River Water Management District Solary Canal Stormwater Treatment Area COMMISSION AGENDA ITEM 601 Consent Information Public Hearing Regular X September 22, 2008 MGR /DEPT / Meeting REQUEST: The Public Works Department requests the City Commission review and approve the Combined Preliminary and Final Engineering/Site Plan for the proposed St. Johns River Water Management District Solary Canal Stormwater Treatment Area on approximately 28.9 acres, located on the east side of DeLeon Street in the City of Winter Springs. PURPOSE: To review the Combined Preliminary and Final Engineering/Site Plan for the proposed St. Johns River Water Management District Solary Canal Stormwater Treatment Area. APPLICABLE LAW AND PUBLIC POLICY: City Code Chapter 5 - Tree Protection and Preservation City Code Chapter 9 - Land Development City Code Chapter 20 - Zoning LAND USE AND ZONING DESIGNATION: Future Land Use Designation: Public / Semi - Public Zoning: Existing Zoning District: Seminole County A -3 Agricultural Proposed Zoning District: Winter Springs R -Cl Single Family Dwelling District (minimum one -acre lot size) with a proposed Conditional Use Permit for public facility use. Please refer to Commission agenda item #504 for the proposed zoning change (Ordinance # 2008 -12). CHRONOLOGY: Nov. 27, 2000 - Annexation of Subject Property (Ordinance 2000 -40). Seminole County and the City of Oviedo formally objected to the annexation. Rezoning was never adopted. January 2005 - Purchase of Property by SJRWMD from Tom Minter. Aug. 21, 2008 - Public Noticing in Orlando Sentinel of LPA Public Hearing Sept. 3, 2008 - P &Z held a Public Hearing and made recommendation to Adopt Ord. 2008- 12 Sept. 4, 2008 - BOA held a Public Hearing and made recommendation to Approve the Conditional Use request PROJECT OVERVIEW: The St. Johns River Water Management District (SJRWMD) is proposing a Stormwater Treatment Area at 1900 DeLeon Street in the northeast corner of the City of Winter Springs to improve the water quality of Solary Canal prior to its discharge into Lake Jesup. Solary Canal is an existing regional drainage channel located primarily within the City of Oviedo with the exception of the northern -most portion of the canal adjacent to Lake Jesup, which is in the City of Winter Springs. SJRWMD purchased property in the City of Winter Springs for a Stormwater Treatment Area to treat the flow from Solary Canal prior to discharging into Lake Jesup. The property, known as the Minter Tract, is located on the west side of DeLeon Street in the City of Winter Springs (see Exhibit A — Project Location Map). The property is approximately 28.9 acres and in Section 3, Township 21 South and Range 31 East. The existing undeveloped property contains mature oak canopy, a citrus grove, and pastureland. Solary Canal enters the property from the southeast property line and exits the property to the north. The contributing drainage area upstream of this property is approximately 1,471 acres. Solary Canal's drainage area is highly developed. Land uses within the drainage area include residential, commercial, industrial, agriculture, wetlands and uplands. Historically, Solary Canal and Lake Jesup have been plagued by water quality and flooding problems. Lake Jesup has been verified by the Florida Department of Environmental Protection (FDEP) as impaired for nutrients and unionized ammonia due to elevated annual average Trophic State Index (TSI) values and exceedances of the unionized ammonia criterion. FDEP formally adopted a Total Maximum Daily Load (TMDL) report for Lake Jesup in April 2006. The TMDL report identified the nutrient loading sources and required reductions to meet water quality standards for total phosphorous (TP) and total nitrogen (TN) within the Lake Jesup Basin. STORMWATER TREATMENT AREA DESIGN SUMMARY: The primary objective of the Stormwater Treatment Area is to reduce phosphorus and suspended solids loadings from Solary Canal prior to discharging into Lake Jesup. A secondary design objective is for the treatment system to limit the change in upstream and downstream flood elevations to less than 0.02 feet for the 25- and 100 -year design storms. There is no land development associated with this project; therefore, there are no requirements to meet a pre- and post- development quantity or quality criteria. This is September 22, 2008 Regular Agenda Item #601 Page 3 of 4 strictly a water quality improvement project that will not increase the flood levels under existing or expected future conditions. The Stormwater Treatment Area is an off -line system comprised of a manmade wet pond and wetland connected in series. All of the canal normal base flow and a large fraction of the storm flow is diverted into an 8 -acre wet pond. Flow from the wet pond discharges into a 4.8 -acre wetland through a control structure and overflow weir. Flow from the wetland discharges through a second control structure and overflow weir back into the canal near the north property line. High storm flows are allowed to bypass the pond over a diversion weir and continue through Solary Canal. Pollutant loads in the canal's base flow and storm flow are first reduced in the wet pond and then reduced further (for most parameters) in the wetland. In addition, the wet pond and wetland system provide over 67 acre -feet of storage. WETLAND IMPACTS: An informal wetland delineation was performed by SJRWMD's design consultant, CH2M HILL, in March 2007. The delineation revealed wetland vegetation along the entire length of Solary Canal totaling approximately 0.56 acres. In addition to