REQUEST: Community Development Department, Land Development Division, presents to
the Commission for action on the request of Design Service Group (agent for
UNICORP National Development, Inc.) to split a platted lot into no more than
two (2) lots (Resolution No. 2000-02)
PURPOSE: The purpose of this agenda item is to present to the Commission for their action on
the request of Design Service Group (agent for UNICORP National Development,
Inc.) to split a platted lot into no more than two (2) lots (Resolution No. 2000-02)
The property is located on the northwest corner of the intersection of SR 434 and
SR 419 and is to be the future site of the proposed Eckerd Drug Store.
APPLICABLE CODE:
Sec. 9-3. Dividing platted property.
An owner of a single lot of sufficient size, except in a platted area of a
planned unit development, may, with prior approval of the city commission, divide
an originally platted single lot once into no more than two (2) parcels or lots. An
owner of a lot which has been divided shall not be granted approval for a replat
which would result in dividing the originally platted single lot into more than two
(2) parcels or lots. Each parcel or lot so divided shall in every respect meet the
criteria established elsewhere in the Code for the category of zoning and other
relevant Codes under which the property is zoned and each parcel or lot shall meet

the engineering requirements set out elsewhere in this chapter. In such instance,
and only within the strict application of this section, may the full provisions of this
chapter be waived and variances granted thereto. No building permit shall be
issued for the erection of any building on a previously platted lot which is divided
contrary to this section.
FINDINGS: 1) The developer has stated that the closing date on this property is January 31,
2000, and the owner of the property insists on the lot split being approved by this
date.
2) The effective date of this Resolution is contingent upon the recordation of a
deed in the Public Records of Seminole County, Florida, which evidences that the
current property owner has conveyed Lot 3I-A to ECK Winter Springs, 9, Inc.,
within sixty (60) days from the date the City Commission approves Resolution No.
2000-02. If said recordation does not occur within said time period, this
Resolution shall be deemed null and void and given no effect.
3) The applicant is seeking such division of property of sufficient size.
4) The property is not located in an approved Planned Unit Development platted
area.
5) The platted lot to be divided has not been previously divided pursuant to
Section 9-3 of the Code.
6) The platted lot to be divided shall be divided into no more than two (2) parcels
or lots, and that each parcel or lot shall in every respect meet the established
criteria requirements in the category of zoning under which the property is zoned.
7) The property is zoned C-I (Neighborhood Commercial) and has a future land
use designation of Commercial.
8) The legal description of the property is: Lot 31, Entzminger Farms Addition
No.2, Plat Book 5, Page 9, Public Records of Seminole County, Florida.

RECOMMENDA TION:
It is recommended that the Commission approve Resolution No. 2000-02
approving a lot split of Lot 31, Entzminger Farms Addition No.2, Plat Book 5,
Page 9, Public Records of Seminole County, Florida with the following caveat:
The effective date of this Resolution is contingent upon the recordation of a
deed in the Public Records of Seminole County, Florida, which evidences
that the current property owner has conveyed Lot 31-A to ECK Winter
Springs 9, Inc., within sixty (60) days from the date the City Commission
approves Resolution No. 2000-02. If said recordation does not occur within
said time period, this Resolution shall be deemed null and void and given no
effect.

To Whom It May Concern:
This letter does authorize Design Service Group, Inc. to act as the agent for
Unicorp National Developments, Inc. for all permitting processes with all
regulatory agencies, departments and their personnel of Seminole County, the
City of Winter Springs, St. Johns River Water Management District, South
Florida Water Management District, Florida Power, Florida Department of
Transportati on and the Flori da Department of Envi ronmenta 1 Protecti on, in an
effort to receive all approvals necessary for the construction and
development of the Eckerd Drug project located at the corner of SR 434 and
CR 419, Seminole County, Florida.

RESOLUTION NO. 2000-02
A RESOLUTION OF THE CITY OF WINTER SPRINGS, FLORIDA
PROVIDING FOR THE DIVISION OF ONE (1) ORIGINALLY PLATTED
LOT HEREINAFTER DESCRIBED, ONCE, INTO NO MORE THAN
TWO (2) PARCELS OR LOTS, PURSUANT TO SECTION 9-3 OF THE
WINTER SPRINGS CODE OF ORDINANCES ENTITLED "DIVIDING
PLA TTED PROPERTY, CONFLICTS AND EFFECTIVE DATE.
WHEREAS, Section 9-3 of the City Code of Winter Springs, Florida, allows an
owner of a lot of sufficient size, except in an approved Planned Unit Development platted area,
with the prior approval of the City Commission, to divide an originally platted lot once, into no
more than two (2) parcels or lots, provided that each parcel or lot shall in every respect meet the
criteria established elsewhere in this Code for the category of zoning under which the property is
zoned; and '
WHEREAS, the applicant, Design Service Group (on behalf ofUnicorp National
Developments, Inc.), have made application to the City Commission for the following property
to be divided pursuant to Section 9-3 :'-
Lot 31, Entzminger Farms Addition No.2, Plat Book 5, Page 9, of the Public
Records of Seminole County, Florida.
WHEREAS, the City Commission was informed that:

1. The applicant is seeking such division of property of sufficient size;
2. The property in question is not located in an approved Planned Unit
Development platted area;
3. The platted lot to be divided had not been previously divided pursuant to
Section 9-3; and,
4. The platted lot to be divided shall be divided into no more than two (2) parcels
or lots, and that each parcel or lot shall in every respect meet the established
criteria requirements in the category of zoning under which the property is zoned.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF WINTER
SPRINGS, FLORIDA, AS FOLLOWS:
SECTION I - That the division of the originally platted property is approved in
accordance with Section 9-3 as follows:

a) The originally platted property to be divided is described as:
Lot 31, Entzminger Farms Addition No.2, Plat Book 5, Page 9, Public
Records of Seminole County, Florida.
b) The two (2) lots or parcels formed by this action are described as:
Lot 31-A (eastern portion of Lot 31) and Lot 3I-B (remaining western
portion of Lot 31) as depicted in Appendices "A" and "B".
SECTION II - This Resolution shall remain in effect until supplemented,
amended, repealed or otherwise altered.
SECTION III - All resolutions or parts of resolutions in conflict with this
Resolution are hereby repealed.
SECTION IV - The effective date of this Resolution is contingent upon the
recordation of a deed in the Public Records of Seminole County, Florida, which evidences that
the current property owner has conveyed Lot 3I-A to ECK Winter Springs, 9, Inc., within sixty
(60) days from the date the City Commission approves this Resolution. If said recordation does
not occur within said time period, this Resolution shall be deemed null and void and given no
effect.
