Authorization REQUEST: The Community Development Department, Planning Division requests that the City Commission hold a Public Hearing to consider adoption of Resolution 2008-37 which designates an area of the City as the "Village Walk Seminole Economic Enhancement District (SEED)/Brownfield Area". PURPOSE: For the City Commission to consider adoption of Resolution 2008-37 designating an area of the City [located generally along SR 434 and SR 419 (as depicted on Exhibit A)] as a SEED/Brownfield Area. APPLICABLE LAW AND PUBLIC POLICY: Florida Statute 376.77 - 376.86: "Brownfield Redevelopment Act" CONSIDERATIONS: The City Commission held a Workshop on Brownfields on March 3, 2008. Mr. John Metsopoulos, Seminole County US 17-92 CRA Program Manager and Mr. George Houston, Dept of Environmental Protection, Brownfield Coordinator- Waste Cleanup described the implications of the brownfield designation (also referred to as "SEED- Seminole Economic Enhancement District"). The City Commission directed that three (3) other areas of the City be explored for designation as SEED/Brownfield Areas under this program. What is the SEED/Brownfield program? The SEED/Brownfield program is a state economic development incentive to accomplish two purposes: 1. To provide general economic development opportunities in SEED/Brownfield designated zones on a project by project basis; 2. To promote special economic development opportunities in SEED/Brownfield designated zones for properties that require the clean-up of environmental contamination on project by project basis. August 25, 2008 PUBLIC HEARING AGENDA ITEM 502 What properties can be included? Section 376.80, Florida Statutes describes the Administrative Process for the Brownfield program. In determining areas to be designated, the City must consider: 1. Whether the brownfield area warrants economic development and has a reasonable potential for such activities; 2. Whether the proposed area to be designated represents a reasonable focused approach and is not overly large in geographic coverage; 3. Whether the area has potential to interest the private sector in participating in rehabilitation; and 4. Whether the area contains sites or parts of sites suitable for limited recreational open space, cultural or historical preservation purposes. In general, any commercial property in need of development or redevelopment or environmental clean-up can be included. In certain cases, residential property in need of environmental clean- up can also be included. The designated SEED/Brownfield Area must be a contiguous area and must be designated by City resolution. Who administers the program? The program is administered by the State of Florida and County Dept of Economic Development What Does it Cost the City? There is no cost to the City other than the public noticing costs, which have already been incurred. The City may match state job creation grants [if it desires] up to $500 per job. What benefits are available for Economic Development Proiects in SEED designated zones? Environmental Clean-up Economic Developm~pt Proilfcts General Economic Development Proiects Building Materials Sales Tax Rebate on residential projects containing 20% or more workforce housing units. Cash Rebates on projects generating $2 million in capital investment outlays and at least 5 new full-time jobs. August 25, 2008 PUBLIC HEARING AGENDA ITEM 502 Seminole County and the City believe that designation of this area as a Seminole Economic Enhancement District / Brownfield Area will provide incentives to encourage development within the designated area. CHRONOLOGY: The public hearings have been noticed as required under Florida Statute: Julv 24. 2008- Public Noticing in Orlando Sentinel of Aug. 7th Public Hearing at First Baptist Church Aug. 3.2008- Public Noticing in Spanish of Aug 7th Public Hearing at First Baptist Church The notice of the August 7th Public Hearing was also posted at the First Baptist Church and announced at a regularly scheduled meeting of the City Commission before the actual hearing date. Aug. 7. 2008- Public Hearing held at First Baptist Church, 817 East State Road 434, Winter Springs, Florida for public input on the proposed Village Walk Seminole Economic Enhancement District/Brownfield Area. Public input was received. The brownfield program administration process requires at least one Public Hearing in each area proposed to be designated as a Seminole Economic Enhancement District (S.E.E.D.)