HomeMy WebLinkAbout2007 05 29 Regular 608 James Doran Company Blumberg Bouevard COMMISSION AGENDA ADD-ON ITEM 608 Consent Information Public Hearing Regular X May 29. 2007 Meeting MGR~ /Dept. 9f(/.- f/ REQUEST: The Community Development Department requests the City Commission consider the request of the James Doran Company to acquire 73 square feet of Blumberg Boulevard right-of-way to accommodate an encroachment from Building 17. PURPOSE: The purpose of this agenda item is to make the City Commission aware of an encroachment into the right-of way of Blumberg Boulevard (7" for the footer and 3" for the proposed exterior wall of the building) and to seek the Commission's direction relative to the vacation of a one (1') foot by seventy-three (73') foot portion of the Blumberg right-of-way. FINDINGS: The right-of-way encroachment was discovered during the preparation of the finished floor elevation and foundation survey. The slab is not yet poured; however, the infrastructure foundation for the elevator is in place. This infrastructure was installed prior to the above referenced foundation survey and the subsequent discovery of the encroachment. The survey was performed and submitted in accordance with City Codes. Pursuant to the Town Center code, the stoops, porches, and steps are allowed to be in the right-of-way. The building wall face was planned to be on the right-of-way line. The encroachment is a result of a minor miscalculation of the building setback on the original building foundation survey. The vacation ofthis section of right-of-way will not affect the location of any public facilities including sidewalks, utilities, or light poles. RECOMMENDATION: Staff recommends that the City Commission approve the vacation of 73 square feet of the Blumberg Boulevard right-of-way and acquisition of this vacated right-of-way by May 29, 2007 Regular Agenda Item 608 (ADD-ON) Page 2 the James Doran Company at fair market value. In addition, staff recommends the Commission give direction to staff and the City Attorney to prepare all necessary documentation to facilitate this right-of-way vacation and acquisition ATTACHMENTS: A.
