CITY COMMISSION ITEM 503 Consent Information Public Hearin2 X Re2ular November 26,2007 Meeting I}----/ / t2OIA- Mgr./~ REQUEST: The Community Development Department requests the City Commission hold a public hearing for First Reading of Ordinance 2007- 29, which amends the text of Section 20- 351 and Section 20-354 of the City's Code of Ordinances with respect to Part "A" PUD density calculations. PURPOSE: To facilitate a text amendment up-dating the PUD "A" sections of the code to provide for currently acceptable mixed-use residential development trends. APPLICABLE LAW AND PUBLIC POLICY: Florida Municipal Home Rule Powers Act. Chapters 163 and 166, Florida Statutes. Chapter 20, Article IV. Planned Unit Developments, Division 2 (Specifically Section 20-351 and Section 20-354). Winter Springs Charter Section 4.15 Ordinances in General. CONSIDERA TIONS: During the Winter Place PUD review, it became obvious that the two separate PUD sections of Chapter 20 (Part "A" and Part "B") had different criteria for which an area's residential density could be calculated. This regulation, which was adopted in the 1980s, is inconsistent with currently acceptable development trends. These current development trends include, but are not limited to, higher density, mixed use, more unit type variation, multi- modal options, as well as scenic and terminating vistas. Development regulations and subsequently approved developments must be consistent with the comprehensive plan. As set forth in Subsection 163.3194, FS, a development regulation is consistent with comprehensive plan if the land uses, densities, or intensities and other aspects of the regulation are compatible with the objectives, policies, land uses, and densities or intensities in the comprehensive plan. Allowable densities may not exceed the maximum set forth in the Comprehensive Plan for a specific Future Land Use designation. Staff will continue to review residential PUD densities for compliance with the comprehensive plan. ATTACHMENT C ORDINANCE NO. 2007-29 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, FLORIDA AMENDING CHAPTER 20, ZONING, OF THE CODE OF ORDINANCES RELATED TO PLANNED UNIT DEVELOPMENT; AMENDING THE DEFINITION OF GROSS RESIDENTIAL ACRE AND PROVIDING A DEFINITION AND DENSITY FOR MIXED RESIDENTIAL PUD; PROVIDING FOR THE REPEAL OF PRIOR INCONSISTENT ORDINANCES AND RESOLUTIONS, INCORPORATION INTO THE CODE, SEVERABILITY, AND AN EFFECTIVE DATE. WHEREAS, the City Commission is granted the authority, under Section 2(b), Article VIII, of the State Constitution, to exercise any power for municipal purposes, except when expressly prohibited by law; and WHEREAS, the City Commission desires to amend the definition of gross residential acre as the term is defined in Section 20-351 of the City Code; and WHEREAS, the City Commission desires to provide a density requirement for mixed residential PUD development on a case-by-case basis as determined by development agreement; and WHEREAS, the City Commission of the City of Winter Springs, Florida, hereby finds this ordinance to be in the best interests ofthe public health, safety, and welfare of the citizens of Winter Springs. NOW, THEREFORE, THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS HEREBY ORDAINS, AS FOLLOWS: Section 1. reference. Recitals. The foregoing recitals are hereby incorporated herein by this Section 2. Code Amendment. The City of Winter Springs Code, Chapter 20, Zoning; is hereby amended as follows: (underlined type indicates additions and stlikcout type indicates deletions, while asterisks (***) indicate a deletion from this Ordinance of text existing in Chapter 20. Areas primarily dedicated to water or utility related uses may be included in calculating gross residential acre. if incorporated into a final development plan as a significant amenity to the residential development. * * * Mixed residential PUD. A planned residential community which may include any combination of single-family homes. patio homes. townhouses or garden apartments. * * * Sec. 20-354. Section 3. Repeal of Prior Inconsistent Ordinances and Resolutions. All prior inconsistent ordinances and resolutions adopted by the City Commission, or parts of prior ordinances and resolutions in conflict herewith, are hereby repealed to the extent of the conflict. This Ordinance shall be incorporated into the Winter Springs City Code and any section or paragraph, number or letter, and any heading may be changed or modified as necessary to effectuate the foregoing. Grammatical, typographical, and like errors may be corrected and additions, alterations, and omissions, not affecting the construction or meaning of this ordinance and the City Code may be freely made. Section 5. Severability. If any section, subsection, sentence, clause, phrase, word or provision of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, whether for substantive, procedural, or any other reason, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions of this Ordinance. Section 6. Effective Date. This Ordinance shall become effective immediately upon adoption by the City Commission of the City of Winter Springs, Florida, and pursuant to City Charter.
