Meeting REQUEST: Police Department Code Enforcement Bureau in conjunction with the Community Development Department requests the Commission review alternatives and provide direction regarding a proposed on-street parking program. PURPOSE: The City Commission on October 2, 2007 directed the Code Enforcement Bureau to bring back the procedures that would be used to implement an on-street parking program on certain roadways within the City and under certain conditions. The purpose of this agenda item is to present these procedures and to request direction from the Commission. CURRENT PARKING REGULATIONS: Under the City's current parking regulations, parking is prohibited on any roadway, except as follows (per City Code Section 12-65.1): 1. Where on-street parking is authorized by City Code for a particular zoning district. 2. ACommission-approved site specific parking zone established by resolution at a public hearing. 3. Temporary suspension of on-street parking by resolution for emergencies, special events, or other public purposes. 4. Temporary parking for delivery vehicles and other service providers. 5. Temporary on-street visitor parking based on a resident's call to and approval by the police department (not overnight). ON-STREET PARKING POLICY OPTIONS: Based on the Commission's discussion and direction at the October 2, 2007 meeting, the following options are presented for further discussion and consideration: December 10, 2007 Regular Agenda Item 604 Page 2 Option 1 - Allow on-street parking City-wide on all streets where it can be supported; no permits required. Option 2 - Implement asix-month pilot program allowing on-street parking in selected neighborhoods on a temporary basis for evaluation; no permits required. Option 3 - Implement aCity-wide on-street parking program consisting of the following components: 1. Individual parking permits that allow up to one (1) vehicle per household to park on the street in front of that household only, based on a demonstrated need for on-street parking (see below for further discussion). 2. Commission-approved site specific parking zones for a neighborhood, street, or block, as currently provided in City Code Section 12-65.1 3. On-street parking can be allowed if Commission finds there is a public necessity at any location. 4. Maintain the current policy for temporary visitor parking, whereby residents call the police department and request approval to allow temporary (non- overnight) parking for one-time events. INDIVIDUAL PARKING PERMITS: Under Option 3 above, individual parking permits would be issued based on the following procedures: 1. City residents complete and submit a "Residential Parking Permit Application Form" (see attached Exhibit A), along with a $25 application fee. 2. In order to receive an individual parking permit, residents must demonstrate to Staff's satisfaction that the number of vehicles at a particular household exceeds the number of available parking spaces, including all garage and driveway parking spaces. Individual parking permits would not be issued for convenience. As a part of the permit review process, residents with garages shall allow Staff to observe the inside of the garages to verify that the garage is being used for its full parking capacity. 3. Staff will review the permit application and determine if the street frontage at that household can safely accommodate on-street parking. Staff will note on the permit any site-specific conditions to be applied. 4. The permit will consist of a tag to be hung on a vehicle's rearview mirror. The tag will be such that it can be easily seen by law enforcement. The tag will be transferable between vehicles at a particular household. 5. Not more than one individual parking permit will be issued per household. December 10, 2007 Regular Agenda Item 604 Page 2 6. Individual parking permits can only be used only at the household for which it was issued. 7. Individual parking permits will be issued only to property owners. The individual parking permits would be good for one year and would require payment of a $25 fee for renewal. 9. Applications will not be received for households on streets that do not support on-street parking due to insufficient street width, street type, lack of a gutter, etc. Residents do not have to pay a $25 application fee only to find out parking is not allowed on their street. 10. Individual parking permits will not be issued to residents on private streets. The Police Department does not enforce parking regulations on private streets, with the exception of ensuring that on-street parking does not limit emergency access. IMPLEMENTATION COSTS: Based on the eligibility restrictions described above for the individual on-street parking permits, it is estimated that there are approximately 100 residents that may be interested in applying for a permit. If this is the case, then the permits can be created, processed, and enforced-with current staff. A City-wide on-street parking program without the eligibility restrictions described above would likely require additional permitting and Code Enforcement staff. RECOMMENDATION: Staff recommends Option 2, consisting of a six-month pilot program allowing on-street parking in selected neighborhoods on a temporary basis for evaluation. This would allow a transition period and would enable the City to adjust the policy and the implementation process before making it City-wide. Any neighborhood could participate in the pilot program upon request if it has streets that can safely accommodate on-street parking. ATTACHMENTS: 1. AND AS SET FORTH HEREIN; PROVIDING FOR REPEAL OF PRIOR INCONSISTENT RESOLUTIONS, SEVERABILITY, AND AN EFFECTIVE DATE. WHEREAS, the City is granted the authority under Section 2(b), Article VIII, of the State Constitution to exercise any power for municipal purposes, except when expressly prohibited by law; and WHEREAS, section 12-65(1)a.3. of the City Code authorizes the City Commission to temporarily suspend the prohibition of parking vehicles on any roadway for public purposes; and WHEREAS, the City Commission hereby finds that temporary on-street parking should be afforded to residents in order to accommodate the increased parking demands generated by the holiday season; and WHEREAS, the City Commission desires to temporarily suspend the prohibition of parking vehicles on certain roadways from December 11, 2007 through 11:59 P.M. of January 5, 2008, pursuant to section 12-65(1)a.3.; and WHEREAS, the City Commission of the City of Winter Springs deems that this Resolution is in the best interests of the public health, safety, and welfare of the citizens of Winter Springs. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, SEMINOLE COUNTY, FLORIDA, AS FOLLOWS: Section 1. Recitals. The foregoing recitals are hereby fully incorporated herein by this reference and are deemed a material part of this Resolution. Section 2. Declaration of Public Purpose. The City Commission hereby declares that temporarily suspending the prohibition of parking vehicles on roadways serves a significant public purpose under the terms and conditions set forth herein. Section 3. Implementing Section 12-65(1)a.3. of the City Code. City of Winter Springs Resolution No. 2007-56 Page 1 of 2 A. Except for the roadways set forth in paragraph B, the prohibition of on-street parking on City roads is hereby temporarily suspended from December 11, 2007 through 11:59 P.M. of January 5, 2008. B. The temporary suspension provided for herein shall not apply to: 1. The roadways set forth in Exhibit "A" which is attached hereto and fully incorporated herein by reference. 2. Any roadway not open to the general public for travel including, but not limited to, private roadways in gated communities. Section 4. Emergency/Public Safety Situations. Nothing herein shall prohibit the City from prohibiting on-street parking on any street located within the City in the event of an emergency or in order to safeguard the public health, safety, and welfare. Section 5. Repeal of Prior Inconsistent Resolutions. All prior resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of the conflict. Section 6. Severability. If any section, subsection, sentence, clause, phrase, word, or portion of this Resolution is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereto. Section 7. Effective Date. This Resolution shall become effective immediately upon adoption by the City Commission of the City of Winter Springs, Florida.
