Authorization REQUEST: The Parks and Recreation Department and Public Works Department are requesting authorization to award the contract for construction of the Trotwood Park Expansion to BDG Construction Services, LLC. PURPOSE: The purpose of this item is to request authorization to award the contract for the construction of a splash playground, pavilion, sidewalk and restroom renovations at Trotwood Park to BDG Construction Services, LLC.. CONSIDERATIONS: • The project was advertised for bid on February 24, 2008. The bids were opened on March 19, 2008. RL Burns, Inc. Construction Company was the low bidder in the amount of $410,677.00. Three other bids were received in the amounts of $425,115.00, $457,315.00 and $532,347.00. • The bid of $410,677.00 was good until June 17 per the bid bond. RL Burns voluntarily agreed to hold the price for only another 45 days (August 1, 2008). • On July 28, 2008, the City Commission approved the authorization for awarding the Trotwood Park Project to RL Burns, Inc. at $410,677.00 • On August 13, 2008, staff received Notice of Rejection of the Trotwood Park Project by RL Burns, Inc. • Staff notified the 2°d low bidder by $14,438.00, BDG Construction Services, LLC and asked if they could still do the work at the bid amount of $425,115.00. • On August 18, 2008, BDG Construction Services, LLC notified staff that they would honor their bid. • CPH has contacted references and confirmed an understanding of the work. However, they stated there was insufficient information submitted to evaluate BDG due to the company being recently formed. • City staff met with representatives of BDG on August 28, 2008 and requested additional documentation and references. Agenda Item Regular 205 September 8, 2008 Page 2 BDG provided additional information which indicated their principal's experience with Winter Springs Town Center Building 3 and 16. Also, they were recommended highly by the Winter Springs Building officials and by RW Contractors regarding the City of Daytona Beach Splash Playground. This FRDAP grant project has a critical milestone. The project must be completed with $400,000 in funds expended by April, 2009 or the $200,000 matching FRDAP will be expired and no extensions given. IMPLEMENTATION SCHEDULE: • The implementation schedule is as follows: ^ Notification of award September 10, 2008 ^ Pre Construction meeting September 25, 2008 ^ Notice to Proceed September 25, 2008 ^ Project start date October 1, 2008 ^ Project duration 182 Calendar Dates ^ Project completion March 31, 2009 ^ FRDAP funding received ($200,000) April, 2009 ^ Grand Opening April, 2009 FUNDING: The funding for this project is provided under the Trotwood Park Improvement Fund, 315- 65000-70109. The funding sources area $200,000 FRDAP grant with the remainder of funding from Park Impact Fees for 07/08 and 08/09. The BDG Construction Services, LLC contract plus contingency and CPH contract are fully funded with the revision of the budget. Should the Parks Impact Fee revenue not materialize as conservatively budgeted, the general fund would make a short term loan to the Trotwood Improvement Capital Project Fund to be paid back when revenue is realised. RECOMMENDATIONS: Staff recommends authorization of awarding the contract for construction to BDG Construction Services, LLC for a contract amount of $425,115.00 plus 10% contingency ($42,512.00) for a total construction authorization of $467,627.00 payable from account 315-65000-70109. (BDG). It is our understanding the apparent low bidder has asked to be removed from consideration, which was accepted by the City. As part of our review, we examined the bid tabulation provided by your office. Upon our review, we found no mathematical errors in the bid tabulation. There are no M/WBE requirements for this project. CPH Engineers contacted the four references provided by BDG. A telephone review/check of their listed references indicates that the references were for two main employees of the company and not current or past work performed by BDG. The references we spoke with stated they had no objections to either Kevin Guffee or Jay Brown and gave them both above average recommendations. One reference stated they would hire the company based an past experience with the employee. The references also mentioned both Mr. Guffee and Mr. Brown worked for other companies on the projects listed and not for BDG. According to the project specifications, section 00200, 1.16 and 1.17, the Contractor was to have performed projects similar in work and size as the proposed work and provide references for this work. There was no indication that the references provided by BDG was far similarwork as required in specifications. This project requires installation of a splash pad including plumbing, piping, and electrical work, which was not evident in the references submitted. We are attaching for the City's use, a copy of the references and reference checklist. Based on our review of the available data (bid tabulation and contractor supplied references), it is our opinion that there was insufficient information submitted to evaluate the Contractor's ability to perform the specialized construction activities for this project. tf this is also a concern of the City of Winter Springs, we recommend that the City request that the bidder submit additional documentation and references addressing the specialized construction of the splash pad, pump equipment room and other structures. We have attached references for this contractor for the City's information. BDG understands the park must be completed no later than April 1, 2009 to receive matching funding for the project. We have carefully considered the scope of the project and are committed to completing this project in order for the City to open the splash pad by this date. We have also negotiated competitive pricing with our vendors to be able to honor our original bid amount from March without passing on any costs increases to the City. BDG will implement our past experience in this type of construction in the planning and completion of the Trotwood Park Improvements. Similarly, Kevin Guffee has overseen the construction of community amenities a# the Avistele in Jacksonville and at Cabana Key in Casselberry. Jay Brown has overseen the construction of swimming pool and spa construction for the LA Fitness in Brandon, FL, notably working with the Hillsborough County Health Department requirements, participating in a variance hearing with the State Health Department, and working with the pool maintenance crews in adjusting the pool chemistry with the electronic equipment. Due to ever escalating costs for materials and labor, many of our Vendors have had to significantly increase their prices. We have determined that the costs for completing this project have increased in excess of $40,000. While we would be delighted to be able to construct this facility for the City of Winter Springs, we are unable to do so without having the amount of our current contract increased. Proceeding at the current dollar value without an escalation for current market increases would affect performance on our part. We want to give the very best job possible.
