REQUEST:
The Community Development Department - Planning Division requests the City Commission
hold a public hearing for the first reading and consideration of Ordinance 2000-04 to expand the
S,R. 434 Corridor New Development Overlay Zoning District to include the 2,5 acre Lamoureux
property.
PURPOSE:
The purpose of this agenda item is to request the Commission hold a public hearing for the first
reading of Ordinance 2000-04 to expand the S.R. 434 Corridor New Development Orverlay
Zoning District to include the 2.5 acre Lamoureux property, The property owner has indicated
his willingness to abide by the New Development Overlay Zoning District Regulations in the
development of the property,
APPLICABLE LAW AND PUBLIC POLICY:
The provisions of 163,3167(11) F.S. which states "Each local government is encouraged to
articulate a vision of the future physical appearance and qualities of its community as a
component of its local comprehensive plan. The vision should be developed through a
collaborative planning process with meaningful public participation and shall be adopted by the
governing body ofthe jurisdiction."
In 1995 the City Commision approved the preparation fo a S.R. 434 Corridor Vision Plan that
would include a "New Development Area".

CONSIDERATIONS:
· The City Commission adopted Ordinance 670 on July 28, 1997 creating a "New
Development Area" Overlay Zoning District.
. The City Commission adopted Ordinance 675 on December 8, 1997 to institute the "New
Development Area" Overlay Zoning District Regulations (aka Design Guidelines) of the
State Road 434 Corridor Vision Plan.
FISCAL IMPACT:
None
FINDINGS:
. The City Commission at its October II, 1999 meeting expressed its desire to have the
Lamoureux property subject to the S,R. 434 Corridor "New Development Area" Overlay
Zoning District Regulations.
. The property owner agrees to abide by the S,R. 434 Corridor "New Development Area"
Overlay Zoning District Regulations,
STAFF RECOMMENDATION:
City staff recommends that the City Commission hold a public hearing for the first reading of
Ordinance 2000-04 to expand the S.R. 434 Corridor "New Development" Overlay Zoning
District to include the 2.5 acre Lamoureux property,
IMPLEMENTATION SCHEDULE:
The ordinance for expanding the S,R. 434 Corridor New Development Overlay Zoning District
would be adopted and become effective on February 28,2000.

AN ORDINANCE OF THE CITY OF WINTER SPRINGS,
SEMINOLE COUNTY, FLORIDA, REVISING SEC. 20-447 TO
EXPAND THE THE S.R. 434 CORRIDOR NEW
DEVELOPMENT OVERLA Y ZONING DISTRICT TO
INCLUDE THE LAMAOREUX PROPERTY; PURSUANT TO
166.041 FLORIDA STATUTES; PROVIDING FOR
SEVERABILITY; CONFLICTS AND AN EFFECTIVE DATE.
WHEREAS, Mr, Robert G, Lamoureux, the owner of the following described
property, had petitioned the City of Winter Springs to be annexed into the City and
said property was annexed into the City on October 25, 1999,
WHEREAS, the City Commission expressed its desire that the S,R. 434
Corridor "New Development" Overlay Zoning District be extended to include the
Lamoureux property.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF WINTER SPRINGS, SEMlNOLE COUNTY, FLORIDA, AS
FOLLOWS:
Section 1- Recitals:
The foregoing recitals are true and correct and are fully
incorporated herein by this reference.
Section 2 - Purpose and Intent:
It is hereby declared to be the purpose and
intent of this Ordinance to expand the S.R, 434 Corridor New Development Area
Overlay Zoning District to include the Lamoureux property.
That the City of Winter Springs revises See, 20-447 to extend the S.R. 434 Corridor
New Development Overlay Zoning District to include the following described real
property:
EAST ONE-HALF (1/2) OF WEST ONE-HALF
(1/2) OF NORTHWEST ONE-FOURTH
(1/4) OF NORTHEAST ONE-FOURTH
(1/4) OF SOUTHEAST ONE-FOURTH
(1/4), SECTION 4, TOWNSHlP 21 SOUTH,
RANGE 31 EAST, SUBJECT TO EASEMENT
FOR STATE ROAD 419 OVER SOUTH 30 FEET
THEREOF,
Section 3 - Repeal of Prior Inconsistent Ordinances and Resolutions: All
prior inconsistent ordinances and resolutions adopted by the City Commission, or
parts of ordinances and resolutions in conflict herewith, are hereby repealed to the
extent of the conflict.
Section 4 - Severability:
If any section, subsection sentence, clause, phrase,
word or provision of this ordinance is for any reason held invalid or unconstitutional
by any court of competent jurisdiction, whether for substantive, procedural, or any
other reason, such portion shall be deemed a separate, distinct and independent
provision, and such holding shall not affect the validity of the remaining portions of
this ordinance,
Section 5 - Effective Date:
The effective This Ordinance shall take effect
immediately upon adoption, in accordance with 166,041(4) Florida Statutes and
Section 4.15(c) of the City Charter.
