REQUEST:
The City Manager presents to the Commission for their consideration, the request of Thomas J.
McGee, NTR Development, Inc. to delete from the proposed Town Center, property located on
the southwest comer of S.R. 434 and Tuskawilla.
PURPOSE:
The purpose of this agenda item is to present to the Commission for their consideration, the
request of Thomas J. McGee, NTR Development, Inc. to delete a 10 acre County enclave from
the proposed Town Center District.

The city shall have all powers possible for a city to have under the constitution

Article m Establishment of Districts
Section 20-104. (Changes and amendments.)
The city commission may from time to time amend, supplement, change or repeal
the regulations, restrictions or district boundaries and designations as set out in this
ordinance after a public hearing(s) as provided in F.S. ~~ 163.3161, 166.041 and any
amendments thereto, and as provided by the intents herein contained and in accordance
with the intents and purposes of the Florida Statutes.

Article xu. Powers
Section 12.01. (Powers generally,)
As provided in Articles VIII, Section 2(b) of the State Constitution the City of
Winter Springs shall have the governmental, corporate and proprietary powers to enable
the city to conduct municipal government, perform municipal functions and render
municipal services and may exercise any power for municipal purposes except when
expressly prohibited by law.
FINDINGS:
. NTR Development, Inc. is the contract purchaser of a 10 acre parcel on the southwest corner
of Tuskawilla Road and S.R. 434.
. Although the parcel in question is a County enclave, it is included within the proposed Town
Center District boundary.
. The NTR Development parcel has been included in the Town Center District since
September 8, 1998.
. A site plan that failed to meet Town Center District guidelines has been prepared by NTR
Development showing a proposed grocery store, retail space (10,560 sq. ft.) and Walgreen's
Drug Store. (Attachment A).
. City Consultant, Victor Dover has reworked the site plan to show how the proposed uses fit
into the Town Center design guidelines. (Attachment B)
. NTR Development, Inc. makes the argument that pedestrians will not cross S.R. 434 because
it will become a six lane divided highway in the future.

· FDOT Transportation Planner, Jim Martin, advises that there are no plans to increase the
capacity of this section of S.R. 434 to six lanes either in the five year plan or the metroplan
2020 long range plan.
· The best chances for configuring S.R. 434 into a desirable form are achievable if both sides
of the road develop according to the rules of the Town Center. With both sides of the road
cooperating, the road can achieve proper definition. The Town Center Master Plan was
created with the idea that the NTR Development property would continue in its present auto-
oriented state for the near term, while the other parts of the Town Center develop first. The
success of the Town Center is not doomed without the NTR Development property
participation, but the Town Center's main entrance at the intersection of Tuskawilla and S.R.
434 can achieve its greatest potential only if all four comers participate.
· Adjacent property south of the subject property consisting of29 acres is requesting
annexation into the City and inclusion in the Town Center District. The 29 acre parcel
would not be contiguous to the Town Center District if the NTR Development property is
removed from the Town Center District and therefore could not be zoned Town Center
District. Rezoning would constitute illegal spot zoning if not contiguous.
· The Town Center benefits as its size increases. The inclusion of the NTR Development
property adds many more residents, services, and places of work The more energy and
synergy that can be concentrated into the Town Center, the better for all.
RECOMMENDATION:
Staff strongly recommends that the 10 acre NTR Development property at the southwest comer
of S.R. 434 and Tuskawilla Road not be deleted from the proposed Town Center District.
