REQUEST:
The Community Development Department-Code Enforcement Division requests
the City Commission holds a public hearing for the second reading of Ordinance
No. 2000-02 providing for the maintenance of fences and walls.
PURPOSE:
The purpose of this agenda item is to hold a public hearing for the second reading of Ordinance
No.2000-02 dealing with fence maintenance.
APPLICABLE LAW AND PUBLIC POLICY:
Current regulations require a permit for installation of a fence, but there is no requirement to
maintain the fence in good order. In 1998 this issue came before the Commission and direction
was given to the acting city attorney to draft appropriate legislation. On January 24,2000 the
City Commission approved the first reading of Ordinance of 2000-02.
ST AFF RECOMMENDATION:
Staff recommends the City Commission hold a public hearing for the second reading of
Ordinance No. 2000-02 and schedule a public hearing for the second reading on February 14,
2000.

ORDINANCE NO. 2000-02
AN ORDINANCE OF THE CITY
COMMISSION OF THE CITY OF WINTER
SPRINGS, FLORIDA, DEALING WITH
FENCE MAINTENANCE , PROVIDING FOR
CONFLICTS, SEVERABILITY AND AN
EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Winter Springs, Florida,
recognizes the need for neighborhoods to protect property values, and
WHEREAS, the upkeep of structures is a valuable tool in maintaining
property values,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF WINTER SPRINGS, FLORIDA, AS
FOLLOWS:
SECTION I -
Fences must be maintained in good order, by including but
not limiting to replacing missing sections, repairing gates to correct alif,1fiment and
insuring that closing mechanisms are working properly.
SECTION II -
Conflicts. All Ordinances in contlict with the provisions of
tins Ordinance are hereby superceded and this Ordinance shall prevail.
SECTION III-
Severability. If any words, phrase, sentence or portion of
tIus Ordinan~e is stricken by a Florida Court of competent jmisdiction, all other
tenns and conditions of tile Ordinance not specifically stricken shall remain in full
force and effect.
SECTION IV-
Effective Date. This Ordinance shall become effective upon
its passage.
