REQUEST: City Manager informing the Commission of a conference call between the City
Manager, City Attorney, Community Development Director, and Debby Parrish., Director of
O.G.T. relative to issues raised at the February 14, 2000 Commission meeting regarding trail
realignment, relocation of the trail, and encumbering FY 2000 OGT funds for acquisition of
Hickory Park and the Parker property.
PURPOSE: The purpose of this agenda item is to update the Commission regarding issues
raised at the February 14, 2000 Commission meeting by Schrimsher Properties regarding trail
realignment, trail relocation and encumbering FY 2000 OGT funds for acquisition of Hickory
Park and the Parker property.
CONSIDERA TIONS: The Office of Greenways and Trails has re-evaluated our project and
determined that OGT will no longer require adoption of the Town Center Zoning Code or
certification of the Wetland Park wetland boundary to utilize OGT funds to acquire Hickory
Park. This conclusion is based on the Commission's decision of February 14, 2000 to acquire
Wetland Park with resources other than OGT funds and the fact that the trail re-alignment as
currently designed has been approved by LAMAC.
CONDITIONS: Currently there is a limited amount of funding available to finish up the
Florida Preservation 2000 program, which will end June 30, 2000. The Hickory Park portion of
this project does fall within the area designated as eligible for negotiations in the Office of
Greenways and Trails (OGT) workplan. It is of the utmost importance that OGT have the funds
for this project encumbered prior to June 30, 2000, which means getting the parcels before the
Governor and Cabinet by the June 27th meeting. In order for OGT to present an item to the
Governor and Cabinet, the following must occur:

Acauisition parcels
1. Appraisal maps ordered (A surveying firm prepares maps for appraisal purposes,
generally identifies project and ownership boundaries, encumbrances, sovereign and
jurisdictional lands. The Bureau of Survey and Mapping must approve maps.)
2. Once Appraisal maps are complete, Appraisal is ordered (appraised by independent
fee-appraisers on the Bureau of Appraisal's approved list of appraisers).
3. When Appraisal is complete, negotiation strategy is prepared for the Division of
State Land's (DSL) approval.
4. After the Negotiation Strategy is approved, begin Negotiations with owners.
5. Once Negotiations are successful, a contract is prepared by DSL and then executed
by the seller.
6. Agenda item is prepared by DSL and OGT (this process must be started 8 weeks
prior to Cabinet date).
7. Agenda Item presented to the Governor and Cabinet sitting as the Board of
Trustees of the Internal Improvement Trust Fund.
8. Closing process begins (procure surveys, environmental audits, title insurance
policies and other necessary documents for closing the acquisition).
Trail realignment/exchange
On December 9, 1999 the proposed trail re-alignment was presented to LAMAC (Land
Acquisition & Management Advisory Council) and passed without objection. Tracey Peters of
the Bureau of Public Land Administration (BPLA) made a determination that those changes
made to the realignment subsequent to LAMAC approval do not necessitate a second review or
approval by that body, therefore, the file has been forwarded to Janice Ellison of the Bureau of
Land Acquisition, awaiting the City's role in providing OGT with the required field survey, legal
descriptions and appraisals as discussed during the December 10, 1999 meeting. Once OGT
obtains these required documents from the City, OGT may then proceed with the exchange that
will be presented to the Governor and Cabinet with a recommendation for approval.
FUNDING: Appraisals and surveys for the project would cost $28,575. The source of funds
will be appr9priations from the General Fund balance.
RECOMMENDATION: It is recommended that the City Commission advance funds for
immediate appraisals and surveys for Hickory Park in the amount of $28,575 from
appropriations from the General Fund balance.

Mr. Carrington, at his point I am aware that you have initiated items 1 and 2 and
pursuant to the Mult -Party Acquisition Agreement (MPAA) items 3 and 4 will also need
to be completed by our office. Of item 5, upon successful negotiations, contracts will be

On a final note, afte fe-evaluating the project, OGr will no longer require that the land
exchange occur prior to the land acquisition project. There is also no requirement that the
Town Center Zonin Code be adopted or that the Wetland Park wetland boundary be
certified in order for OGT to utilize funds to acquire Hickory Park. This conclusion is
based on your Corom ssion's decision of February 14,2000 to. acquire Wetland Park with
resources other than OGT funds and the fact that the trail re-alignment, as currently
designed, has been a roved by LAMAC.