the canal wetlands, three small, isolated, low quality wetlands within the existing pasture totaling 0.26 acres were identified. The combined onsite wetlands are approximately 0.82 acres, or 2.8 percent of the 28.9 - acre site. An Environmental Resource Permitting (ERP) pre - application meeting was held on May 9, 2007 with FDEP staff to discuss the project and the wetland impacts. FDEP staff indicated that a formal wetland delineation would not be required prior to submittal of the ERP application given the limited impacts and the overall low quality of the depressional wetlands in the pasture. However, upon submittal of the ERP application, FDEP will visit the site and notify SJRWMD if a formal wetland delineation and flagging is required. At this time, FDEP will also determine whether mitigation for the wetland impacts is required. During the pre - application meeting, FDEP indicated that mitigation will likely not be required due to the water quality improvement nature of the project, the creation of over 3 -acres of wetlands, and the relatively low quality and small area of wetlands being impacted. The wetland impact areas are shown on the plans on sheet C -3, "Clearing, Erosion Control, and Tree Protection Plan." Impact Areas 1, 2 and 3 are within Solary Canal. Impact Areas 1 and 2 will be disturbed by the installation of sheet piling and riprap. Impact Area 3 will be disturbed by installing the box culvert for the canal crossing. The entire canal side slope is shown as being impacted even though riprap will only be placed along the bottom of portions of the canal. This conservative designation is included because of potential temporary or permanent impacts during construction. Impact Areas 4 and 5 are isolated depressional wetlands that will be excavated during the pond construction. A portion of the narrow Swale wetland, Impact Area 6, may or may not be impacted from the pond construction, but is included in the tabulation. ACCESS AND SITE SECURITY: The entire site will be surrounded by a 6 -foot high black vinyl coated chain link fence. Permanent access to the site will be off of DeLeon Street through a 14 -foot wide gate. Construction access will be from the same location as the permanent site access (see sheet C -1). The site will need to be periodically accessed by maintenance personnel for inspections, pond treatments, trash and debris removal, grounds maintenance, and other related tasks. The project has no buildings or mechanical equipment. The site is not intended to be open to the public and there are no facilities onsite designed to accommodate public access. September 22, 2008 Regular Agenda Item #601 Page 4 of 4 TREE IMPACTS: The proposed Stormwater Treatment Area has been designed to minimize tree impacts to the extent practicable. The City Arborist has met onsite with the design consultant to review the existing trees onsite and to determine the trees that can be protected. Plan sheet C -3 indicates a total of 120 trees onsite will be removed, and a total of 369 trees onsite will be protected. The project will require an Arbor Permit. AVAILABILITY OF LAKE JESUP TMDL CREDITS: The proposed Stormwater Treatment Area will remove a significant amount of nutrients (pollutant loadings) from Solary Canal on an annual basis. The City of Winter Springs will soon be receiving a final Lake Jesup nutrient reduction allocation from FDEP, which is currently in progress as part of the Lake Jesup Basin Management Action Plan, or BMAP. The Solary Canal project may offer the City an opportunity to obtain credit towards meeting at least a portion of its mandated pollutant loading reduction requirement. In order to obtain pollutant loading reduction credits, the City would have to participate in the project in some form, such as construction funding, project administration, or long -term ownership and maintenance responsibility. The amount of credit available for such tasks has not been determined yet, but so far the Cities of Winter Springs and Oviedo have expressed support for the project and a willingness to explore project partnership opportunities when more information is available. ARCHAEOLOGICAL RESOURCES: Comprehensive Plan Policy 1.9.2 states: "Development shall be prohibited which damages any site or building determined to be either historically or archaeologically significant as designated on the register of historically significant property maintained by the State of Florida." Because of the site's proximity to Lake Jesup, there is a moderate possibility of archaeological resources being present onsite. The State Division of Historical Resources is the agency responsible for determining the level of archaeological resource evaluation required for a project, which may include having a professional archaeologist perform a cultural reconnaissance survey of the project area. A similar archaeological survey was recently required by SJRWMD on the City's Orange Avenue project due to its proximity to Lake Jesup. PLANNING & ZONING BOARD ACTION: At its September 3, 2008 meeting, the Planning and Zoning Board unanimously recommended approval of the Combined Preliminary and Final Engineering/Site Plan for the proposed St. Johns River Water Management District Solary Canal Stormwater Treatment Area. RECOMMENDATION: Staff recommends the Commission approve the Combined Preliminary and Final Engineering /Site Plan for the St. Johns River Water Management District Solary Canal Stormwater Treatment Area subject to satisfaction of the State Division of Historical Resources requirements for archaeological evaluation.
