CITY COMMISSION
ATTORNEY -CLIENT SESSION
FEBRUARY 23, 2004
I. CALL TO ORDER
The Attorney-Client Session of Monday, February 23,2004 of the City Commission was
called to order by Mayor John F. Bush at 5:30 p.m. in the Commission Chambers of the
Municipal Building (City Hall, 1126 East State Road 434, Winter Springs, Florida
32708).
ROLL CALL:
Mayor John F. Bush, present
Deputy Mayor Edward Martinez, Jr., present
Commissioner Robert S. Miller, absent
Commissioner Michael S. Blake, present
Commissioner Sally McGinnis, present
Commissioner David W. McLeod, arrived at 5:59 p.m.
City Manager Ronald W. McLemore, arrived at 5:33 p.m.
City Attorney Anthony A. Garganese, arrived at 5:35 p.m.
Discussion.
City Manager Ronald W McLemore arrived at 5:33 p.m.
Commissioner Michael S. Blake stated, "Point of Order" and spoke of the current
discussion.
City Attorney Anthony A. Garganese arrived at 5:35 p.m.
Mayor Bush called a recess at 5:38 p.m.
Mayor Bush reconvened the Meeting at 5:59 p.m. and asked that another "Roll Call" be
called.

II. ATTORNEY-CLIENT SESSION
Pursuant To Section 286.011(8), FLorida Statutes, The City Attorney Will Be Seeking
The Advice Of The City Commission Regarding Settlement Negotiations And
Strategy Related To Litigation Expenditures Concerning The Pending Litigation
Titled "Robert Ritz, et at. v. City of Winter Springs, et at." - United States District
Court for the Middle District of Florida - Case No.: 6:03-CV-129-0RL-31-JGG."
The Persons Scheduled To Be In Attendance Are Mayor John F. Bush, Deputy
Mayor Edward Martinez, Jr., Commissioner Robert S. Miller, Commissioner
Michael S. Blake, Commissioner Sally McGinnis, Commissioner David W. McLeod,
City Manager Ronald W. McLemore, City Attorney Anthony A. Garganese, And A
Court Reporter.
Attorney Garganese stated; "Pursuant to Section 286.011, Florida Statutes, I am seeking
the advice of the City. Commission regarding possible Settlement Negotiations and
Strategy relating to the case, 'Robert Ritz, et al. v. City of Winter Springs, et al.' - that is
currently before the United States District Court for the Middle District of Florida - Case
Number 6:03-CV-129-0RL-31-JGG."
Attorney Garganese suggested that the Attorney-Client Session would last approximately
forty-five (45) minutes.
Mayor Bush then remarked that, "The persons scheduled to be in attendance are Mayor
John F. Bush, Deputy Mayor Edward Martinez, Jr., Commissioner Robert S. Miller,
Commissioner Michael S. Blake, Commissioner Sally McGinnis, Commissioner David
W. McLeod, City Manager Ron McLemore, City Attorney Anthony A. Garganese -
Michael Roper, Attorney representing the City, and a Court Reporter."
Mayor Bush then recessed the open portion of the Meeting at approximately, 6:03 p.m.
All parties who were a part of the Attorney-Client Session then departed the Commission
Chambers.
At the conclusion of the "Closed Session, " Mayor Bush re-opened the Meeting to the
public at approximately 6:33 p.m. and asked that another "Roll Call" be called.

Mayor Bush adjourned the Meeting at 6:34 p.m.
