HomeMy WebLinkAbout2007 09 24 Consent 202 DK Properties COMMISSION AGENDA September 24,2007 Meeting Consent Information Public Hearin Re ular MGR. ~ lDept. ~ x ITEM 202 REQUEST: The Public Works Department requests the City Commission validate the staff recommendation finding the DK Properties site to be built in substantial accordance with the Final Engineering plans and to accept the potable water infrastructure for ownership and maintenance. PURPOSE: The purpose of this Agenda Item is to request the City Commission validate the staff recommendation finding the DK Properties site to be built in substantial accordance with the Final Engineering plans and to accept the potable water infrastructure for ownership and maintenance per Section 9-178 in order for Certificates of Occupancy to be issued. The site is located on the north side ofS.R. 434, east ofSR 417, between Barclay Reserve and Barrington Estates. The project consists of a new 10,000 SF office building and related site infrastructure and landscaping improvements. APPLICABLE CODE: Section 9-178. Required Improvements to be completed prior to building on lots; exceptions. (c) Where the building official has an authoritative method of assurance that the improvements will be completed in accordance with approved plans, such as withholding occupancy, the building official may issue building permits upon advising the developer that all or partial occupancy will be restricted until satisfactory completion of the improvements has be accomplished. CertifIcates of occupancy will not be issued until all improvements are accepted by the city commission. 092407_ COMM _ Consent_ 202 _ DK Properties Site Acceptance September 24, 2007 Consent Agenda Item #202 Page 2 FINDINGS: 1) The site has been constructed in substantial accordance with the Final Engineering plans approved by the City Commission at the November 27,2006 City Commission meeting, except as noted below. 2) All City agencies have found the work to be acceptable. 3) The engineer-of-record has certified the sitework. RECOMMENDED CONDITIONS OF APPROVAL: The following items are necessary to complete prior to a Certificate of Occupancy: 1) Record drawings shall be revised to comply with City requirements 2) The letter of credit for the portion ofthe onsite water main being conveyed to the City shall be re-issued to cover a two-year period instead of one-year as submitted 3) The berm at the stormwater pond shall be finish graded and sodded per the approved plans. RECOMMENDATION: Staff recommends that the City Commission validate the staff recommendation finding the DK Properties site to be built in substantial accordance with the Final Engineering plans and to accept the potable water infrastructure for ownership and maintenance, subject to the conditions of approval listed above. IMPLEMENT A TION: The Certificate of Occupancy can be issued after Commission approval and satisfaction ofthe conditions of approval.
