HomeMy WebLinkAbout_2004 10 04 City Commission Special Minutes CITY OF WINTER SPRINGS MINUTES CITY COMMISSION SPECIAL MEETING OCTOBER 4, 2004 CALL TO ORDER The Special Meeting of Monday, October 4, 2004 of the City Commission was called to order by Deputy Mayor Robert S. Miller at 6:45 p.m. in the Commission Chambers of the Municipal Building (City Hall, 1126 East State Road 434, Winter Springs, Florida 32708). ROLL CALL: Mayor John F. Bush, absent Deputy Mayor Robert S. Miller, present Commissioner Michael S. Blake, absent Commissioner Donald A. Gilmore, present Commissioner Sally McGinnis, present Commissioner David W. McLeod, attended via telephone City Manager Ronald W. McLemore, present City Attorney Anthony A. Garganese, present A moment of silence was held, followed by the Pledge of Allegiance. PUBLIC HEARINGS AGENDA PUBLIC HEARINGS 400. Community Development Department - Planning Division Requests The City Commission Conduct A Public Hearing For The First Reading Of Ordinance 2004-48, Annexing Three Parcels Located At 1740 Deleon Street Equaling Approximately 4.05 Acres And Owned By Cynthia Rook. Ms. Eloise Sahlstrom, AICP, ASLA, Senior Planner, Community Development Department presented her opening remarks. "MOTION TO READ BY 'TITLE' ONLY." MOTION BY COMMISSIONER McGINNIS. SECONDED BY DEPUTY MAYOR MILLER. DISCUSSION. CITY OF WINTER SPRINGS MINUTES CITY COMMISSION SPECIAL MEETING - OCTOBER 4,2004 PAGE20F3 VOTE: COMMISSIONER GILMORE: AYE COMMISSIONER McGINNIS: AYE COMMISSIONER McLEOD: AYE DEPUTY MAYOR MILLER: AYE MOTION CARRIED. City Attorney Anthony A. Garganese read Ordinance 2004-48 by "Title" only. Deputy Mayor Miller opened the "Public Input" portion of the Agenda Item. No one spoke. Deputy Mayor Miller closed the "Public Input" portion of the Agenda Item. Discussion ensued on holding a Second Reading and the related advertising; to which Ms. Sahlstrom stated, "I will send it tonight." Deputy Mayor Miller stated, "We will tentatively schedule a - Special Meeting for 6:30 [p.m.] on the 18th [of October]." Ms. Sahlstrom added, "We are required to notify the County fourteen (14) days prior to adoption, which - we'll get that out tomorrow." "I WOULD LIKE TO MAKE A MOTION THEN THAT WE APPROVE ITEM '400'. MOTION BY DEPUTY MAYOR MILLER. SECONDED BY COMMISSIONER McGINNIS. DISCUSSION. VOTE: COMMISSIONER McGINNIS: AYE COMMISSIONER GILMORE: AYE DEPUTY MAYOR MILLER: AYE COMMISSIONER McLEOD: AYE MOTION CARRIED. In related City business, Attorney Garganese spoke of Seminole County's proposed Charter Amendment and stated, "I think the Commission needs to decide this evening, formally, whether it wants to challenge that Charter Amendment." "MAKE A MOTION THAT WE FILE LEGAL PROCEEDINGS AGAINST THE COUNTY WITH THEIR AMENDMENT. MOTION BY COMMISSIONER McLEOD. SECONDED BY DEPUTY MAYOR MILLER. DISCUSSION. CITY OF WINTER SPRINGS MINUTES CITY COMMISSION SPECIAL MEETING - OCTOBER 4, 2004 PAGE 3 OF 3 COMMISSIONER SALLY McGINNIS ADDED, "I HAVE THE UTMOST CONFIDENCE IN OUR ATTORNEY, IN THIS PROCESS. I THINK WE ARE VERY LUCKY TO HAVE ANTHONY [GARGANESE]." VOTE: COMMISSIONER McLEOD: AYE DEPUTY MAYOR MILLER: AYE COMMISSIONER McGINNIS: AYE COMMISSIONER GILMORE: AYE MOTION CARRIED.
