REQUEST: The Public Works Department requests the City Commission validate the
staff recommendation finding the Town Center Building 17 site to be built in
substantial accordance with the Final Engineering plans and to accept the
potable water and sanitary sewer infrastructure for ownership and
maintenance.
PURPOSE: The purpose of this Agenda Item is to request the City Commission validate the
staff recommendation finding the Town Center Building 17 site to be built in
substantial accordance with the Final Engineering plans and to accept the potable
water and sanitary sewer infrastructure for ownership and maintenance per
Section 9-178 in order for Certificates of Occupancy to be issued.
APPLICABLE CODE:
Section 9-178. Required Improvements to be completed prior to building on lots;
exceptions.
(c) Where the building official has an authoritative method of assurance that the
improvements will be completed in accordance with approved plans, such as withholding
occupancy, the building official may issue building permits upon advising the developer
that all or partial occupancy will be restricted until satisfactory completion of the
improvements has be accomplished.
(d) ... Certificates of occupancy will not be issued until all improvements are accepted
by the city commission.
CONSIDERATIONS:
Town Center Building 17 is a 26-unit condominium building by the James Doran Company
located on a 0.81 acre site on the south side of Blumberg Boulevard in the Winter Springs Town
Center. The site abuts the Kingsbury property to the east, the Building 16 parcel to the south,

Cliff Rose Drive to the west, and Blumberg Boulevard to the north. Along with the 26
condominium units the site contains an outdoor Jacuzzi and grill area along with 41 onsite
parking spaces in a gated parking lot accessible from Cliff Rose Drive.
FINDINGS:
1) The site has been constructed in substantial accordance with the Final Engineering
plans approved by the City Commission on August 28, 2006, except as noted on the
attached site punchlist, Exhibit A.
2) All City agencies have found the work to be acceptable, except as noted on Exhibit A.
3) The engineer-of-record has certified the sitework and provided a complete set of
record drawings.
4) The developer has provided atwo-year maintenance bond for the water and sewer
utilities being turned over to the City for ownership and maintenance.
5) The developer has dedicated and recorded the required onsite utility easements.
6) The Final Engineering plans were approved with a condition that the developer
provide six (6) temporary unpaved parking spaces on the adjacent undeveloped
building pad located on the west side of Cliff Rose Drive across the street from
Building 17. This area is stabilized and available to be converted into temporary
parking spaces as needed to meet the peak parking demand for Building 17.
RECOMMENDATION:
Staff recommends that the City Commission validate the staff recommendation
finding the Town Center Building 17 site to be built in substantial accordance with the
Final Engineering plans and to accept the potable water and sanitary sewer infrastructure
for ownership and maintenance, subject to satisfactory completion of all site punchlist
items listed in Exhibit A.
IMPLEMENTATION:
The Certificate of Occupancy can be issued after Commission approval and
satisfaction of all site punchlist items listed on Exhibit A.

Construction Items to Complete:
1. Install the two handicapped diagonal parking spaces on Blumberg Blvd per the plans
2. Paint backflow preventer black (use NSF 61 approved paint for potable water lines)
3. Re-Jet/Vac stormwater system
4. Place 2" curb stop that was to be used as irrigation in an at-grade box
5. Install detectable warnings at the parking lot entrance (south side) and at the sidewalk
point of entry into the back of the parking lot
6. Install the bike rack per the plans
7. Install the two parking lot lights shown on the plans in the two parking lot islands
8. Verify that all valve box covers and cleanout caps can be removed (some appear to be
sealed with concrete)
9. Clean up concrete and trash in green areas
10. Onsite signs are required to be the decorative type meeting the Town Center Standards
(per the approved agenda item)
11. Building permits for the parking lot gate and trellis at the traffic circle must be pulled prior
to C.O. for Building 17.
12. Finish landscaping. Contact Steve Richart at 407-327-5976 to schedule a final
inspection for landscape and irrigation, if you have not already
13. Verify with the Fire Inspector that the onsite fire hydrant has passed the flow test
