HomeMy WebLinkAbout2008 08 11 Consent 201 Temporary Signs (Including Political Signs) COMMISSION AGENDA August 11, 2008 Regular Meeting Consent Informational Public Hearing Regular V Mgr. / x ITEM 201 REQUEST: The Community Development Department requests the City Commission approve the attached brochure for distribution, related to Temporary Signs (including Political Signs). PURPOSE: To authorize distribution of an informational brochure related to Temporary Signs (including Political Signs). CONSIDERATIONS: With the political season quickly approaching, the Community Development Department would like to take this opportunity to make information available on signage regulations in the City of Winter Springs to political candidates as well as to the general public. Staff has prepared a brief, user-friendly brochure based on the City's sign code. The brochure will be made available to the general public at the permit counter and copies will be provided for distribution by Code Enforcement. A copy of the brochure will also be included in packets distributed by the Clerk's office to Winter Springs' political candidates. FUNDING: No supplemental funding is required, as the brochure will be printed in-house and the quantity printed can be correlated to demand. RECOMMENDATION: The Community Development Department requests Approval of the attached informational brochure on temporary signs (including political signs). ATTACHMENTS: A- Brochure- Temporary Signs (including political signs) Maximum # of Temporary Signs Each residential property is allowed a maximum of four (4) Temporary Signs, with no sign being over six (6) square feet in size. [See. 16-60(c), City Code] Temporary signage on non-residential properties shall not exceed a total area of thirty-six (36) square feet, with no sign being over nine (9) square feet in size. [See. 16-60(c), City Code] The calculation for a double faced sign shall be the area of one face only. [Sec. 16-51, City Code] Sign Permit Checklist Submit the Following with your Application for any TEMPORARY SIGN over SIX (6) Square Feet: 1. Four (4) copies of sign plans de- signed in accordance with Florida Building Code See. 3108.3 and 3108.3.2 for wind loads of 110 miles per hour 3 second gust and in compliance with the requirements of Winter Springs Code, Chapter 16 Ihttp.//www wintersorinasfl or9 Click on the Tab for "Documents & Forms" then go to "Codes and Ordinances"] 2. Two (2) copies of Plot Plan or Sur- vey (no larger than 8"x14"- legal size) for each site showing the proposed location for each sign. 3. Building Permit Application filled out completely as to: a. Property owner, address, and busi- ness name where each sign is to be lo- cated; b. Sign Contractor's name, address, phone, license, and insurance; e. Description of sign materials, di- mensions, and text; temporary SIGNS Where Can Signs be Located? Signs are to be installed only on private property with the permission of the prop- erty owner. Temporary Signs are not allowed in a pub- lic right-of-way. Signs are not to be at- tached to utility poles, light fixtures, trees, inoperable or unlicensed vehicles, or tem- porary structures. Signs must also be at least five feet (5') from any right-of-way and at least ten feet (10') from side and rear property lines. [See. 16-60(e), City Code] No sign shall obstruct the sight of any roadway or drive- way intersection or approach. [See. 16-76] [political signs] There is no time restriction as to how many days prior to the event a Temporary Sign may be installed. Type of sign (i.e. "temporary"); e. $ amount of the sign contract; and f. Notarized signature of Property Owner and Sign Contractor (or Contractor's authorized agent- [requires Power of At- torney]). Temporary Signs must be removed within three (3) days after the date upon which the sign has fulfilled its purpose (i.e. the date of the election for election-related temporary signs). [Sec. 16-60(a), City Code] Maximum Ht. of Temporary Signs Sign height is measured from the average finished grade elevation to the highest point of the sign. Residential properties- Four (4) feet maximum height. [See. 16- 60(c), City Code] Non-Residential properties- Eight (8) feet maximum height. [See. 16- 60(d), City Code] Where Can I Get an Application? Applications are available at the Permit Counter at the Winter Springs City Hall. They are also available from the City's website at: http'//www.winterspringsfl org [Click on the Tab for "Documents & Forms" then go to "Forms and Publications" then go to "Building and Permitting". The Sign Permit Checklist (included on the back of this brochure) lists everything needed to submit with your Application. The Applica- tion you will use is the Building Permit Ap- plication. The Winter Springs Code Regulates Signage These regulations are established in order to promote the overall economic well- being of the city, while at the same time providing for the health, safety and welfare of the public by reducing the adverse ef- fects of signs on safety, property values, traffic, and the enjoyment of the scenic beauty of the city. These regulations are intended to avoid excessive competition and clutter among sign displays in the de- mand for public attention, eliminate dan- gerous, dilapidated and unsightly signs and provide for adequate maintenance and in- spection of signs within the corporate lim- its of the city, consistent with constitutional guarantees and while providing for ade- quate opportunities for effective means of communication. [Sec. 16-52(a), City Code] Is a Permit Required? Although all signs are subject to the Code, only Temporary Signs over six (6) square feet [or 24" x 36"] require a Permit. Permitted signs are given a Sticker that in- cludes the permit number and date of ex- piration of the permit, This Sticker is to be displayed on each Permitted sign. If the sign is smaller than six (6) square feet, the sign can be installed without a Permit, but Code regulations Sections 16- 59 and 16-60, still apply. These include construction and maintenance standards, location, size and removal requirements, Prohibited Signs Temporary Signs shall not be illuminated and cannot contain any flashing, running or revolving parts. Prohibited signs include electronic signs, balloon displays, and trailer signs. A complete listing of prohib- ited signs is included in See. 16-57, City Code. What about Banners? Political Signs Are Regulated Just Like any Other Temporary Sign What is a Temporary Sign? A "Temporary Sign" is defined as "a sign displayed before, during or after an event or occurrence scheduled at a specific time and place, inclusive for example, for rent signs, for sale, construction signs, real es- tate signs, management signs" [Sec. 16-51, City Code]. What is the Fee for a Temporary Sign Permit? The fee is $17 per $1000 of value with a minimum charge of $45. The City Code distinctly regulates Banners apart from Temporary Signs. Banners may only be displayed for a maximum of four- teen (14) days per calendar year in non- residential areas and three (3) days in resi- dential areas. How Long Does It Take to Process an Application? Although the City will make every effort to review your Application as quickly as pos- sible, the process to grant or deny your permit may take up to forty-five (45) days. [See. 16-54(c), City Code] Maximum banner sizes are as follows: Residential properties- Twenty-four (24) square feet Non-residential areas: Sixty-four (64) square feet A complete listing of banner regulations is included in See. 16-87, City Code.
