COMMISSION AGENDA ITEM f'(-:r Consent Informational Public Hearing Regular June 26, 2000 Meeting Mgr. I Authorization REQUEST: The General Services Department requests that the City Commission pass a resolution for the formal adoption of the new Personnel Po'lities. PURPOSE: The purpose of this agenda item is to formally adopt new personnel policies which comply with federal and state legislation passed since 1980, and which provide for updated procedures to address the complete range of human resource issues. APPLICABLE LAW AND PUBLIC POLICY: Fair Labor Standards Act - Family Medical and Leave Act - Title 7,42 U.S.C. Chapter 760, Florida Civil Rights Act Comprehensive Omnibus Budget Reconciliation Act (COBRA) City Charter City Administrative Code CONSIDERATIONS: - The current Personnel Policies of the city were originally compiled and adopted in 1980 and do not adequately address personnel issues and practices now required by city organizational changes, federal law, and state law. New Personnel Policies have been promulgated with the input of senior staff and the city's labor attorney. June 26, 2000 City Commission Regular Agenda Item"C" FUNDING: None Required. STAFF RECOMMENDATION: Staff recommends the Commission pass the attached resolution adopting new personnel policies for the city. ATTACHMENTS: - Resolution # 2000-18 - (Complete sets of Personnel Policies have been provided to the City Clerk's office for appropriate distribution) COMMISSION ACTION: RESOLUTION #2000-18 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, FLORIDA, RELATING TO CITY PERSONNEL POLICIES; PROVIDING FOR THE REPEAL OF PRIOR INCONSISTENT RESOLUTIONS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Winter Springs, Florida, has, from time to time, adopted and revised personnel policies for the proper administration of human resource matters; and WHEREAS, those personnel policies are in need of updating by the passage of this resolution; and WHEREAS, the City Commission of the City of Winter Springs, Florida, hereby finds this resolution to be in the best interests of the public health, safety, and welfare of the citizens of Winter Springs; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, SEMINOLE COUNTY, FLORIDA, AS FOLLOWS: Section 1. The foregoing recitals are affirmed and incorporated as part of this resolution. Section 2. Unless otherwise provided or superceded by city charter, city ordinance, state or federal law, the administration of personnel matters affecting city employees shall be governed by written personnel policies and procedures as herein adopted and attached hereto as Exhibit "A", and which are fully incorporated herein by this reference. Section 3. All prior inconsistent resolutions adopted by the City Commission are hereby repealed. City of Winter Springs Resolution # 2000-18 Page 1 of 2 Section 4. If any section, clause, phrase, word, or provision is for any reason held invalid or unconstitutional by a court of competent jurisdiction, whether for substantive or procedural reasons, such portion shall be deemed a separate, distinct, and independent provision, and such holding shall not affect the validity of the remaining portions of this resolution. Section 5. This resolution shall become effective immediately upon passage by the City Commission of the City of Winter Springs, Florida.
