Authorization REQUEST: The City Clerk respectfully requests that the City Commission decide on the appropriate Appointments or Reappointments for terms of office which will be expiring in July 2000 - pertaining to the Beautification Of Winter Springs Board; the Board of Adjustment; the Planning And Zoning Board/Local Planning Agency; and the Tuscawilla Lighting And Beautification District Advisory Committee. PURPOSE: The purpose of this Agenda Item is for the City Commission to make Appointments or Reappointments for terms of office, pertaining to the Beautification Of Winter Springs Board; the Board of Adjustment; the Planning And Zoning BoardILocal Planning Agency; and the Tuscawilla Lighting And Beautification District Advisory Committee. All Seats are scheduled to expire in July 2000. Membership; terms; removal. The board shall be comprised of seven (7) mem- bers. Five (5) members to be appointed by the city commission with the incumbent mayor and the city manager serving as ex officio members of the board. Each board member shall serve a three- year term and may be removed at any time by a majority vote of the city commission. The city com- mission - shall strive to appoint persons from the private business sector in Winter Springs or busi- ness persons residing within the city. (Ord. No. 424, ~ 2, 7-11-88) Sec. 2-72. Reimbursement for expenses. Each board member except the mayor and the city manager shall be reimbursed from the city treasury to cover the expenditures naturally and necessarily incurred in the performance of their duties of office and the reimbursement for ex- penses shall be established by resolution. The board shall recommend to the city commission all pro- grams it deems necessary to effectuate its pur- poses. (Ord. No. 44, 9 44.10, 1-8-68; Ord. No. 156, 9 2, 9-12-77). Sec. 20-58. Assistants. Expenditures for all professional and clerical assistants employed in connection with the per- formance of the functions of the planning and zoning board shall b~ within the amounts appro- priated for such purposes. (Ord. No. 44, 9 '44.12, 1-8-68) Sec. 20-59. Recommendations. The recommendations of the planning and zon- ing board to the city commission shall be in writing and in duplicate, and shall show the estimated cost and the suggested method or meth- ods of financing. As soon as convenient, after the recommendations are received by the city commis- sion, the city commission shall call for a public hearing regarding the regulation, restriction or boundaries at which parties in interest and citi- zens shall have an opportunity to be heard. Notice of the time, place and purpose of the public hearing shall be published once, no less than fifteen (15) days prior to the time of the hearing in a newspaper of general circulation in the city and notice shall also be posted in three (3) conspicuous places throughout the city. After public hearing, the city commission shall consider and act upon the recommendations of the planning and zoning board and upon completion of action by the com- mission, the city clerk shall return to the plan- ning and zoning board a copy of the recommenda- tions with the commission's action noted thereon. No. 44, 9 44.17,1-8-68) Sec. 20-77. Composition, appointment of members. The board of adjustment shall consist of five (5) members having designated seats one (1) through five (5) with such numbers corresponding with a commission seat. Each member shall be a citizen and registered voter of the city and each appoint- ment by the respective commission member occu- pying the corresponding numbered seat shall be subject to commission ratification. (Ord. No. 44, 9 44.18, 1-8-68; Ord. No. 105, 9 1, 7-1-74; Ord. No. 214, 99 1,2,5-13-80) Sec. 20-78. Term; filling vacancies; removal of members. ( The term of office of the members of the board of a~justment shall run from the second Friday in July and each member appointed shall serve for a term of two (2) years, or until his successor is appointed and qualified. Except however, the first board appointed shall serve terms as follows: Seats two (2) and four (4), shall serve the full two-year term ending July 10, 1982. Seats one (1), three (3), and five (5) shall serve a one-year term ending July 10, 1981. Vacancies on the board may be filled by the commission member whose seat number corresponds with the vacant board of adjustment seat, subject to commission ratifica- tion. If any commissioner fails to appoint a mem- ber within two (2) regularly scheduled commis- .Editor's note-Ord. No. 577, ~ 1. adopted Feb. 3, 1995. amended Div. III, 99 20-76-20-84, of Art. II to provide that the decisions of the board of adjustment shall be recommen- dations to the city commission and that the city commission shall be the final authority for granting or denying requests for variances, special exceptions or other requests pursuant to section 20-82. As Ord. No. 577 did not specify amendatory language. the editor has amended the language of the provi- sions of Div. 3 to conform to the requirements of Ord. No. 577. Members shall be subject to removal from office . by the commission for failure to perform their duties or for other misconduct in office or auto- matically for failure to attend three (3) meetings within any twelve-month period of time. For pur- poses of removal, an absence from a specially called meeting of the board shall count the same as an absence from a regularly schedule meeting. (Ord. No. 44, ~ 44.19, 1-8-68; Ord. There shall be a chairman and vice-chairman of the board of adjustment selected from and by the members. They shall serve a term of one (1) year or until their appointment to the board is termi- nated, whichever is shorter, unless sooner