REQUEST:
The Community Development Department - Planning Division requests the City Commission
review the following infonnation regarding City Code requirements for fences, walls, buffers.
PURPOSE:
The purpose of this agenda item is to infonn the City Commission of the existing City Code
requirements for fences.
APPLICABLE LAW AND PUBLIC POLICY:
Sec. 6-190 Height Limitations generally.
All walls or fences hereafter located, erected constructed, reconstructed, or altered outside of the
established building lines shall adhere to the following heights :If front of the front building
line, no more than four (4) feet in height; if to the rear of the front building line, provided the
provisions of section 6-191 are met for comer lots, no more than eight (8) feet in height.

Sec.6-191 Limitations when adjacent to street intersection.
To avoid the obstruction of clear vision around or through comers on comer lots, no fence, wall
or hedge shall be erected, planted or grown within twenty-five (25) feet of the intersecting
property line comer adjacent to the street intersection comers. (Code 1974, 5-127)

An ordinance of the City of Winter Springs, amending Chapter 20 "Zoning", Sec. 20-239 to
20-250, Sec. 20-453 and Sec. 20-465 regatrding a wall requirement when commercially
zoned or used property abuts residentially zoned property.
SECTION IT - That Sec. 20-239 now read: A solid six (6) foot wall, constructed of concrete,
block or other durable material (wood not allowed) compatible with the surrounding area, and
acceptable to the Development Review Committee, shall be required at the time of development
or redevelopment of commercially zoned or use property to buffer residentially zoned property
from commercial activities and uses, This wall is to be constructed by the developer of the
commercially used property,
SECTION ill - That Sec. 20-453(b) be amended to read Sec. 20-453( c),
SECTION IV - That See, 20-453(b) now read: A solid six (6) foot wall, constructed of concrete,
block or other durable material (wood not allowed) compatible with the surrounding area, and
acceptable to the Development Review Committee, shall be required at the time of development
or redevelopment of commercially zoned or used property to buffer residentially zoned property
from commercial activities and uses, This wall is to be constructed by the developer of the
commercially use property.
SECTION V - That See, 20-465(b) be amended to read Sec. 20-465( c).
SECTION VI - That Sec. 20-465(b) now read: A solid, six (6) foot wall, constructed of
concrete, block or other durable material (wood not allowed) compatible with the surrounding
area, and acceptable to the Development Review Committee, shall be required at the time of
development or redevelopment of commercially zoned or used property to buffer residentially
zoned property from commercial activities and uses. This wall is to be constructed by the
developer of the commercially use property,
Sec. 20-380 Site Development standards. (per Planned Unit Development)
(14) Commercial, multi-family structures or buildings and common open spaces located at the
perimeter of the PUD shall be permanently screened by a greenbelt or buffer zone, The
greenbeltlbuffer zone shall be an area at least thirty-five (35) feet in width and of such
height and density as to protect the privacy and amenities of the adjacent areas, It may be
composed of trees, shrubs, wall or fence or a combination as approved by the City
Commission (Ord,367, 2, Art. XIV, Part B, 44,85.4,5-11-87)
(15) As deemed appropriate, the planning and zong board may recommend and the City
Commission may approve the imposition of additional restrictions not herein mentioned to
ensure the protection of the public interest.

CONSIDERATIONS:
There are no provisions in the City Code that requires a fence, wall, or special buffer
between residential zones of different densities, such as single family and multi-family.
The proposed Town Center District Code (February 3, 2000) does not have a specific
requirement for a wall, fence, or ground width buffer between different land uses or same
land uses but with differing densities/intensities. Much authority and latitute is given to
the Development Review Committee in administering the Town Center Design Code.
It should be noted that the Cross-SOOlinole Trail runs along the south boundary of the
St. Johns Landing Subdivision. The trail is one-hundred (100) feet wide with trees on
either side ofthe trail bed, It is the policy of the Office of Greenways and Trails of the
Florida Department of Community Affairs not to remove trees along the inside edge of
the trail as far as possible. The trail and trees are in fact a significant buffer that should
provide the protection to St. Johns Landing from disparate nearby land uses 100 feet
south of the subdivision,
