September 22, 2008 ~~ Meeting Authorization PUBLICLYANNOUNCE THE REQUEST REQUEST: The City Manager is requesting that the City Commission hold a Public Hearing relative to the approval of Resolution No. 2008-47, which establishes the Final Operating Millage Rate and the Final Voted Debt Service Millage Rate for Fiscal Year 2008-2009 for the City of Winter Springs. Note to Mayor and Commission: Once consensus has been reached on the millage budget the Finance staff requests a recess to calculate the final numbers. PURPOSE: The purpose of this agenda item is to have the Commission approve Resolution No. 2008- 47, otherwise known as the Final Millage Rates for Fiscal Year 2008-2009. CONSIDERATIONS: On September 8, 2008, the Commission adopted a tentative operating millage rate of 3.0338 mills and a tentative voted debt service millage rate of 0.1100 mills for a total tentative millage rate of 3.1438 mills. Tonight the Commission will set the final millage rates which can not exceed the tentative millage rates. At the budget workshop on September 17, 2008, the City Manager provided the Commission with a new `base' millage rate of 2.2486 mills along with a list of potential add-backs for their consideration. This agenda item which will establish the final millage rates must be approved prior to the final budget agenda item (Public Hearing 501). However, it will be necessary to engage in budget discussions in order to determine the millage rate. Since the tentative millage rate of 3.0338 is less than the rolled-back rate of 3.6512 mills the vote will only require a simple majority. RECOMMENDATION: It is recommended that the Commission adopt Resolution No. 2008-47 establishing the final operating millage rate at whatever rate the Commission deems necessary for fiscal year 2008-2009, the final voted debt service millage rate at 0.1100 mills for fiscal year 2008-2009 and publicly announce the percentage by which the final operating millage rate is less than the rolled-back rate. A `sample' motion follows which includes the necessary elements for statutory compliance: 1 make the motion that the City of Winter Springs adopt Resolution No. 2008-47 establishing the final operating millage rate at mills, establishing the voted debt service rate at 0.1100 mills and publicly announce that the final operating millage rate is % less than the computed rolled-back rate of 3.6512 mills. IMPLEMENTATION SCHEDULE: Upon approval and adoption of Resolution No. 2008-47, the millage rates for fiscal year 2008-2009 would be communicated to the Seminole County Property Appraiser and the Seminole County Tax Collector as the millage rate to be levied by the City of Winter Springs for the 2008 tax year. WHEREAS, the City Commission of Winter Springs of Seminole County, Florida, on September 22, 2008, adopted Fiscal Year 2008-2009 Final Millage Rates following a public hearing as required by Florida Statute 200.065; WHEREAS, the City Commission of Winter Springs of Seminole County, Florida, held a public hearing as required by Florida Statute 200.065; WHEREAS, the gross taxable value for operating purposes not exempt from taxation within Seminole County has been certified by the Seminole County Property Appraiser to the City of Winter Springs as $2,019,574,380; WHEREAS, the City Commission of Winter Springs desires to adopt the final operating millage rate and publicly announce the percent, if any, by which the final operating millage rate is more than or less than the rolled-back rate, and adopt the final voted debt service rate; and WHEREAS, the City Commission of Winter Springs deems that this Resolution is in the best interest of the public health, safety, and welfare of the citizens of Winter Springs. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, SEMINOLE COUNTY, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing recitals are deemed true and correct and are hereby fully incorporated by this reference. Section 2. The City Commission adopts its final operating millage rate of mills and its final voted debt service millage rate of 0.1100 mills for the fiscal year commencing October 1, 2008 and ending September 30, 2009. Within three (3) days of the date of this Resolution, the Finance Director shall forward the Resolution adopting the final millage rates to the Seminole County Property Appraiser and the Seminole County Tax Collector. Section 5. Within thirty (30) days of the date of this Resolution, the Finance Director shall certify compliance with Chapter 200, Florida Statutes by causing the Certification of Compliance, along with all necessary documentation, to be sent to the Property Tax Administration of the Department of Revenue. Section 6. Repeal of Prior Inconsistent Resolutions. All prior resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of the conflict. Section 7. Severability. If any section, subsection, sentence, clause, phrase, word, or portion of this Resolution is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereto. Section S. Effective Date. This Resolution shall become effective immediately upon adoption by the City Commission of the City of Winter Springs, Florida. Section 5.