re- moved by the board. (Ord. No. 44, ~ 44.19.1, 1-8-68; Ord. No. 214, ~ 2, 5-13-80) Sec. 20-80. Compensation; allowances for ex- . penses incurred in performance of duties. Members of the board of adjustment 'of the city shall be reimbursed from the city treasury to cover the expenditures naturally and necessarily incurred by them and that such reimbursement for expenses shall be established by resolution. (Ord. No. 44, ~ 44.19.2, 1-8-68; Ord. No. 219, 9 2, 7 -8-80) Sec. 20-81. Meetings; quorums; records to be kept. The board of adjustment shall meet bimonthly at a time set by its members. A special meeting may be called at any time by the chairman or any three (3) of its members if the need should arise. Three (3) members shall constitute a quorum. No action by the board of adjustment, except a vote to adjourn or to continue a matter to a subsequent date, shall be valid or binding unless adopted by Supp. No. 15 9 20-82 affirmative vote of three (3) or more members of the board. The board of adjustment shall make recommen- dations to the city commission to grant any vari- ance or special exception as delineated in this chapter. (1) The board of adjustment shall have the additional following specific powers. and duties: . a. To hear and make recommendations on appeals only where it is alleged there is error in any order, require- ment, decision or determination made by an administrative official in the enforcement of any zoning ordinance or regulations adopted. b. To hear and make recommendations to the city commission on special excep- tions as authorized under the terms of the city's zoning ordinances; to make recommendations to the city commis- sion on such questions as are involved in determining when special excep- tions should be granted; and to make recommendations to the city commis- sion on special exceptions with appro- priate conditions and safeguards, or to recommend denial of special excep- tions when not in harmony with the purpose and intent of the zoning regu- lations. In granting any special excep- tion with appropriate conditions and safeguards, violation of such condi- tions and safeguards, when made a part of the terms under which the special exception is granted, shall be deemed a violation of this chapter. The board of adjustment may recommend a reasonable time limit withln which the action for which the special exception is required shall be begun or com- pleted, or both. (a) The code enforcement board shall consist of seven (7) members to be appointed by the city com- mission. If any member fails to attend two (2) of three (3) succes- sive meetings without cause and without prior approval of the chairman, the board shall declare the member's office vacant and the city commis- sion shall promptly fill such vacancy. The members of the enforcement board shall elect a chairman from among its members who shall be a voting member. The presence of four (4) or more members shall constitute a quorum of the enforcement board. Members shall serve without compensation, but may be reimbursed for such travel, mileage and per diem expenses as may be authorized by the city commission or otherwise as provided by law. (Code 1974, ~ 2-54) State law reference-Similar provisions, F.S. ~ 162.05(3l. Sec. 2-59. Code inspector; duties. There shall be a code inspector who may be any authorized agent or employee of the city. It shall be his duty to ensure code compliance and to ini- tiate enforcement proceedings. No member of the code enforcement board shall have the power to initiate such enforcement proceedings. If it is de- termined that there has been a violation of the codes of the city, the code inspector shall notify the violator and give him a reasonable time to correct such violation. Should the violation con- tinue beyond the time specified for correction, the code inspector shall notify the enforcement board and request a hearing pursuant to the procedure hereinafter established. Written notice shall be mailed to the violator by certified mail, return receipt requested. Where mail would not be effec- tive, notice shall be by hand delivery by the code inspector. Notwithstanding the above, in the event the code inspector has reason to believe a viola- tion presents a serious threat to the public health, Supp. No. 13 safety and welfare, or the violation is irreparable or irreversible in nature, the code inspector may proceed directly to the hearing procedure pro- vided in section 2-60 and make a reasonable effort to notify the violator. (Code 1974, ~ 2-55) State law reference-Similar provision, F.S. ~ 162.06(2), (3). Sec. 2.60. Hearings. (a) Hearings of the code enforcement board may be called upon request of the code inspector or by the chairman of the board or by written notice signed by at least thtee (3) members of the board. Future hearings may be set at any hearing of the code enforcement board. The code enforcement board shall attempt to convene at least once every two (2) months, but it may meet more or l~~s often as the demand necessitates. Minutes shall be kept of all hearings by the code enforcement board and all hearings and proceedings shall be opened to the public. The city commission shall provide cler- ical and administrative personnel as may be rea- sonably required by the code enforcement board for the proper performance of its duties. A member of the administrative staff of the city shall present each case before the code enforcement board. The testimony presented to the code enforcement board shall be under oath and shall be recorded. The code enforcement board shall take testimony from the code inspector and the alleged violator. Formal rules of evidence shall not apply, but fundamental due process