HomeMy WebLinkAbout2000 05 22 Informational B Add On Oviedo Marketplace Development of Regional Impact .\.- "" COMMISSION AGENDA ADD ON B Consent Informational X Public Hearing Regular May 22,2000 Meeting Mgr. / Authorizat REQUEST: The City Manager informs the City Commission that the City of Oviedo Local Planning Agency will consider a request on Thursday, June 1,2000 at 7:00 p.m. to Change the Approved Oviedo Marketplace Development of Regional Impact (DRI). PURPOSE: To inform the Commission that City of Oviedo is going through the process to review an application by Wall Mart Stores to Change the Approved Oviedo Marketplace Development of Regional Impact (DRI). APPLICABLE LAW AND PUBLIC POLICY: The provisions of 380.06(19)(f) F.S. which states in part: "Any proposed change to a previously approved development which creates a reasonable likelihood of additional regional impact, or any type of regional impact created by the change not previously reviewed by the regional planning agency,. shall constitute a substantial deviation and shall cause the development to be subject to further development-of-regional-impact review." CONSIDERA TIONS: . Applicant (Wall Mart Stores East, Inc.) has proposed to remove seven (7) acres [Parcel 34] from the Oviedo Marketplace DR! which incluides 60,000 square feet of retail and service uses, 350 parking spaces, and .6 acre wetland. CDDIt\'lay 19, 2000/3:47 I'M " MAY 8, 2000 CITY MANAGER'S SEAT Page 2 · Wall Mart Stores East, Inc. wants to build a Wal- Mart Supercenter (60,000 sq. ft.) on the west side of State Road 426 (Aloma Ave.) and just north of Mitchell Hammock Road (continuation of Red Bug Lake Road east of the beltway) · The Wal-Mart Supercenter will be adjacent to the Oviedo Marketplace DRI but will not have/share a common plan of development. It will have a separate master plan and will be permitted as a separate development from the Oviedo Marketplace. The Wal-Mart Supercenter will not share infrastructure. and will not have a common advertising scheme or promotional plan with Ovieod Marketplace DR!. · The applicant will need to proceed with a comprehensive plan amendment to the Oviedo Comprehensive Plan to change the existing future land use map categories of industrial or office to Planned Unit Development. · FDOT has outstanding issues regarding the total amount of trips that will be generated by the Wal-Mart Supercenter and the amount of trips that will result on S.R. 426 and Red Bug Lake Road, wich are both under the jurisdiction ofFDOT. First Street Sanford, FL 32771 Re: Oviedo Crossings (Wal-Mart) Notification of a Proposed Change E~:ment#5181 Dear Messrs~ and West:* We have reviewed the referenced NOPC and it is our understanding that the following changes are proposed: 1. Delete Parcel 34 from the DRI for the development of a Wal-Mart Supercenter, consisting of both retail and supermarket use. The proposed Wal-Mart development is represented to have a separate infrastructure and scheme of development from the DRI and the Viera Company has consented to the proposed change. 2. Revise the Development Order to reflect: a. Deletion of Parcel 34 from Map H, the Master Development Plan; b. Deletion of 6.6 acres; c. Deletion of 350 parking spaces; d. Deletion of 60,000 square feet of retail services; e. Deletion of .6 acres of wetland conservation; f. Deletion of 880 ADT and 880 external daily trips, and; g. Deletion of 148 peak hour external trips. We have reviewed this proposed change to see if the proposed Wal-Mart would share in the common infrastructure with the mother project, if it would share common ownership or advertising or if there are other indications that the projects were to be jointly operated. The only shared infrastructure appears to be a roadway that would, as proposed, run from Red Bug Lake Road to Oviedo Crossings Boulevard. The consultant for Wal-Mart has indicated thatthis roadway is in the City's comprehensive plan and is being put forth as a condition of approval by the City. Therefore, it assumed to be an involuntary sharing of infrastructure required by the city to promote circulation in the area and preserve capacity on SR 426. Other concerns related to this project include the following: 1. Access to Red Bug Lake Road and SR 426: is the spacing adequate for safe ingress and egress? The storage lanes need to be adequate so that left turning traffic entering the project does not back up into the main stream of traffic. 2. Is there capacity available on SR 426, Red Bug Lake Road, intersections of 434 & 426, 426,and Red Bug Lake Road? 3. A supplementary traffic analysis should consider the peak shopping timeframes to see if that hour's total traffic is less than the scenario analyzed for the usual PM peak hour. With the plethora of shopping in the vicinity, the Saturday afternoon peak could be higher than the weekday later afternoon peak. The city, county and FOOT should address these issues so that the regional roadway facilities are adequately protected. In conclusion, it is our opinion that these proposed changes do not result in an automatic substantial deviation determination pursuant to the threshold criteria of section 380.06(19), Florida Statutes. These changes are not expected to cause new or increased impacts to regional resources or facilities when considered independently or cumulatively with prior project changes. We therefore do not recommend that this proposal be submitted for additional regional review by this agency.
