I. CALL TO ORDER
The Special Meeting of October 3, 2000 of the City Commission was called to order by
Deputy Mayor Cindy Gennell at 6: 12 p.m. in the East Training Room of the Municipal
Building (City Hall, 1126 East State Road 434, Winter Springs, Florida 32708).

MOTION CARRIED.
Mr. Bill Leedy with William R. Hough & Company stated, "I wanted to just be sure that
you all knew what a great job your Finance Director and Financial Advisor did on this. I
can - say that - we had asked if it would be possible to get an underlying rating on this
bond issue and we knew this was going to take a lot of extra time, but it would be worth
it if we could get an underlying rating from Standard & Poor's; and your Finance
Director and your Financial Advisor pulled the information together with a lot of
information about the City and a lot of information about this Water & Sewer system, and
they did get an underlying 'A' rating and it saved the City quite a bit of money on the
interest rates that we were able to get because of that. And I just felt like you should
know that, because that was not easy to get that underlying 'A' rating on short notice the
way they did." Deputy Mayor Gennell stated, "Just for the record, that was Mr. Bill
Leedy."

Requesting The City Commission To Consider The Need For Canceling The
October 9, 2000 Regular Commission Meeting.
"I MAKE THE MOTION THAT WE DO NOT CANCEL THE OCTOBER 9TH,
2000 MEETING." MOTION BY COMMISSIONER McLEOD.
MOTION DIED FOR LACK OF A SECOND.
Deputy Mayor Gennell polled the Commission to find out which members of the
Commission would be in town on October 9,2000. Brief discussion.
"I MAKE A MOT][ON THAT WE CANCEL THE MEETING SCHEDULED FOR
NEXT MONDAY NIGHT, UNTIL THE NEXT REGULARLY SCHEDULED
MEETING." MOTION BY COMMISSIONER MILLER. SECONDED BY

Requesting The City Commission To Reschedule The Dyson Annexation
Referendum.
"I MAKE A MOTION THAT THE DYSON ANNEXATION BE POSTPONED
FROM THE NOVEMBER 7TH BALLOT TO THE MAY 8TH BALLOT OF 2001,
AND THAT THE CITY MANAGER ALSO - INFORM THE RESIDENTS BY
MAIL OF THE CHANGE - OF THE DYSON AREA." MOTION BY
COMMISSIONER McLEOD. SECONDED. DISCUSSION.

D. City Manager
Requesting The Commission To Consider A Policy For Providing Announcement
Of Community Events And Other Community Messages On The City Utility Bill
And City Newsletter.
Brief discussion.
Commissioner Edward Martinez, Jr. stated, "We have been talking about this many times
and we have suggested many instances that the people be notified by mail, together with
the water or electric bills, or water and sewer bill; to make it a policy so we don't have to
go into making these Motions continuously. We should do something like this for the
benefit of the people of Winter Springs." Commissioner Martinez further stated that his
preference was that "A policy be drafted."
Attorney Vickaryous commented, "We want to make absolutely sure that if a policy is
enacted like this, that the proper procedures are put in place so that, for instance, if
'Rachel's' wants to pay to have an ad put in there, that the City is not putting something
in there - would not have to put something in there that would be offensive to many
people in the community; so we want to make absolutely sure that that is not going to
happen. "
Deputy Mayor Gennell commented that having the City incur the expense of stuffing -
for anybody, is again something else." "I just don't know what kind of costs are
represented by stuffing extra stuff in it, if it's just a mechanical thing and you punch a
different key on the machine, that's fine; but secondly, I had a conversation with the City
Manager regarding this, as to when the Seminole County Government Television
Channel was considered and the verbiage for the County setting it up and everything was
worked on - we deliberated and debated all these things - and how do you contain it, so

that we aren't having to put out adult entertainment on it or craziness. And the way that
was handled, was that the production available was available for government and
education. That's it! And that seems to fit under some federal guideline which I referred
the City Manager (to refer Anthony) - somebody - where government and education.
And in fact, government is educating by virtue of the information on the water bill and by
the City's newsletter - we are educating. It's a matter of public information every time
we hold a meeting."
Deputy Mayor Gennell further said, "My suggestion is to see if it can be done; if we can
accommodate the public and the City of Winter Springs, and those with children in
school- they will have - varied interests, if we confine it to government, which is City; it
could even be the County. What if the County comes to open another portion of the Trail
and they want to put in on our water bills, that we're getting a new section of the Trail
open. That's another thing. Government, in general or education. That's my
suggestion. "
Commissioner David W. McLeod commented that, "I believe you are opening it wide
open. I think you are really creating a potential headache. I think you're better off just to
leave the thing so that it is strictly used for our City - our City government, as it was
initially intended, and the water bills, anything being put on those water bills is put on by
the City, for the City's activities, or what they're involved with and sponsoring. And the
same thing with the newsletter. Only that the newsletter - I was involved with and so
were you - when that newsletter was brought out by the City and it was to be brought out
- the newsletter for a true picture of what's happened in our City, and with our City
government; and what the future of our City and our City government is. It was not for
the purpose of schools, it was not for the purpose of the County, or anything else. And I
think that as soon as we open that up, that door - once you open it, it's very hard to shut
it. I think you should just leave it shut. You leave the policy as the policy today, and
leave it at that."
Deputy Mayor Gennell stated that, "I am open to listening to both sides of it, because I
think both sides have merit. But - 1 do want it researched real well and come back,
reflecting all of the Commissioners' input and concerns."
Commissioner Robert S. Miller added, "I'd like to see this deferred. Counsel is working
on an analysis of the pros and cons of such a policy. I think we should wait until we
receive that."
Commissioner Martinez then said, "1 don't have any problem with tabling this Item
today, until the City Attorney has finished and conducted his research, and drafts some
kind of a policy. I agree with Commissioner McLeod, to a degree, with some of the
things he said, but I think that the policy writers are going to set the tempo for what we
would be able to put in that bill, or not. And, when that comes to us for a final decision,
we'll decide whether that's what we want in there, or not."

"I'D LIKE TO MAKE A MOTION THAT WE DEFER." MOTION BY
COMMISSIONER McLEOD - "UNTIL THE ATTORNEY HAS COME BACK
WITH A SOLUTION TO THIS PARTICULAR ITEM AND
RECOMMENDATION. I SUSPECT THAT HE'LL HAVE IT FOR US WITHIN
THIRTY (30) DAYS." SECONDED. DISCUSSION.
Attorney Vickaryous commented on the proposed time frame and added, "This is
probably one of the most complex areas of the law; and we're talking about the First
Amendment and how it applies to government. There are books on that."

Wishes To Advise The City Commission Of Changes That Will Take Place In The
Employee Health Insurance Program, Effective October 16, 2000, The Reason
Therefor, And An Alternative That Is Available.
Discussion.
"I'LL MOVE THAT WE ADOPT THE SILVER PLAN - CHANGES EFFECTIVE
OCTOBER 16TH, AND AUTHORIZE STAFF TO NEGOTIATE WITH THE
LEAGUE." MOTION BY COMMISSIONER MILLER. SECONDED BY
COMMISSIONER McLEOD. DISCUSSION.
