Authorization REQUEST: The Community Development Department-Code Enforcement Division requests the City Commission review infonnation concerning Golf Terrace Apartments, Phase II. PURPOSE: The purpose of this agenda item is to present information to the City Commission regarding Golf Terrace Apartments, Phase II. APPLICABLE LAW AND PUBLIC POLICY: Golf Terrace Apartments, Phase II approved plans call for a partial screening wall to be installed at intervals along the Talmo Street and Nursery Road sides of the project. These walls are approximately 6 ft. high and 60-70 feet long. They are constructed of foam board core with stucco applied as a coating. Their purpose is to prevent headlights from cars in the apartment parking lots shining in the homes across the street on Talmo Street and Nursery Road. CONSIDERA TIONS: Complaints have been received from a resident along Talmo Street regarding the possibility of future noise and light problems from the apartments. The complainant is asking the City to require the contractor to construct a concrete block wall between the parking area and his home. Staff estimates that 250 ft. of additional wall would need to be constructed along Talmo Street. The cost to install a similar foam core wall would be approximately $6,000.00. Golf Terrace's plans were approved in 1984. The plans are consistent with current city codes. As such, there does not appear to be anything the City can do to make the contractor construct the wall. FEBRUARY 14,2000 CONSENT AGENDA ITEM C Page 2 However, the contractor has recently paid a $5,000.00 fine for improper cutting of trees. The City could offer to forgive the $5,000.00 fine if the contractor and owner would be willing to extend the fence the length of the parking lot on Talmo Street. STAFF RECOMMENDATION: Staff recommends the City Commission offer to forgive the $5,000.00 fine levied against Reed Contractors if they will agree to extend the fence along the parking lot located on Talmo Street. I have attended two of the City meetings and voiced my concern over the manner which the parking area and my home are separated. In other areas on Talmo Street they built a so call wall in areas where parking lots would face the other homes and in the area behind the apartments they are to landscaped mounds. The so call walls are only mesh wire covered by stucco. The kids throwing balls will put holes in them because of the lack of strength. My home at 1070 is located in an area that on the plans was shown as heavy wooded. Because of this heavy woodea- marking the City Zoning Department did not make the contractor included this area in the tree count, therefore they have taken out all but one row of scrub oak trees that will not shield any light or noise from my home. I am requesting that the City of Winter Springs require the contractor to build a concert block wall between the parking area and my home. It is the lack of control and follow-up by the Zoning Department that allowed the contractor get away with some much on this project. The zoning department was given pictures and a letter several months ago and not one response have I had from them. I understand that the city stands to increase its tax role with the new apartments but it should not be at my expense. With the parking as it is today I will have lights shining directly into my home every night and at all hours. .... . . . I would very much like a response from someone within the city that will open his or her eyes to the homeowners and not just to big business. I do feel that the city is responsible for this problem and should take steps to correct the mistake of the Zoning Department.
