Authorization REQUEST: The City Manager is requesting that the City Commission hold a Public Hearing relative to the approval of Resolution No. 2008-40, which establishes the Tentative Operating Millage Rate for Fiscal Year 2008-2009 for the City of Winter Springs at 3.0338 mills which is 16.91 % less than the rolled-back rate of 3.6512 mills and the Tentative Voted Debt Service Millage Rate for Fiscal Year 2008-2009 for the City of Winter Springs at 0.1100 mills. PURPOSE: The purpose of this agenda item is to have the Commission approve Resolution No. 2008-40, otherwise known as the Tentative Millage Rates for Fiscal Year 2008-2009. CONSIDERATIONS: On August 4, 2008, the Commission established the 2008-2009 proposed operating millage rate (millage cap) at 3.0338 mills and the proposed voted debt service millage rate at 0.1100 mills. The proposed operating millage rate of 3.0338 as submitted on the DR-420 is 16.91% less than the rolled-back rate. Resolution No. 2008-40 will establish the 2008-2009 tentative millage rates. It is recommended that the tentative millage rates not vary from the proposed millage rates that were previously established. The operating millage for the current fiscal year 2007-2008 is 3.2496 mills. The voted debt service millage for the current fiscal year 2007-2008 is 0.1022 mills. The FY 2008-2009 Preliminary Budget reflected an operating millage rate of 2.2685 mills. The rolled-back rate for fiscal year 2008-2009 is 3.6512 mills. The maximum millage levy allowed by a majority vote for fiscal year 2008-2009 is 3.3859 mills. 090808_COMM_ Public_Hearing_500_Tentative_Millage.doc ^ The $981,878 increase in the General Fund fund balance represents the balance of funds generated by the 3.0338 millage cap which is subject to final budget action by the Commission. ^ Any subsequent revisions by the City Commission to the tentative millage rates and/or the tentative budget will be reflected in the Final Millage and Final Budget Hearings scheduled for September 22, 2008 at 5:15 p.m. However, the tentative millage rates that are established tonight can not be exceeded at the final hearing. As such, it is recommended that the Commission set the tentative operating millage rate equivalent to the proposed operating millage cap of 3.0338 mills. The Commission may reduce the operating millage rate at the final hearing. RECOMMENDATION: ^ Recommend that the Commission adopt Resolution No. 2008-40 establishing the tentative operating millage rate at 3.0338 mills for fiscal year 2008-2009 and the tentative voted debt service millage rate at 0.1100 mills for fiscal year 2008-2009. ^ Recommend that the Commission adopt Resolution No. 2008-40 authorizing the City to advertise the City's intent to hold public hearings to adopt final millage rates and final budget in a newspaper of general circulation in compliance with Florida Statute 200.065. IMPLEMENTATION SCHEDULE: Upon approval and adoption of Resolution No. 2008-40, the appropriate advertising will run in the Orlando Sentinel on September 18, 2008 which will reflect the tentative levy for Fiscal Year 2008-2009 and announce the final Public Hearing on September 22, 2008 at 5:15 p.m. ATTACHMENTS: Resolution No. 2008-40 COMMISSION ACTION: 090808_COMM_ Public_Hearing_500_Tentative_Millage.doc RESOLUTION N0.2008-40 A RESOLUTION OF THE CITY COMMISSION OF WINTER SPRINGS, FLORIDA, ADOPTING THE TENTATIVE OPERATING MILEAGE RATE FOR THE CITY OF WINTER SPRINGS FOR THE FISCAL YEAR COMMENCING ON OCTOBER 1, 2008 AND ENDING ON SEPTEMBER 30, 2009; ANNOUNCING THE PERCENTAGE BY WHICH THE TENTATIVE OPERATING MILEAGE RATE IS LESS THAN THE ROLLED-BACK RATE; PROVIDING FOR REPEAL OF PRIOR INCONSISTENT RESOLUTIONS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Winter Springs has held a public hearing on the tentative millage rate pursuant to Florida Statute 200.065, Subparagraph (c); WHEREAS, the City Commission of Winter Springs desires to adopt the tentative operating millage rate and publicly announce the percentage change by which the tentative proposed operating millage rate is less than the rolled-back rate, and adopt the tentative voted debt service rate; and WHEREAS, the City Commission of the City of Winter Springs deems that this Resolution is in the best interest of the public health, safety, and welfare of the citizens of Winter Springs. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, SEMINOLE COUNTY, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing recitals are deemed true and correct and are hereby fully incorporated by this reference. Section 2. The City Commission adopts its tentative operating millage rate of 3.0338 mills and its tentative voted debt service millage rate of 0.1100 mills for the fiscal year commencing October 1, 2008 and ending September 30, 2009. Section 3. The tentative operating millage rate of 3.0338 mills is less than the computed rolled-back rate of 3.6512 by 16.91 %. Section 4. Within fifteen (15) days of the date of this Resolution, the City Clerk shall advertise in a newspaper of general circulation its intent to finally adopt the millage rates and budget and shall hold a public hearing to adopt the millage rates and finalize the budget not less than two (2) days or more than five (5) days after the date the advertisement is first published. All prior resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of the conflict. Section 6. Severability. If any section, subsection, sentence, clause, phrase, word, or portion of this Resolution is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereto. Section 7. Effective Date. This Resolution shall become effective immediately upon adoption by the City Commission of the City of Winter Springs, Florida.
