REQUEST: Public Works/Stormwater Department Requesting Direction Regarding the
Access to Oak Forest Lake for Maintenance
PURPOSE: The purpose of this Board item is to request direction from the City Commission
regarding the access alternatives to Oak Forest Lake for Aquatic Maintenance
purposes.
CONSIDERA TIONS:
This agenda item is needed to provide direction to the staff on the various access
possibilities to Oak Forest Lake to perform aquatic weed maintenance. The City has been
maintaining Oak Forest Lake since approximately 1995 using Stormwater Utility maintenance
funds at a cost of $178. 75/month because stormwater runoff from the surrounding public
streets enters the lake. The outfall is through a control structure on the Winter Springs
Boulevard side of the lake.
Access to the lake has been previously through Tract B although no drainage easement
exists on Tract B (See Attachment No.1). There are three drainage easements to the waters
edge from Chokecherry Court, Oak forest Drive, and Winter Springs Boulevard which are 15',
15' and 20' wide, respectively. These easements are in the location of the pipes into and out of
the lake. All three have some obstacles and challenges to be converted to the permanent
access point.
The construction of the Oak Forest Wall does not provide an opening for the current
access because a permanent easement is not in place. Once construction of the wall footing

began last November along Tract B, our access was blocked. No aquatic weed control has
been performed since November which has resulted in an increased growth of vegetation in the
lake. The increased vegetation is more of an aesthetic issue and does not pose a risk to the
stormwater functionality of the lake at this point. Attempts to create a new access over Tract
B from Winter Springs Boulevard were not successful because the property owner would not
memorialize the access in the form of a recorded easement and we were unwilling to spend
public funds on private property without a legal means of access in place. The Stormwater
Utility Manager sent correspondence in March to the lakefront property owners to ascertain if
an additional means of access was available which we were not aware of. No other access
points were identified.
At the May 22nd City Commission meeting, Marshall Allen of 1065 Winter Springs
Boulevard and owner of Tract B, offered to provide an access easement to the City at the
southern end of Tract B for access to the lake. The access would necessitate a gate opening in
the Oak Forest wall at this location. The Oak Forest Wall and Beautification District Advisory
Committee considered the access easement offer which would require a gate opening at their
June 8th meeting (minutes attached) and recommended that the City". . . utilize the existing
three (3) utility (sic) easements that they have and not pursue adding a gate in the wall on
Tuskawilla".
ALTERNATIVES:
.
1. Direct staff to utilize whichever existing drainage easement is most conducive to a permanent
access point. After reviewing the three existing easements, the Winter Springs Boulevard
location appears to be the best access due to the steepness of the other two easements.
Improving this access may necessitate a dredge and fill permit, the removal of some palm trees,
and modifications to the outfall structure to allow the launching of a small boat. A rough
estimate of the costs would be $15,000 paid from the Stormwater Utility.
2. Direct staff to formalize the access easement offered by the property owner at the south end of
Tract B. Upon receipt, we would request Seminole County to provide curb cuts on Tuskawilla
Road and request a change order be processed for the gate opening. The gate would be an

aluminum "faux wrought iron" the same as being installed at the County's stormwater outfall
north of Winter Springs Boulevard. Additional costs for the gate opening, if any, would be
borne by the Stormwater Utility.
3. Direct staff to discontinue aquatic weed control maintenance on the lake. Stormwater pipe and
outfall maintenance would still be the responsibility of the Stormwater Utility.
FUNDING:
Any additional costs associated with the lake access alternatives would be borne by the
Stormwater Utility.
RECOMMENDA TION:
It is recommended that the City Commission direct the staff to follow the
recommendations of the Oak Forest Wall and Beautification District Advisory
Committee and implement alternative NO.1 which is to utilize the existing easements
for access to Oak Forest Lake.
IMPLEMENTATION SCHEDULE:
Staff will immediately implement the chosen alternative.

