Authorization REQUEST: The Parks and Recreation Department is requesting that the City Commission approve Resolution 2008-55, increasing Fees and establishing new fees to be paid by individuals or groups for use of City Facilities and Program participation. PURPOSE: The purpose of this item is to receive Commission approval for Resolution #2008- 55 which establishes new fees and charges for use of City Facilities and Program participation. CONSIDERATIONS: At the November 24, 2008 meeting, the City Commission reviewed the proposed new fees and charges recommended by Parks and Recreation. The Commission recommended a change in the Splash Playground fee. Staff recommends the following: o Those who register prior to Apri130, 2008: ^ Seminole County Resident: 1St Person - $10 Per Season 2°d and any additional - $5 Per Season o Those who register after Apri130, 2008: ^ Seminole County Resident: 1St Person - $15 Per Season 2°d Person - $10 Per Season 3`d and any additional - $5 Per Person, Per Season • The cost to provide Parks and Recreation Programs and Facilities has increased and continues to increase for supervision, utilities and maintenance. • The amount of General Fund dollars available to provide Parks and Recreation funding may be less in the near future. • All fees and charges that have been charged for most Parks and Recreation Programs and Facilities were increased last year. • Parks and Recreation 2008/2009 Athletic budget, Splash Playground, and Senior Center budgets were approved with the intent of increasing fees to cover more or all costs. • The proposed fees are in line with other Governmental Agencies. • The Parks and Recreation Department has a scholarship program for any resident who is needy and cannot afford to participate in a program or use a facility. Scholarship dollars are budgeted each year and also private individuals and organizations donate funding for scholarships. Agenda Item Consent 203 December 8, 2008 Page 2 • Parks and Recreation collection of the proposed fees can be done without hiring additional staffing. • Parks and Recreation also recommends an Implementation Schedule beginning January 1, 2009. This allows the department the opportunity to notify users of coming fees and increases. • Winter Springs Parks and Recreation Proposed Fee Increases and New Fees Chart is attached. • Staff also reviewed the current scholarship application and prices and believes it is simple and not demeaning or invasive. FUNDING: None Required. RECOMMENDATIONS: The Parks and Recreation Department recommends approval of Resolution #2008-55 establishing new fees and charges for use of City Facilities and Program Participation. WHEREAS, the City is granted the authority, under Section 2(b), Article VIII, of the State Constitution, to exercise any power for municipal purposes, except when expressly prohibited by law; and WHEREAS, the City Commission has the authority to establish fees pursuant to section 166.201, Florida Statutes; and WHEREAS, the City Commission finds it necessary to periodically review its fee schedules pertaining to facility uses and activities within the City; and WHEREAS, the City Commission desires to revise and amend certain fees as set forth in this Resolution; and WHEREAS, the City Commission of the City of Winter Springs fords that this Resolution is in the best interests of the public health, safety, and welfare of the citizens of Winter Springs. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, SEMINOLE COUNTY, FLORIDA, AS FOLLOWS: Section 1. Recitals. The foregoing recitals are deemed true and correct and are hereby fully incorporated herein by this reference. Section 2. Fees Established. The City Commission hereby adopts the fee schedule set forth in Exhibit "A," attached hereto and fully incorporated herein by this reference. The fees set forth in Exhibit "A" shall be effective January 1, 2009. Section 3. Repeal of Prior Inconsistent Resolutions. All prior inconsistent resolutions adopted by the City Commission, or parts of prior resolutions in conflict herewith, are hereby repealed to the extent of the conflict. Section 4. Severability. If any section, subsection, sentence, clause, phrase, word, or portion City of Winter Springs Resolution No. 2008-55 Page 1 of 2 of this resolution is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereto. Section 5. Effective date. This Resolution shall become effective on January 1, 2009. In order to provide all members of the community with an equal opportunity to take advantage of our services, the City of Winter Springs Parks and Recreation Department has a limited amount of financial assistance available. Individuals and families who are unable to pay for the full cost of a City of Winter Springs Parks and Recreation program fee may apply for a reduced rate and may be awarded partial financial assistance based on their demonstrated need. ELIGIBILTY 1) Financial assistance will be granted on the basis of financial need. The family income guidelines used by the Parks and Recreation Department will be a verification of any assistance you currently receive that is for low and moderate income families. 2) Financial assistance will be reviewed for eligibility, for each program period (requests must be made for each individual program) 3) The entire Financial Assistance Application MUST BE FILLED OUT COMPLETELY to be considered. 4) Financial assistance is not guaranteed on an ongoing basis and MUST be reapplied for before each additional/new program. All current and correct paperwork must be submitted every year. HOW TO APPLY 1) Applicants must complete all Financial Assistance Application forms as well as the standard Parks and Recreation program forms. Your application will not be forwarded for approval without above paperwork 2) If possible, the Program Supervisor will meet with you when you present the required documentation. If not, you may be called to discuss the request. 3) Application processing time is typically 5 to 10 working days after all required information has been received. 4) Financial assistance eligibility will be based on verification of any assistance you currently receive that is for low and moderate income families and an interview with the applicant. The Parks and Recreation Department reserves the right to deny any or all assistance to any applicant. If any section, subsection, sentence, clause, phrase, word, or portion City of Winter Springs Resolution No. ?008-55 Page 1 of 2 of this resolution is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereto.
