Authorization REQUEST: City Manager updating the Commission on the status of the relocation of the Cross Seminole Trail in the Town Center, and Office of Greenway and Trails $4,988,000 appropriation grant to purchase greenspaces in the Town Center and to request direction. PURPOSE: The purpose of this agenda item is to bring the Commission up to date on these two Town Center projects and to ask direction relative to the most appropriate direction the City should follow. On October 9, 1998 the Florida Office of Greenways and Trails approved a $4,988, 000 appropriation grant and ranked the City 6th out of 25 approved applicants. The Office of Greenspaces and Trails had at the time of the grant approved $17.5 million dollars available to be awarded among the approved applicants on a first come first serve basis. Approval of the grant was contingent upon two conditions: 1) Adoption of the Town Center Code 2) Relocation of the Cross Seminole County Trail within the Town Center. Adoption of the Town Center Code: Adoption of the Town Center Code has been stalled since November 9,1998 due to disputes with Schrimsher Properties and threats of litigation from Schrimsher Properties relative to the City adopting the code. Trail Relocation: Relocation of the Trail has been delayed due to changes of state operation rules and untimely submission of the application by the County which resulted in the operation not being submitted by the County until August 6, 1999. The City was originally invited by a.G.T. to submit the application for relocation. The City acting in an expedited mode submitted the relocation application on April 2, 1998. The County objected to the City being the applicant and prevailed upon a.G.T. to change the rules providing for the County to be the applicant. On September 23, 1998, a.G.T. informed the City that it would not City of Winter Springs February 14, 2000 Regular Agenda Item "D" Page 2 of 4 process the application and that the County would have to be the applicant. As stated, the County did not complete the application until August 6, 1999. O.G.T. staff approved the application in September 16, 1999. The Bureau of Land Management approved the application in November 10,1999. The Land Acquisition Management Council approved the application on December 9, 1999 authorizing it to go before the Governor and Cabinet for final approval. Final approval of the relocation of the Trail will not be considered by the Governor and Cabinet until a survey and appraisal of the property involved is completed according to State rules. Neither the appraisal nor the survey can be initiated until such time that a new wedand determination is made on the Schrimsher Properties. The previous wedand determination expired on December 1, 1999. In conclusion, in order to utilize O.G.T. funds to acquire Town Center Greenspaces approved for funding by O.G.T. in October 1998, the following would have to happen: 1) The City must adopt the Town Center District Code. 2) The revised wedand determination of the Schrimsher Property must be completed. 3) Subsequent to the completion of the updated wedand determination and the survey and appraisals of the Trail property located on the Schrimsher Property, the application can be forwarded to the Governor and Cabinet for consideration. 4) Cabinet aids set aside eight (8) weeks for administrative review prior to placing a trail relocation application on the Cabinet Agenda. 5) If the Governor and Cabinet approve the relocation of the Trail then and only then will O.G.T. release funds to acquire Greenspaces to enhance the trail and Town Center. At this time the O.G.T. funds have been spent down from $17.5 million to $5 million. Relatedly, O.G.T. had advised that we apply only for Hickory Park. To secure funds for Hickory Park in the current year, the City would need to complete appraisal and surveys of the property at a cost of approximately $28,500 immediately. However, as stated, even if the funds are encumbered, they cannot be authorized until the City adopts the Town Center Code and the Governor and Cabinet approves the trail relocation. Costs for the trail relocation appraisals, surveys, and wedand boundary update will be $45,125. The City can reapply in this and future years, for funds to acquire Town Center Greenspaces under a new state program en tided "Florida Forever". Should the City move forward with $45,125 in expenses to relocate the Cross Seminole Trail within the Town Center? 2. Should the City move forward with $28,500 in expenses to secure funding for Hickory Park in this year's budget? DUSCUSSION: 1) If the City and Schrimsher can agree to adoption of the Town Center Code on February 14, 2000, it is difficult but possible to get the approvals, survey, and the wedand determination completed and submitted in time to get the funds for Hickory Park committed for this year, and the application for Trail relocation before the Governor and Cabinet for consideration in May. 2) If the City delays adoption of the Town Center Code beyond February 14,2000 in order to continue negotiations with Schrimsher it is doubtful that funds could be increased for Hickory Park in this year. 3) If the City adopts the Town Center Code on February 14,2000, and Schrimsher litigates there is obviously no possibility in having funds secured for Hickory Park or consideration of the trail relocation by the Governor and Cabinet this year. RECOMMENDATION: In consideration of the status of the Town Center property and the Trail relocation staff's recommendation is as follows: 1. That no further action be taken until such time that: a) The Town Center District Code is law. b) Schrimsher Properties completes the update of the wedand determination. 2. Upon completion of the above, the staff would recommend proceeding with the surveys and appraisals necessary to relocate the trail. 3. Upon approval of the Governor and Cabinet to relocate the Trail, completion and submission of a new application under the Florida Forever program for funds to acquire Town Center Greenspace properties to enhance the trail.
