" n, CITY OF WINTER SPRINGS MINUTES CITY COMMISSION ATTORNEY-CLIENT SESSION OCTOBER 8, 200 I L CALL TO ORDER The Attorney-Client Session of Monday, October 8, 2001 was called to order by Mayor Paul P. Partyka at approximately 5:49 p.m. in the Commission Chambers of the Municipal Building (City Hall, 1126 East State Road 434, Winter Springs, Florida 32708). ROLL CALL: Mayor Paul P. Partyka, present Deputy Mayor David W. McLeod, present Commissioner Robert S. Miller, arrived at approximately 5:56 p.m. Commissioner Michael S. Blake, arrived at approximately 5:54 p.m. Commissioner Edward Martinez, Jr., present Commissioner Cindy Gennell, present City Manager Ronald W. McLemore, present City Attorney Anthony A. Garganese, present A moment of silence was followed by the Pledge of Allegiance. Commissioner Cindy' Gennell objected to holding the "Closed Session" in the Commission Chambers, and highly suggested that the "Closed Session" be held in a Conference Room. Brief discussion. The consensus of those in attendance agreed with Commissioner Gennell's suggestion. The Attorney-Client Session was estimated to last approximately one hour. Mayor Partyka stated that "Pursuant to Section 286.011(8), Florida Statutes, the City Attorney will be seeking the advice of the City Commission regarding Settlement Negotiations and Strategy related to Litigation' Expenditures corrceming- the ,. Pending ... Litigation titled 'City of Oviedo, and Seminole County, Florida v. City of Winter Springs' - Circuit Court of the Eighteenth Judicial Circuit, In And For Seminole County, Florida - Case Number 00-89 AP." Mayor Partyka added that the following individuals were scheduled to be in attendance: Mayor Paul p, Partyka, Deputy Mayor David W. McLeod, Commissioner Robert S. Miller, Commissioner Michael S. Blake, Commissioner Edward Martinez, Jr., Commissioner Cindy Gennell, City Manager Ronald W. McLemore, City Attorney Anthony A. Garganese, and a Court Reporter. Blake arrived at the West Conference Room at approximately 5:54 p.m. Commissioner Robert S. Miller arrived at the West Conference Room at approximately 5:56 p.m. II. ATTORNEY-CLIENT SESSION Pursuant To Section 286.011(8), Florida Statutes, The City Attorney Will Be Seeking The Advice Of The City Commission Regarding Settlement Negotiations And Strategy Related To Litigation Expenditures Concerning The Pending Litigation Titled "City Of Oviedo, and Seminole County, Florida v. City Of Winter Springs" - Circuit Court Of The Eighteenth Judicial Circuit, In And For Seminole County, Florida - Case Number 00-89 AP." Note: Transcript to be provided by the Court Reporter at a later date. Mayor Partyka, Members of the City Commission. Manager McLemore, and Attorney Garganese returned to the Commission Chambers at approximately 6:45 p.m. Mayor Partyka called the "open" portion of the Attorney-Client Session back to order at 6:46 p.m. III. ADJOURNMENT Mayor Partyka stated, "I would be looking for a Motion to adjourn." "MAYOR, MOTION TO ADJOURN THIS SPECIAL EXECUTIVE SESSION." MOTION BY COMMISSIONER BLAKE. SECONDED BY COMMISSIONER MARTINEZ. DISCUSSION. VOTE: COMMISSIONER BLAKE: AYE COMMISSIONER MARTINEZ: AYE DEPUTY MAYOR McLEOD: AYE COMMISSIONER MILLER: AYE MOTION CARRIED. ..
