REQUEST: The Public Works Department requests the City Commission validate the staff recommendation fmding JDC Town Center Phase I Expansion (Buildings 3,4, and 16) to be built in substantial accordance with the Final Engineering plans PURPOSE: The purpose of this Agenda Item is to request the City Commission validate the staff recommendation finding JDC Town Center Phase I Expansion (Buildings 3, 4, and 16) to be built in substantial accordance with the Final Engineering plans per Section 9-178 in order for Certificates of Occupancy to be issued. The site is located at the northwest comer of Tuskawilla Road and Tree Swallow Drive in the Winter Springs Town Center. APPLICABLE CODE: Section 9-178. Required Improvements to be completed prior to building on lots; exceptions. (c) Where the building official has an authoritative method of assurance that the improvements will be completed in accordance with approved plans, such as withholding occupancy, the building official may issue building permits upon advising the developer that all or partial occupancy will be restricted until satisfactory completion of the improvements has be accomplished. (d) ... Certificates of occupancy will not be issued until all improvements are accepted by the city commission. FINDINGS: 1) The site has been constructed in substantial accordance with the Final Engineering plans approved by the City Commission at the January 24, 2005 City Commission meeting, 021207_ COMM _ Consent_ 400_ IDC Phase I Expansion_Acceptance February 12,2007 Consent Agenda Item 400 Page 2 and amendments approved at the April 25, 2005 and September 26, 2005 Commission meetings. 2) All City agencies have found the work to be acceptable, except as noted below in the recommended conditions of approval. RECOMMENDED CONDITIONS OF APPROVAL: 1) The following items must be complete prior to issuance of any Certificate of Completion for any building: a. Complete sidewalk and ramp at the roundabout north of Building 16 b. Complete installation of the hose bibb and meter at the dumpster c. Repair damaged sidewalk on Blumberg Boulevard d. Repair damaged curbing along the south side of Building 16 along the new parking area e. Provide sketches and legal descriptions for all utility easements f. Provide a cost breakdown to support the bill of sale g. Provide a 10%, 2-year maintenance bond or letter of credit for the utilities dedicated to the City h. Submit record drawings acceptable to the City 2) The wall and sidewalk required along the north property boundary have not been constructed due to the ongoing construction at the Building 4 and Building 17 sites. JDC has provided a letter of credit to ensure that these items will be constructed. Staff recommends requiring completion of these items prior to issuance of a Certificate of Completion for Building 4. The wall between Building 4 and the Kingsbury property to the north shall be a steel fence with brick columns, as depicted on the aesthetic review rendering approved as a part of Building 17 at the August 28,2006 Commission meeting (copy of wall rendering is attached as Exhibit I). 3) The sidewalk along the south side of Building 3 must be complete prior to any Certificate of Occupancy being issued for Buildings 3, 4, or 16. 4) The conversion of parking from angled to parallel in front of Building 3 shall be completed prior to any Certificate of Occupancy being issued for Building 3. RECOMMENDATION: Staff recommends that the City Commission validate the staff recommendation finding JDC Town Center Phase I Expansion to be built in substantial accordance with the Final Engineering plans, subject to the above-listed recommended conditions of approval. IMPLEMENTATION: 021207_ COMM _ Consent_ 400_ IDC Phase I Expansion_Acceptance February 12, 2007 Consent Agenda Item 400 Page 2 Certificates of Occupancy can be issued after Commission approval and verification that all applicable conditions have been met.
