COMMISSION AGENDA ITEM 200 CONSENT X INFORMATIONAL PUBLIC HEARING REGULAR October 13,2008 Meeting MGR~ IDEPT ~~) .,-.-" Authorization REQUEST: The Finance Department is requesting authorization from the City Commission to extend the City's current contract with Severn Trent Environmental Services, Inc. to read City water meters for the contract period October 1, 2008 to September 30, 2009. PURPOSE: The purpose of this Agenda item is to request authorization to extend the City's current meter reading contract for Fiscal Year 2008-2009. CONSIDERA nONS: On July 29, 2008 Consent Item # 204 was approved by the City Commission which authorized the City to piggyback off of the City of Mount Dora, Florida's contract with Severn Trent Environmental Services, Inc. for contract meter-reading services. Due to the timing differences between the City of Winter Springs' contract period (August 2007 to July 2008) and Mount Dora's contract period (October 2007 to September 2008), the initial authorization period was for the months of August and September 2008 only as the contract pricing for October 1, 2008 to September 30, 2009 had not been calculated and presented to the City of Mount Dora. Per Section 9.5 of the City of Mount Dora's contract, annual pricing shall be increased by the lesser of 4% or the Consumer Price Index for all Urban Consumers (CPI-U) each October 1. The new contract pricing has been presented to the City of Winter Springs with a CPI-U index of 4% increase (see attached). FUNDING: Funding is payable from the Utility Billing Division of the Finance Department (in the General Fund 1360-53188) at a cost of $0.71 cents per manual-read meter, $0.61 per touch- read meter and $0.61 per remote-read meter, which is an decrease of 1.5% over FY 2007-2008 contract pricing as all of our meters are manually read. The General Fund will be reimbursed by the Water and Sewer Utility Fund for 100% of the fees charged. The contract will be for approximately $131,855 per year, based on our current customer count. Consent Agenda Item 200 October 13,2008 Page 2 of2 RECOMMENDATION: It is recommended authorization be granted to extend the City's contract with Severn Trent Environmental Services, Inc. to read City water meters for the contract period October 1, 2008 to September 30, 2009 at the following price structure: $0.71 cents per manual-read meter, $0.61 per touch-read meter and $0.61 per remote-read meter. In August of 2008, the City of Winter Springs elected to piggyback off of the City of Mt. Dora Meter Reading Services Agreement with Severn Trent Environmental Services. According to the Agreement, Section 1.1 allows for annual extensions providing both sides agree, in writing. At this time, Severn Trent would like to offer a one (1) year extension, effective October 1, 2008 through September 30,2009. Section 9.5 of our agreement allows for a CPI increase on contract extensions. The annual CPI increase for July 2008 (see attached CPI statistics) was 4%, bringing the radio read rate from $0.583 to $0.61 and the manual read rate from $0.686 to $0.71 effective October 1, 2008. All terms and conditions of the Agreement will remain the same. At this time, Severn Trent is not requesting the City approve an additional increase in the per meter rate due to rising fuel costs. However, if fuel prices fluctuate upwards significantly, we may request a renegotiation of this cost. If you are in agreement with the above, please sign the two originals of this letter to confirm our agreement, return one to my office by September 26, 2008 and retain one for your records. Enclosed is a self-addressed stamped envelope for your convenience. We look forward to continuing to work with you. WITNESSETH: WHEREAS, the City and Contractor entered into an Agreement for Meter Reading Services dated August 1, 2008 ("Agreement"); and WHEREAS, pursuant to section 2.1 of the Agreement, the parties desire to extend the term of the Agreement for an additional one-year term commencing on October 1, 2008; and WHEREAS, pursuant to section 9.5 of Exhibit "A" to the Agreement, Contractor may increase its fees on an annual basis; and WHEREAS, Contractor proposes to increase its meter reading fees by four percent (4%); and WHEREAS, the parties hereto desire to set forth their mutual understanding ofthe modified terms and conditions of the Agreement as set forth herein. NOW THEREFORE, in consideration of the mutual covenants and conditions contained herein and for other valuable consideration, the receipt and sufficiency of which is acknowledged by the parties hereto, the parties agree as follows: 1.0 Recitals. The foregoing recitals are true and correct and are hereby incorporated herein by this reference as a material part of this Agreement. 2.0 Term. The term of the Agreement shall be extended for one (1) year, commencing on October 1, 2008 and terminating on September 30, 2009. 3.0 Payment. City and Contractor agree that the City shall pay Contractor for each meter read at the following rates: Radio Read $0.61 each Touch Read $0.61 each Manual Read $0.71 each 4.0 Other terms. Any other term or condition of the Agreement not expressly modified by this Addendum shall remain in full force and effect.
