REQUEST: The Community Development Department requests that the Commission approve the Tali's Crossing final subdivision plat and authorize its recordation, subject to the City Attorney's review and comments. PURPOSE: The purpose of this agenda item is to approve and authorize recordation of the Tali's Crossing final subdivision plat. APPLICABLE CODE: Section 9-3. Dividing platted property. Section 9-4. Waiver to subdivision requirements. Section 9-75. Final Plat, contents and recording procedures. Section 9.77. Approval of final plat. Code Section 9-78. Recording/distribution of the final plat. Chapter 177, Florida Statutes. Chapter 197, Florida Statutes (Section 197.333 When taxes due; delinquent). CONSIDERATIONS: The approximately 9 acre site is located on the east side of Fisher Road (a.k.a. Bird Road), just south of the Dunmar subdivision. The site has a Rural Residential future land use designation and lies within the RC-1 zoning district. A maintenance bond for the associated water line extension was provided to Public Works and found acceptable nearly 2 years ago. The plat is in substantial conformance with the approved subdivision plans (41ots, ranging from 2.0 to 2.55 acres in size), has been certified by the City's consulting surveyor, and is ready for Commission approval, subject to the City Attorney's review and comments. FINDINGS: 1. The plat is consistent with the Comprehensive Plan and City Code. August 25 2008 Regular Agenda Item 601 Page 2 2. The plat is consistent with the approved final subdivision plan approved by the City Commission on April 24, 2006. 3. The City's surveying consultant has reviewed the plat and has certified that it meets the platting requirements of Chapter 177, Florida Statutes. 3. The City Commission approved the final engineering/subdivision plan for 9.080 acres on Apri124, 2006. 4. Staff has reviewed the plat and recommends approval, subject to the City Attorney's review and approval of the plat and title certification -the applicant must make any changes or provide any additional information required by the City Attorney, prior to execution by the City and recordation in the public records of Seminole County. The applicant pays for recordation and the City's copies of the plat and HOA restrictive covenants. RECOMMENDATION: Staff recommends that the City Commission approve and record the Tali's Crossings final subdivision plat, subject to the City Attorney's review and comments.
