Authorization REQUEST: The City Attorney is requesting that the City Commission consider the first Reading of Ordinance Number 2000-01, which staggers the term of Members of the Board of Trustees - Pension Plan ("Board of Trustees"). PURPOSE: The purpose of this Agenda Item is to amend Section 14-52 of the City of Winter Springs' Code of Ordinances, by staggering the terms of the Board of Trustees. CONSIDERATIONS: At the December 13, 1999 City Commission Meeting, the City Commission directed the City Attorney, Mr. Anthony Garganese, Esquire to prepare an Ordinance which staggers the terms of the members of the Board of Trustees. The City Attorney has revised Section 14-52 of the City of Winter Springs' Code of Ordinances, by staggering the terms for members of the Board of Trustees. FUNDING: None Required. COMMISSION ACTION: ATTACHMENT " A" ORDINANCE NO. 2000-01 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, FLORIDA AMENDING THE CITY OF WINTER SPRINGS CODE OF ORDINANCES, SECTION 14-52 (a) FOR PURPOSES OF STAGGERING THE TERMS OF THE BOARD OF TRUSTEES OF THE PENSION PLAN FOR THE EMPLOYEES OF THE CITY OF WINTER SPRINGS, FLORIDA; PROVIDING FOR THE REPEAL OF PRIOR INCONSISTENT ORDINANCES AND RESOLUTIONS; PROVIDING FOR INCORPORATION INTO THE CODE; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, pursuant to Section 14-52 (a) of the City of Winter Springs Code, the existing terms of the five member board of trustees of The Pension Plan For The Employees of The City of Winter Springs, Florida ("Plan") all expire at the same time; and WHEREAS, the City Commission of the City of Winter Springs, Florida deems it is in the best interests of the administration and oversight of the Plan to reconfigure the terms of the board of trustees by staggering the terms of the board members so that they all do not expire at the same time, thereby, ensuring the presence of experienced trustees on the board by avoiding the possibility the City Commission would have to appoint an entirely new board of trustees every three years when the terms expire; and WHEREAS, the City Commission hereby finds that this ordinance is in the best interests of the public health, safety, and welfare of the citizens of Winter Springs, Florida. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, SEMINOLE COUNTY, FLORIDA, AS FOLLOWS: Section 1. Winter Springs Code Section 14-52 is hereby amended as follows: (underlined type indicates additions and stIikeout type indicates deletions, while asterisks (* * *) indicate a deletion from the Ordinance of text existing in Section 14-52. It is intended that the text in Section 14-52 denoted by the asterisks and set forth in this Ordinance shall remain unchanged from the language existing prior to adoption of this Ordinance). Sec. 14-52. Board of trustees. (a) There is hereby created and established a board of trustees consisting offive (5) members who shall be appointed for a term of City of Winter Springs Ordinance No. 2000-01 Page 1 of 3 three (3) years by resolution of the city commission. The board member seats shall be designated as seat #1 through seat #5, respectively. Each commissioner shall have one ~ appointment to the board which shall coincide with the city commissioner's district number. The terms of the board members shall be staggered: thus, as of the effective date of this section, the initial term of each shall expire as follows: Seats # 1, 3, and 5 - 2003 Seats # 2 and 4 - 2002 The successors of the original appointees shal.l be appoihted fOI tel IUS oftluee (3) yeaH by resolution of the city commission. Vacancies in on the board shall be filled by the city commission for the unexpired terms of such vacancy. The city commission, by majority vote, shall have the right to make any appointment hereupder in the event the city commissioner responsible for making an appointment fails or is unable to make an appointment within a reasonable period of time after a term has expired or a vacancy has occurred. * * * Section 2. Repeal of Prior Inconsistent Ordinances and Resolutions. All prior inconsistent ordinances and resolutions adopted by the City Commission, or parts of ordinances and resolutions in conflict herewith, are hereby repealed to the extent of the conflict. Section 3. Incorporation Into Code. This ordinance shall be incorporated into the Code of Ordinance of the City of Winter Springs and any section or paragraph number or letter and any heading may be changed or modified as necessary to effectuate the foregoing. Section 4. Severability. Ifany section, subsection, sentence, clause, phrase, word or provision of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, whether for substantive, procedural, or any other reason, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions of this ordinance. Section 5. Effective Date. This Ordinance shall become effective immediately upon adoption by the City Commission of the City of Winter Springs, Florida.