shall be observed and shall govern such proceedings. (b) At the conclusion of the hearing, the code enforcement board shall issue findings of fact, based on evidence of record, and conclusions of law and shall issue an order affording the proper relief consistent with powers granted herein. The findings shall be by motion approved by a ma- jority of those present and voting, except that at least four (4) members of the code enforcement board must vote in order for the action to be offi- cial. The order may include a notice that it must be complied with by a specified date and that a fine may be imposed if the order is not complied with by that date. Zoning ordinances; alterations, changes or amendments. Whenever it is proposed by or to the city com- mission that the zoning ordinances be altered, changed or amended, the city commission shall call a public hearing on the same and give notice of the time, date and purpose thereof, no less than fifteen (15) days prior to the date of the hearing by publishing such notice once in a newspaper of general circulation in such municipality and by posting such notice in three (3) conspicuous places throughout the city, one (1) of which shall be the city hall and a copy of such notice shall be deliv- ered to the planning and zoning board chairman or secretary not less than fifteen (15) days prior to the time of the hearing. After service upon the board, the chairman or secretary shall then call a meeting to consider the proposed alteration, change or amendment and shall thereafter and not less than forty-eight (48) hours prior to the scheduled hearing submit the board's recommendations to the city clerk for use of the commission at the time of the hearing and at least one (1) desig- nated member of the board shall attend the pub- lic hearing. Provided, however, the procedure set forth hereinabove does not apply to rezoning ap- plications and alterations in the city's compre- hensive plan, and the commission shall, on such requests, follow the procedure set forth in F.S. ch. 166 and F.S. ch. 163, as it now exists or as it may be renumbered or amended. Actions to alter, etc. (a) All applications for rezoning within the city shall be presented to the planning and zoning board for their consideration and recommendation to the city commission. Affirmative action by the city commission upon any rezoning application shall require a public hearing by the city com- mission. The public hearing before the city com- mission shall be advertised according to the pro- cedures set forth in F.S. ch. 163 and F.S. ch. 166, as they now exist or as they may be renumbered or amended. (b) The city commission is authorized to pro- ceed without the recommendations of the plan- ning and zoning board if such recommendations are not forwarded to the city commission within seven (7) days from the date of the planning and zoning board meeting. (c) The city commission shall act on a request for rezoning within six (6) months of receipt of an application by the planning and zoning board from the property owner. If the applicant requests a delay in the rezoning procedures, any such delay that will not permit commission action, after due public notice, within the six-month period of time, shall result in the application becoming null and void. The term of office of the members of the plan- ning and zoning board shall run from the second Friday in July and each member appointed shall serve for a term of two (2) years, or until his successor is appointed and qualified. Except how- ever, the first board appointed shall serve terms as follows: Seats two (2) and four (4) shall serve the full two-year term ending July 10, 1982. Seats one (1), three (3), and five (5) shall serve a one-year term ending July 10, 1981. Vacancies on the board may be filled by the commission mem- ber whose seat number corresponds with the vacant planning and zoning board seat subject to commission ratification. If any commissioner fails to appoint a member within two (2) regularly scheduled commission meetings after a vacancy occurs or a term expires, that seat will be filled by the mayor, subject to the ratification by city commission. Members of the planning and zoning board of the city shall be reimbursed from the city trea- sury to cover the expenditures naturally and necessarily incurred by them and that such reim- bursement for expenses shall be established by resolution. The planning and zoning board shall meet at least once each calendar month at a time set by its members. A special meeting may be called at any time by the chairman or any .three (3) of its members if the need should arise. Three (3) members shall constitute a quorum. No action by the planning and zoning board, except a vote to adjourn or to continue a matter to a subsequent date, shall be valid or binding unless adopted by affirmative vote of three (3) or more members of the board. The planning and zoning board shall serve as the planning and zoning commission. It shall be the duty of the planning and zoning board to recommend to the city commission the boundaries of the various original zoning districts and appro- priate regulations to be enforced therein and any proposed amendments thereto and shall collect data and keep itself informed as to the best practices generally in effect in the matter of city planning and zoning to the end that it may be qualified to act on measures affecting the present and future movement of traffic, the segregation of residential and business districts and the conve- nience and safety of persons and property in any way dependent on city planning and zoning. The board shall recommend the boundaries of dis- tricts and appropriate regulations.
