'i ';I' City Commission Special Meeting October 3, 2000 City Manager Department Agenda Item "B" COMMISSION AGENDA ADD-ON ITEM E CONSENT INFORMATIONAL PUBLIC HEARING REGULAR X 10/23-00 Meeting MGR~DEPT Authorization REQUEST: Mayor Paul P. Partyka requesting two items to be placed on the agenda for discussion. PURPOSE: The purpose of this agenda item is discussion of two issues, the legality of the severance provisions of the City Manager's contract and the future use of spray fields on Shepard Road for the Grizzly Football League. CONSIDERATION: 1. City Manager Contract: A question was raised by a local citizen as to the legality of the severance provision of the City Manager's Contract. The City Attorney has been asked to review this question. 2. Grizzly Football/Shepard Road Spray Fields: Several citizens have written letters to the city regarding the future use of the Shepard Road spray fields site as a practice area for the Grizzly Football League. FUNDING: Not applicable. RECOMMENDATION: It is the recommendation of the Mayor that the Commission discuss these items in the October 23, 2000 Commission meeting. Item: Requests clarification from the City Attorney on Section 5.02 in the City Charter as it pertains to severance pay for the City Manager. Does it conflict with the current City Manager contract? What are the options if it does? A citizen at the Commission Meeting of September 25 raised this issue. The City Attorney was requested to have the answer by the next meeting. 2. Item: Requests response from the recreation department I City Manager on use of the spray fields in the Highlands Community and whether there will be any plans for future sports fields' development. This issue continues to come up and we must respond to this issue clearly and directly for the residents of the community. This will ensure the correct facts for the public. The information provided to you regarding the development of the spray ponds is inaccurate. At the August 14,2000 Commission Meeting the Commission discussed the issue of the future use of the spray fields for recreational uses and determined the following: 1. The spray fields will need to be retained as part of the city sewer utility system. 2. Recreational use of the spray fields by the Grizzly Football League is temporary until such time that a replacement 10cation can be found. 3. The city should "attempt" to find a replacement location prior to the football league's next season. If this is not possible the footballleague's temporary use of the spray fields is to be significantly reduced until an alternative location can be found. As a result of the Commission's determinations the city is attempting to find an alternative site for the footballleague. The city has no plans to invest funds for the purpose of developing the spray fields for a permanent home of the football league. ',. Ronald McLemor City Manager for Winter Springs <. . .~TER SPRINGS _ , ...lanager Sir: Just this week I have been apprised of the proposed development ofthe retention ponds along Shepard Road. I am vehemently opposed to such a plan, as are almost all of our neighbors. I am shocked that the city would proceed with such a plan without notifying the residents. I believe that the development of the ponds area into a sports complex violates the intent and purpose ofthe Planned Unit Development (PUD). This area has a lot of retired and elderly people and this places an additional vulnerability to problems such as vandalism and drug related crimes. Crimes readily associated with kids with too much time and no supervision such as those congregated at a sports complex. I understand that these groups used to play at West Wind Park. That is the place for them, it is not right on top of our homes and elderly people who would like to take a walk. after dinner without being bumped and pushed and harassed and generally treated poorly. Plus, this lovely park has already gotten the traffic flow problems worked out. With the money set aside for development of the ponds, why could you not develop a new area of the Park and set it aside for a sports complex.
