REQUEST: Community Development Department, Land Development Division, presents to
the Commission for their direction to Staff on the request of Children's World
Learning Centers to amend the existing Tuscawilla Tract 15 Parcel l-C
Developer's Agreement.
PURPOSE: The purpose of this agenda item is for Staff to receive direction from the
Commission on the request of Children's World Learning Centers to amend the
existing Tuscawilla Tract 15 Parcell-C for outparcel NO.2 of the Kash n'Karry
site to allow Children's World Learning Center to locate on this site. The property
is on the west side of Vistawilla Drive, to the immediate south of the Kash n'Karry
complex and northeast of the Howell Creek Reserve recreation area.
APPLICABLE CODE:
Florida Statutes 163.3225. Public Hearings
The statute allows the amendment of a development agreement.
FINDINGS: 1) The City of Winter Springs entered into a Development Agreement with
Robert Yeager, Trustee, Zimmer Development Company and ContraVest, Inc.,
said agreement found in Official Record Book 3574 Page 0529 of the Public
Records of Seminole County, Florida.
2) Paragraph 3.5 of said agreement reads: The outparcel No.2 of the Kash
n'Karry site shall be restricted to office use only.
3) After the execution of the Development Agreement the entire Parcell-C was
platted in Plat Book 56 Pages 29-32 of the Public Records of Seminole County
and outparcel NO.2 of the Kash n'Karry site is now known as Lot 4.

4) The information to be included as an attachment to this agenda item was
presented to the Board of the Howell Creek Reserve Homeowners' Association
and was found to be an attractive alternative to office use. The Association, if
the Development Agreement is amended, would like a stipulation entered that if
the Children's World Learning Center would relocate at a later date that the parcel
return to office use only or a similar use as Children's World Learning Center.
RECOMMENDA TION:
The Staff is seeking direction from the Commission at this point. There are two
(2) recommendations to be considered. These are:
1) Proceed with the amendment of the document which would allow
Children's World Learning Center to locate on the outparcel; or,
2) Do nothing and leave the agreement as is.

Dear Don,
Following our conversation of April 4, I am enclosing for your review, a
packet of information about Children's World. The 4 - 8-1/2" X 11" color photos
are of the most recent building in Ohio which doesn't reflect the revised Florida
design. Unfortunately, that's the best I can do as a center has not been built yet in
Florida. The Ohio center is certainly representative in terms of quality.
The Florida centers have been designed with 11,411 SF of air conditioned
space to accommodate 175 children and 18 teachers. The hours of operation are
from 6:00 AM to 6:30 PM Monday through Friday. The centers are typically build
on a site of 65 to 70,000 SF, roughly 1.6 acres to accommodate the building, required
setbacks and drainage retention, if required, parking for 40 cars or so and a
playground area of 20 to 25,000 SF.
The specific site they are interested in for development of a child care facility
in Winter Springs, Tuscawilla area, is the Outparcel No.2 as defined on the
attached site plan from the Orange county records as surveyed by Boyer Singleton
& Assoc. This is the parcel that is the subject of the use restriction under Section
3.5 of the Development Agreement; page 5 attached.

Children's World would like this restriction "office use only", to be
amended to include child care as a permitted use. I will appreciate your discussion
with the City Manager to judge the City of Winter Springs' position. If it is in the
affirmative, Children's World will move forward with their due diligence period of
90 days to assess the viability of developing the site as a child care center. If further
information is needed or questions need to be answered, please call. I look forward

3.4 The Kash n' Karry development shall be subject to and comply with the sign
regulations and specifications set forth on the Bowyer-Singleton Signage Sheet sealed
and dated \ '2-}- 38
on file with the Office of the City Clerk, Winter Springs,
Florida, as a Final Engineering Permit condition for site development of said parcel,
if addressed therein, or if not the requirements set forth in Winter Springs Ordinance
No. 675.
3.5 The outparcel NO.2 of the Kash n' Karry site shall be restricted to office use only.
4.0 Development Conditions for the Courtney Springs Apartment Site (ContraVest)
To minimize impacts to abutting properties and to enhance the quality and design of
the Courtney Springs Apartments (the Apartment site) certain amenities have been
agreed to by the City and Contra Vest, and shall constitute requirements for
Apartment site development. Enhanced or permitted variations from City Code
requirements on the apartment site shall be as set forth below.
4. I Contra Vest is allowed to vary the size of the parking spaces from 10' x 20' to
9' x 20' for one hundred fifty four (154 spaces).
4.2 ContraVest is permitted to construct two (2) wing walls of approximately 60' in length
with the Courtney Springs identification sign on the front face of each wall on each
side of the entryway into the complex from state road 434. In addition, the crown of
the signs on the wing wall is allowed to exceed the eight (8') foot height requirement,