A. Discussion Of the City Commission's Meeting Regarding The Oak Forest
District
The Committee discussed that the meeting went "very well"; the deadline to file litigation
has passed; the number of assessment pre-payments received by the City; if maintenance
of common areas could be included in the yearly maintenance assessment; the ownership
and the lack of maintenance on empty lots and the right of ways; and how far the
irrigation extends down the medians into Oak Forest.
B. Update On The Transformer
Mr. Kipton D. Lockcuff, Director, Public WorkslUtility Department informed the
Committee that he had not received a price quote for the relocation of the transformer.
The Committee discussed the progress of the wall and road construction.
C. Update On The Winter Springs Boulevard Median
Mr. Lockcuff informed the Committee that the contractor has not submitted a price quote
for the new median design at Winter Springs Boulevard. Discussion ensued regarding
needing the price to make a decision.
D. Discussion Of The Entrance To Oak Forest Lake
Mr. Lockcuff explained that City has been doing stormwater maintenance and weed
control for the last five (5) years: that the City has accessed the lake through tract B,
which wilI be blocked by the wall; other alternative access options; and the gate for the
outfall west of Winter Springs Boulevard. Mr. Lockcuff distributed a copy of letter from
a resident proposing to grant the City an easement to the lake from Tuskawilla Road.
Discussion ensued regarding the various options to access the lake; the County's need for
an easement large enough for a curb cut with a "T -turn"; which easement option would
be easiest for the City; and who will be responsible for the cost.
The Committee reviewed the wall plans and discussed the location of the gate in the
northern section of the wall; whether access should be through the wall; and what work
the City does to the lake.
Mr. Gregory spoke of not putting "a hole" in the wall and using some other easement.

Discussion continued regarding whether the property owners around the lake have an
association specifically for maintenance to the lake; and that a recommendation from the
Committee should be made to the City Commission.

E. The Committee's Membership
Chairman Helgeson informed the Committee of the resignation of Committee Member
Anna Fernandez and Committee Member Dennis Norsesian's lack of attendance; he read
Article 3.2 A. of the By-laws regarding "causes of removal"; and "that he would entertain
a motion at this point, should one be made, to recommend to the City Commission for
removal of Committee Member Norsesian".

The Committee discussed if an newspaper advertisement is necessary to attract interest in
the vacancy on the Committee. Chairman Helgeson explained that he wrote an article for
the Homeowner's Association newsletter informing the residents of the procedure if
someone was interested in becoming a Committee Member; and informed the Committee
that Mr. Gregory submitted a letter requesting appointment to the Committee.
F. Other Business
Discussion ensued regarding the delivery of the brick; the status of the wall construction;
that Mr. Lockcuff will inspect the back side of the wall; and that the wall height will be
six (6) feet on the Tuskawilla Road side and will vary on the resident's side due to the
road be raised.

The Committee asked Staff to submit at the July meeting a detailed plan of the signage
and Mr. Lockcuff requested the City Clerk's Office to research the minutes for discussion
regarding the wording of the signage. The Committee discussed the medallion; the
present Oak Forest sign at the Trotwood Boulevard entrance; whether the sign lettering is
bronze or painted; the Staff needing a detailed design for the medallion; and the location
of the transformer south end of the wall.

It is also worth noting that there will be another cut in our wall for the purpose (I believe)
of treating ponds.
EASEMENT IMPEDIMENTS
Easement between Lots 2 and 3 (Purple highlight)
18 mature trees, 2 young trees, landscaping, partial privacy fence, existing electrical
transformer in the center of the easement, storm water drainage curbside. (trees valued at
$90,000).
Easement between Lots 14 and 15 (Green highlight)
Fence, storage shed, storm water drainage curbside.
Easement between Lots 21 and 22 (Blue highlight)
Power transformer in the center of the easement, at least one (1) mature tree, storm water
drainage curbside fence, and pool pump.
I am a homeowner whose home does not abut the lake. I cannot, in all good conscience,
recommend using these easements as boat access points. It would be an imposition as
well as disturbing to the natural tranquility of those affected homeowners. When exiting
the Oak Forest Subdivision from Oak Forest Drive and Winter Springs Blvd., one cannot
see the offered area of access. Traveling at 45 mph down Tuscawilla Road will not leave
much of an opportunity to view the access area. Please do the RIGHT thing. Take the
necessary action to establish the easement (through tract B), provide a curb cut, and make
provisions for gated access through the brick wall.

