434.
5. Parking analysis justifying the proposed parking - not provided - the number of
parking spaces totals 45, which exceeds any existing known standard for
automobile repair garages (i.e. 1 space for each 200 square feet, which totals 15
spaces).
6. Other reasonable supporting documents to indicate intentions and/or any other
items required by the Development Review Committee.

The City's town center consultant, Victor Dover, has provided additional insight as to how an
automobile repair facility can be an asset to a town center through proper design and operation.
These are addressed in Staff's recommended conditions.
FINDINGS: 1. The Staff Development Review Committee, at its July 17,2001, meeting, found
the concept of an automobile repair shop, limited to routine service only, in the
Town Center District, to be consistent with the general zoning and with the public
interest. This finding did not address specific site-plan issues. Those issues will
be addressed during the site-plan review process.
2. Dover, Kohl & Partners, the City's consultant for the City Center, has worked
with the applicant to ensure that the project is consistent with the Town Center
theme. Please see the attached Dover, Kohl & Partners memorandums in
Attachment "F." In the October 16,2001, memo, Victor Dover has noted that an
automobile garage for routine maintenance is a normal use in and can be a great
asset to a town center.
3. The proposed special exception, with the attached seven (7) conditions set
forth below, meets the four (4) special exception criteria set forth in
Subsection II C of the Town Center District Code:
1) The proposed development contributes to, promotes and encourages the
improvement of the Winter Springs Town Center and catalyzes other
development as envisioned in the Winter Springs Town Center
regulations. The project will provide a needed service, with seven (7)
reasonable conditions of approval to ensure the project is
complementary to other development in the Town Center.
2) The proposed development will not have an unfavorable effect on the
economy of the Winter Springs Town Center. The attached seven
(7) conditions will ensure a favorable effect.
3) The proposed development abides my all rules in this code other than
those specially excepted. The applicant has agreed to abide by all
of the rules set forth in the Town Center Code and the attached seven
(7) conditions.
4) The proposed development meets any reasonable additional conditions,
restrictions or limitations deemed necessary by the City Commission in
order to preserve and promote the intent of the Winter Springs Town
Center Master Plan. The applicant has agreed to all the seven (7)
conditions set forth in this document, which go beyond the Town
Center District Code.

STAFF RECOMMENDATION:
Staff recommends that the City Commission approve the Special Exception to
allow an automobile repair shop, limited to routine service, in the Town Center
District at 1135 East S.R. 434, subject to the following conditions (please also see
Dover, Kohl & Partners memorandums in Attachment "F"):
1. Hours of OperationINoise: Activities producing noise, audible from
surrounding properties shall be prohibited from 7:00 P.M. until 7:00 A.M.,
Monday through Saturday, and daytime noise levels must be restricted, pursuant
to the requirements of Chapter 13, Article II of the City Code. Emergency towing
to the facility is allowed between the 7:00 P.M. and 7 A.M. as well as on Sunday.
2. Signage: Signage must conform to the Town Center requirements and shall
be limited to that depicted in attachment "B".
3. Vehicle Storage: Vehicles awaiting routine service or repair must be stored
in the rear of the site and not be visible from the public rights-of-way. Garden
walls, fences, or hedges may be used to screen vehicles from the public view. A
6-foot tall masonry wall must be provided across the rear of the facility. The site
is not to be a towing storage area (no wrecked or stored vehicles will be allowed)
- there will be a reasonable limit to the time a vehicle may be kept at the site.
Tow trucks must not be stored on-site.
4. Use Restrictions: On-site work shall be limited to minor automobile repairs
and express lube. There shall be no retail sales of automobile parts or accessories.
Allowable uses include express lubrication; other automotive fluid changes or
additions; tune-ups; timing, carburetor, clutch, and other various adjustments;
changing clutches, head gaskets, shock absorbers, struts, starters, alternators,
water pumps, radiators, hoses, belts, windshield wipers, and similar other routine
service items. Prohibited used include major engine or transmission work (e.g.
overhauling or changing engines or transmissions), frame straitening, or any paint
and/or body work.
5. Building: All four (4) sides of the building, as well as the walles), shall be
substantially consistent, architecturally, with the fa~ade depicted conceptually in
the attachment. The applicant may, if he wishes, construct his residence (a
permitted use) on the second floor of the structure, subject to all applicable
building and life/safety codes. The building shall be provided with an awning or
awnings on the front, consistent with the awning specifications set forth in the
Town Center District Code.
6. Landscaping: In addition to the normal exterior building landscaping, the
final site plan shall include a landscape plan with landscaping and trees on the