/Brownfield Area. Aug. 14.2008- Public Noticing in Orlando Sentinel of Adoption Public Hearing for Resolution 2008-37, on August 25, 2008 at City Hall. Aug. 25.2008- City Commission Public Hearing for Adoption of Resolution 2008-37. Proposed Village Walk Seminole Economic Enhancement District/Brownfield Area FINDINGS: 1. The properties described in Exhibit A meet the criteria for designation as a brownfield under section 376.80, Florida Statutes; 2. The City is not responsible for the costs and liabilities associated with site remediation, rehabilitation, economic development, or source removal unless the City specifically designates itself as a responsible person pursuant to section 376.80 (3), Florida Statutes; and 3. The public hearing and noticing requirements have been met. ATTACHMENT B RESOLUTION NO. 2008-37 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, SEMINOLE COUNTY, FLORIDA, DESIGNATING THOSE PARCELS IDENTIFIED IN THE MAP ATTACHED HERETO AS EXHIBIT "A" FOR INCLUSION WITHIN THE SEMINOLE ECONOMIC ENHANCEMENT DISTRICT / BROWNFIELD AREAS FOR THE PURPOSE OF ENVIRONMENTAL REMEDIATION, REHABILITATION AND ECONOMIC REDEVELOPMENT ("VILLAGE WALK S.E.E.D. / BROWNFIELD AREA"); AUTHORIZING THE CITY CLERK TO NOTIFY THE FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION OF SAID DESIGNATION AS REQUIRED BY LAW; PROVIDING FOR THE REPEAL OF PRIOR INCONSISTENT RESOLUTIONS, SEVERABILITY AND AN EFFECTIVE DATE. WHEREAS, the City is granted the authority, under S 2(b), Art. VIII of the State Constitution, to exercise any power for municipal purposes, except when expressly prohibited by law; and WHEREAS, sections 376.77 through 376.85, Florida Statutes, known as the "Brownfield Redevelopment Act" ("the Act") authorizes the designation by resolution of certain lands as "Brownfield Areas", and for the corresponding provision of environmental remediation, rehabilitation, and economic redevelopment for such areas; and WHEREAS, the City Commission finds that the proposed area set forth herein warrants economic development and has a reasonable potential for such activities; and WHEREAS, the City Commission finds the proposed area represents a reasonably focused approach and is not overly large in geographic coverage; and WHEREAS, the City Commission finds the proposed area has potential to interest the private sector in participating in rehabilitation; and WHEREAS, the City Commission finds the proposed area contains sites or parts of sites suitable for limited recreational open space, cultural, or historical preservation purposes; and WHEREAS, pursuant to section 376.80(2)(a), Florida Statutes, the City of Winter Springs has held a public meeting on a August 7, 2008 in the area to be designated as a Brownfield Area, as more particularly described in Exhibit "A"; City of Winter Springs Resolution No. 2008-37 Page 1 of 3 WHEREAS, the City Commission desires to designate the parcels described in Exhibit" A" as the Village Walk S.E.E.D. / Brownfield Area; and WHEREAS, City Commission deems that this Resolution is in the best interests of the public health, safety, and welfare of the citizens of Winter Springs. NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, SEMINOLE COUNTY, FLORIDA, THAT: SECTION 1. Incorporation of Recitals. The foregoing recitals are deemed true and correct and are hereby fully incorporated herein by reference. SECTION 2. Designation of Village Walk S.E.E.D. / Brownfield Area. The City Commission of the City of Winter Springs hereby designates those parcels identified on the map attached hereto as Exhibit "A" and fully incorporated herein by this reference, as part of the Seminole Economic Enhancement District (S.E.E.D.) / Brownfield Area ("the Area") for environmental remediation, rehabilitation, and economic redevelopment as set forth in the Act and pursuant to the following terms and conditions: A. The City of Winter Springs shall, as soon as is practical, designate the entity or entities responsible for the remediation and rehabilitation of the Area, or specific portions thereof, pursuant to section 376.80(3), Florida Statutes. B. The designation of the Area by this Resolution does not render the City of Winter Springs responsible for the costs and liabilities associated with site remediation, rehabilitation, economic development, or source removal, as those terms are defined in the Act, unless the City of Winter Springs specifically designates itself as a responsible person pursuant to Section 376.80(3), Florida Statutes. C. Nothing in this Resolution shall be deemed to prohibit, limit, or amend the authority and power of the City of Winter Springs to designate any other property or properties as a Brownfield / S.E.E.D. Area, or to modify, amend, or withdraw the designation as established herein. SECTION 3. Directions to City Clerk. Upon adoption of this Resolution by the City Commission, the City Clerk shall notify the Florida Department of Environmental Protection of the City's designation of the Area consistent with the requirements of the Act. SECTION 4. Severability. If any section, subsection, sentence, clause, phrase, word, or portion of this Resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction, whether for substantive or procedural reasons, such portion shall be deemed a separate, distinct, and independent provision, and such holding shall not affect the validity of the remaining City of Winter Springs Resolution No. 2008-37 Page 2 of 3 portions of this Resolution.