Public Works/Storm water Department Requesting Direction Regarding the Access to
Oak Forest Lake for Maintenance
I have been asked to represent homeowners whose property abuts Oak Forest Lake. Let
the record show that homeowners from all homes abutting Oak Forest Lake have
responded to the city by way of Petition. This equates to 100%.
As you know from your packets, Oak Forest Wall Beautification Advisory Board will
recommend you use one of the existing drainage easements for access to the Oak Forest
Lake for the purpose of treating the aquatic weeds resulting from City storm water
drainage. Recognizing the importance of the Oak Forest Wall Beautification Committee,
it is our feeling that this committee comprised of 3 members out of a 5 member board
was presented inconect, incomplete, and misleading testimony, possibly poisoning the
board causing a personal, not equitable, decision to be made. We realize this may _be a
strong statement, therefore, the tape of the meeting is available tonight if you care to
listen to our claims. In fact, during a discussion regarding the property owner of tract B
the following statement was made by Board member Murro "Had we ignored him and
not asked him or not anything, I'd say you know what, maybe it',s kind of a design error
we missed when we designed it, when we thought this out. We were at this doorstep 100
times and 100 times it was no. Get out! Get out! Get out! Get out! So I say, you know
what it's a nice gesture, but take the palm trees out and go through there." Testimony
was also presented that there were "6 to 8" palm trees to move from Lot 2-3. Actually
there are 18 Palm trees (I counted them).
We are here tonight to present you with facts and show you that the directions by your
own Storm Water Manager, Ms. Kimberley Hall, E.L, were in fact followed to the letter
(March 6, 2000). In Ms. Hall's letter, she addresses the three (3) easements of Oak
Forest Lake, stating that all are currently unsuitable to allow for boat access. Ms. Hall
further suggests the Lake Residents meet as a group to discuss alternatives for permanent
access. (Pictures)
Residents of Oak Forest Lake have agreed (by petition) to the only equitable solution.
Residents request the city to provide a curb cut and make previsions for gated access
through the brick wall, accepting the permanent boat accessible easement from the
property owner of tract B. This is the same route by which the lake has been accessed for
the last 21 years.
It is worth noting that originally, a cut in the wall was planned during the original stages
of the wall planning (as testified to by Commissioner D. McLeod). It is my
understanding that the owner of tract B tried to work out another solution for access to
the lake, thus avoiding a cut in the wall for aesthetic purposes. This "other" offer was not
acceptable to the City putting us back to where we are today.

Dear resident:
As you probably know, the City of Winter Springs has not been maintaining your lake for the
last few months. Since the city does not have an easement over the lake and access easements to
the lake are obstructed, the city has been deliberating on whether to maintain the lake or return
maintenance responsibility over to the residents.
The City has decided to maintain the lake once a permanent access easement can be established.
The City of Winter Springs has three (3) easements for Oak Forest Lake, all of which are
currently unsuitable to allow for boat access. It is crut:ial for the City to access this lake in order
to provide proper stormwater maintenance for the purpose of stormwater retention and water
quality. Eliminating proper water quality treatment will cause your lake to deteriorate rapidly
causing negative effects on aquatic plants, fish, natural wildlife and the overall aesthetics of the
lake.
In the past, Mr. Allen was gracious enough to allow the City to access the Lake through his
property along Tuscawilla Road. However, during the lane widening construction, a permanent
wall is being placed along Tuscawilla Road, thereby eliminating this access point.
Unless the residents can provide a suitable 15' wide, boat accessible easement, the City will
utilize one of the existing easements. Please take the initiative to discuss with your neighbors
the alternatives for permanent access. I highly urge the residents to meet, as a group, to discuss
these alternatives. If no alternatives can be presented to me, as a group, then the City will take
r'urther activn to modify the eXIstmg casement that we have selected tor access.
I will be happy to help you in any way possible, and I will make myself available to meet the
residents, as a group, ifneeded. If you have any questions or comments, please do not hesitate to