interior of the site. The applicant shall maintain the landscaping at all times, and
to ensure this, he shall maintain a contract with a professional landscape
maintenance firm from the time the Certificate of Occupancy is issued for as long
as the business operates as an automotive repair shop.
7. Pollution and other environmental concerns: Existing rules governing
noxious fumes, disposal of waste materials etc., must be observed. Fumes and
obnoxious odors generated by the automobile repair shop must not affect the
surrounding properties. Stormwater management, motor oil tanks, and other
environmental considerations will be addressed during the site plan review
process.

In order to grant a variance, the.Board of Adjustment must make the

Dear Mr. Baker,
In response to your request regarding the Winter Springs Automotive facility, I offer you
the following description.
Winter Springs A.utomotive will be a five bay light repair shop with three bays for sman
automobile repairs and two bays for express lube. It will be open to the general public of
Winter Springs and the surrounding neighborhoods.
Only cars needing to be towed in for minor repairs will be dropped off at this location,

Subject: An automobile repair shop within the Winter Springs Town Center
An automobile repair shop is a normal use that can often be found in and around
healthy town centers. It can be a great asset for residents and employees within the town
center, for whom the repair shop would be within walking distance. Care must be taken
to ensure that the shop is a good neighbor to properties surrounding it. Below are some
recommendations for ways to deal with some of the typical issues with integrating
automobile repair shops into mixed-use areas:
Architectural: The design of the shop should meet all of the design requirements
outlined in the Town Center District Code including:
· Height ranging from 2 to 4 floors.
· Close proximity to the sidewalk according to the building placement rules laid out on
the Street Type pages.
· Doors and windows facing the street.
· Weather protection for pedestrians via awnings etc.
· Landscaping and street trees.
· Additionally. the vehicular garage doors should be located to the rear of the building.
Noise: Activities producing loud noise should be insulated to prevent them from
impacting surrounding properties. Activities producing any noise audible from
surrounding properties could be prohibited during certain hours (i.e. from 10pm to 7am.)
Signage: I think the Code covers signage issues pretty comprehensively. Temporary
signs should be subject to the same standards as permanent signs.
Vehicle Storage: Vehicles dropped off for repair should only be stored to the rear of the
facility. They should not be stored where visible from public streets. Garden \valls,
fences or hedges may be used to screen vehicles from view.
Pollution and other environmental concerns: Existing rules governing noxious
fumes, disposal of waste materials etc" should be followed stringently. Fumes and
smells generated by the automobile repair shop should not be allowed to impact
surrounding properties, which in a town center are often in very close proximity.

At the present time, it is over 300 feet from the rear of the proposed
building to the nearest trailer. (See accompanying site plan)
At the present time it is over 450 feet to the nearest stnlcture east on
SR 434. (See accompanying plat map)
At the present time. the Post Office is the nearest structure to the west on
SR 434. about 1/4 mile away. (See aerial)
Mr. Miranda has agreed to have a landscape management contract in place
to maintain the grounds in the same condition on a continuing basis.
Mr. Miranda has agreed that there will be no tow trucks parked on site~
that only minor car repair and oil and lube operations win be conducted.
Mention has been made as to the total character of the building- sides
and back as well as front. With Mr. Miranda locating his home to the
second floor, window treatment and walls will abound with a professional
look in keeping with the TOWN CENTER concept,
Some concerns have been raised about the area. on Nursery Road where
Mr. Miranda is now a tenant. We need to emphasize than Mr. Miranda is a
tenant only and the landlords in that area are responsible for the upkeep
and that the part of the operation that Mr. Miranda is responsible for is
kept up. We enclose a letter from AAA commending and honoring Mr.
Miranda for.,..,
Parking issues were discussed and both Seminole and Orange COWlty
parking requirements are include to show what the standards are for the
area. Both agencies require one space for each 200-250 square feet of
building area. The proposed building is 3,000 square feet, so the required
parking would be only 12-15 spaces. Seminole County addressed service
stations in panicular at 3 spaces per bay_ The proposed building has S
bays,
Mr. Miranda has already met with a builder, Mr. William Harkins, an
architectural firJn, Burke. Bales, and Mills, and an engineering fum,
FEe, Inc. as he prepares to proceed with the project upon final approval

