REQUEST: Community Development Department, Land Development Division, requests the
Commission remove Regular Agenda Item.A of the August 28,2000 Commission
Meeting from the table for consideration. The request is to record the plat and
covenants for Golfside Villas.
PURPOSE: The purpose of this agenda item is to request the Commission remove from the
table Regular Agenda Item A of the August 28, 2000 Commission which was a
request to approve the recordation of the plat and the covenants for Golfside
Villas.
FINDINGS: The Commission, at their meeting of August 28, 2000, tabled (postponed) this
item until the September 11, 2000 meeting while certain questions were researched
and answered. The questions related to covenants are as follows:
COVENANTS:
]) Section 12( e) - Is it correct to show 100% lot coverage. Yes - this is a
townhouse development and it is possible for a 100% lot coverage.
2) Section 18 - Is this matter covered by federal regulations? Yes. The HOA or
developer/owner should consult with federal regulations on this matter.
3) Section 21 - Is it legal to prohibit political signs? This is a private subdivision
with private streets. Private Deeds and Covenants can be more restrictive than
City Code.
4) Section 23 - Prohibition to hang garments and clotheslines. This is a common
stipulation found in covenants previously reviewed by the Commission.

OTHER ITEMS:
1) Minimum lot width - This is a Planned Unit Development and minimum lot
widths are specified at the time of approval. Town House lot widths can vary
from 12 feet to 30 feet. The Golfside Villas town house lots vary from 24.67 feet
to 27.66 feet in width.
2) Sodding of the pond - Silver Sea Homes has previously been notified by City
Staff that there must be sodding in the pond. The item is on the punch list for final
inspection prior to Certificates of Occupancy being issued. There is also a
Performance Bond which covers "Earthwork, curb, off site paving, signs, sodding,
water and sewer." The project is scheduled to come back before the Commission
for acceptance of improvements prior to the issuance of Certificates of
Occupancy.
3) The City Attorney is looking into the entire CCR issue and will report back
to the Commission upon completion of his research and analysis.
RECOMMENDA TION:
Staff recommends that the Commission approve the request to record the plat and
covenants.