Dear Lakefront Property Owner:
This is in response to the letter we received from Ms. Kimberly Hall,
Winter Springs Stormwater Utility Manager, dated March 6th, 2000. I
have had discussions with several lakefront property owners who have
expressed their concern about the letter from Ms, Hall and how the
city has allowed the lake to deteriorate to the worst condition in
over 16 years. Hopefully, t.his will address some of t.he questions
posed and will "set. the record straight.". I have acted in good-faith
and in a spirit of cooperation and fairness with the cit.y for over a
year in an effort to allow an acquatic weed control contractor access
to Oak Forest L.ake. Unfort.unat.E-dy, T cannot say t.he same for t.he cit.y
government officials with whom I have dealt during that time,
First, some background. About. 7 or 8 years ago I discovered t.hat.
Tract "B", which consists of approximately five acres, including over
one half of Oak Forest. Lake, wit.h approximat.ely 140 feet. of frontage
on Winter Springs Boulevard and 600 feet. of front.age on Tuscawilla
Road, unlike ot.her properties abut.ting Oak Forest Lake, had no deed
restrictions. This meant. t.hat an ent.it.y, such as t.he Cit.y of Winter
Springs, for eXi:."jmple, or an individual, insensit.ive t.o t.he peace B.nd
t.ranquility of lakefront living enjoyed by lakefront propert.y owners,
might acquire the property and open the lake to the general public,
with devastating consequences to our quality of life, such as the in-
troduction of power boats, powered personal watercraft, along with the
associated noise, t.rash, lit.ter, loud music, trash talk, etc. Fortu-
nat.ely, I was able t.O purchase t.he parcE')} in .July, 1997.
Several months ago I met with Ms. Hall, members of her staff, and the
acquatic weed control contract.or. At that meeting I agreed t.o grant.
the city access to Oak Forest Lake, ingressing and egressing via Win-
ter Springs Boulevard, provided the cit.y would accomplish t.he clearing
and grading necessary to allow vehicular access. To make the lake ac-
cessible would ent.ail t.he removal of underbrush, grading, and the re-
moval of several t.rees (It now appears that access will require re-
moval of t.wo pine t.rees plus 3 smaller trees). Ms. Hall expressed an
opinion that if the city expended funds to clear, grade, and remove
t:rees, t.he draft..ing of a formal easement. would be required. Obviously,
encumbering the property with an easement will adversely impact the
value of the pay'cel and will not. be considered.
Aft.er several days of mulling over the matt.er, I decided to make the
cit.>' an offsr t.hey could not. refuse. I would clear, grade, and remove
the trees, at my expense, and allow the city access to the lake. Aft.er
clearing t.he underbrush and rough grading, T submit.t.ed a request t.O
the city requesting an arbor permit t.o remove, again at my expense,
three pine trees approximately 14 to 18 inches in diameter. Staff ad-
vised me t.hat. T would be required t.O pay (T think it. was $25) for a
permit plus I would be required to plant three 15 gallon trees to re-
place the pine trees. Since Tract R and the lot on which my home is
locat.ed in Oak Forest are bot.h heavily txeed (due t.O numerous t.rees I
planted during the past 16 years), I had nowhere to locate three 15
gallon trees. Surprise! Surprise! They had t..he perfect. solut.ion t.o
my di lemma. Si nee I had no place t.o plant the trees, t.he ci ty wou'ld
allow me to pay t.he city a sum of $150 ($50 per tree) and t.hey would
plant three trees elsewhere in "Tree City, USA", commonly known as
Winter Springs. Rased on the fact that. T had already spent several
hundred dollars to rent construction equipment and several days of
labor by myself and Mr. Mitch Workum, owner and occupant of 1067 Win-
ter Springs Boulevard, T rejected their largesse. I then requested
the staff member contact Ms. Jimmette Cook, explain to her that the
reason for removing the trees was to allow t.he city access to Oak
Forest Lake. Later that evening I saw Ms. Cook and was appalled when
she informed me that she would not waive the fee. Based on thi~, and
several other instances where I have found city staff members to be
equally arbit.rary, any future dealings T have with the cit.y on t.his
matter will be reduced to writing and made a matter of record.
Should any recipient(s) of t.his let.ter so desire, t.hey may pursue with
the city the lake access issue. I am leaving open the offer t.o permit
access to t.he lake across Tl-act B via Wi nter Spr i ngs Bou levard, and
will sign an application for a permit. t.o remove five trees, so long as
t.he work is done by a licensed contractor.

PROVIDE ACCESS TO OAK FOREST LAKE FOR AQUATIC WEED CONTROL
We, the undersigned, owning and residing on property abutting Oak
Forest Lake, feel the time has come for local authorities of ~inter
Springs to provide access to the Lake so out-of-control aquatic weeds
may be removed by periodic application of aquatic herbicides_ For
the past 21 years, access to the Lake has been from Tuscawilla Road
through the southern portion of Tract B, Oak Forest, Unit One_ Due
to the lane widening and construction of a brick wall, the only suit-
able access to the Lake will be blocked. The property owner of Tract
B has agreed to grant the City a permanent, boat accessible easement,
from Tuscawilla Road. Respectfully request you take the necessary
action to establish the easement, provide a curb cut, and make pro-
visions for gated access through the brick wall.