CHRONOLOGY OF EVENTS
The applicant Mr. Miranda and myself started meeting with the city planners and other
officials in January 2001 regarding the possibility of putting the car care facility on SR 434
on the property now owed by Mr, Miranda, (Thursday, January 11 with Tom Grinun.)
The response was Yes, Mr. Miranda we would love to have this property annexed into the
city from Seminole County, and yes the car care facility was a permitted use with a special
exception,
We had another meeting planned with Mr. Cbarles Carrington and Ron McLemore on Jan.
29, 2001, but only Mr. Carrington was available
We had picked up all the paperwork for annexation, rezoning, small scale amendment and
dropped these completed forms off to Mr, Carrington on Feb 7,2001.
We also met with an independent land planner in January, Mr. Mike Wadley.
In early February we received via fax the initial artist renderings and site plan trom Dover
and Kohl, city planners/consultant for the city of Winter Springs showing what would be
acceptable for a car care facility.
On March 13, Mr. Miranda closed on the property.
Tuesday April 24 Mr. Miranda and myselfagaio met with Mr. Carrington.
On May 9, Mr. Bill Harkins, the potential contractor for the building of the facility, along
with Mr. Miranda and myself met again with Mr. Carrington, to try to get some things
ironed out that were concerns of Mr. Harkins, such as sewer and water availability.
On Wednesday May 23, Mr. Harkins, Mr. Miranda and myselfmet with the city
planners/consultant Victor Dover at city hall to discuss the project and the various
requirements for the building.
May 31, 2001, the Special Exception application and fee was given to the city.
June 11,2001, the site was annexed into the city ofWioter Springs.
On June 25, 2001, I picked up a poster from John Baker and posted it on the property for
re-zoning.
July 17,2001, the Staff Development Review Committee met and found the concept oran
automobile repair ship, for routine service only, in the Town Center District. to be
consistent with the general zoning and with the public interest.

On August 15, we submitted 10 copies ofall the things that were required for review for
the special exception.
On September 10, 2001, zoning was finalized into the Town Center District.

Dear Commissioners:
We reside at 1130 E, SR434. We are presently out of the state. and have asked
Mr. Carrington to read this lener at the hearing,
We have two concerns regarding this proposed exception, its location and the
viability of such an enterprise.
1. Granting this special exception will be a devastating embarrassment to the city and its
commissioners. Imagine; after spending 6 million dollars on pJannUig, landscaping,
and hours of hard work, the first construction as a resuh of the vast effort will be a
tbree~stall auto repair shop on the main highway through the city. Let us hope the
io(;aJ papers do not pkk up that one. In May of this year we, the owners of property
across the street, spent $5,000 demolishing a building no less handsome than the one
proposed to be erected..
Our desire is to have a bank building, a library, or perhaps a regional headquarters for
a national corporation, or an attractive. campus-style office complex. A repair shop with
crippled vehicles littering the view will not enhance the prospetts. -
2. Preliminary sketches show a two-story building fronting fur a three.staU repair shop
in the back. You can put aU the restrictions imaginable upon this fledgling business,
but you cannot repeal the Jaws of nature. In less than a year you will be asked to
allow putting an old auto body atop a 20-1\. pole to help advertise the business. There
is no demand for a back yard repair shop even though the front is on 434.
