Bush at 5:01 p.m. in the Commission Chambers of the Municipal Building (City Hall, 1126 East State Road 434, Winter Springs, Florida 32708). Mayor John F. Bush, present Deputy Mayor Robert S. Miller, present Commissioner Michael S. Blake, arrived 6:18 p.m. Commissioner Edward Martinez, Jr., present Commissioner Sally McGinnis, present Commissioner David W. McLeod, arrived at 5:52 p.m. City Manager Ronald W. McLemore, present City Attorney Anthony A. Garganese, arrived 5 :25 p.m. Following a moment of silence, the Pledge of Allegiance was led by Mayor Bush. AGENDA 1. A. Community Development Department Requests The City Commission Conduct The Scheduled Workshop, Complete With A Presentation By Breedlove Dennis And Associates, Inc. (BDA), Environmental Consultants, To Discuss The Need For Changes To The Code Of Ordinances Related To Boat Docks. City Manager Ronald W. McLemore introduced the Agenda Item. Mr. Mike Dennis, President Breedlove Dennis And Associates, Inc., 330 West Canton Avenue, Winter Park, Florida: addressed the City Commission and introduced Ms. Penny E. Cople, Senior Scientist. Commissioner Edward Martinez, Jr. stated, "We should have an Ordinance and we should vote it up or down to protect whatever there is of the lake [Jesup]." Discussion. City Attorney Anthony A. Mr. John Baker, AICP, Senior Planner, Community Development Department addressed questions by the City Commission. Discussion. Tape l/Side B Further discussion. Commissioner David W McLeod arrived at 5:52 p.m. With discussion, Commissioner McLeod asked, "What is it costing these Homeowner's to build a dock out there? Do we know that? When they put a permit in, they are supposed to tell us what the value of that dock is?" Commissioner McLeod further said, "I think that would be interesting to look at also." Discussion followed on the Parkstone community dock. Commissioner McLeod added, "It would be interesting to find out from the Developer what that dock - by the time he got through with - regulations and when he got it built; what that dock cost him per foot to build; along with what it cost, and how long is that dock and what is the width of that dock." Furthermore, Commissioner McLeod asked Manager McLemore, "Do we totally understand what St. Johns [River Water Management District's] regulations are? Does your Staff? Has that portion of this whole thing been researched?" Discussion. Deputy Mayor Robert S. Miller stated, "I would like to see a composite of what all the other Ordinances have come up with in terms of length, size." Deputy Mayor Miller added, "If people build boat dock houses; how big are they; how big of a dock do we want to have?" Furthermore, Deputy Mayor Miller said, "Right now, we do not have any Ordinance that says you cannot have a fifty foot (50') high shed on Lake Jesup." Next, Deputy Mayor Miller added, "That is the type thing I would like to see you bring back, and if you have some ideas on protection of wetland areas, on the number of docks that you ought to transgress a designated wetland, I would be interested in seeing things of that nature also." Discussion. Commissioner Michael S. Blake arrived at 6:18 p.m. Commissioner McLeod said, "I do not think water quality is the issue here. I think you are covered by the St. Johns [River Water Management District's]. I do not think you can do anything greater there. I think if you are going to do anything that is going to be advantageous to the City, then I think you need to look at perhaps materials that these docks are built out of." CITY OF WINTER SPRINGS MINUTES CITY COMMISSION WORKSHOP - SEPTEMBER 8, 2003 PAGE30F4 Furthermore, Commissioner McLeod stated, "If you want to give some direction - how to build a lasting boat dock, quality type boat dock that is going to give longevity with maintenance and some heights and widths restrictions, I really think that is where you need to go, and not worry or try to stop the docks." With additional discussion, Mayor Bush stated, "Commissioner McLeod has made the recommendation that he come back with some building code type recommendations - length, height, width, etceteras." Deputy Mayor Miller added, "If the City Manager listens to the tape tonight - listens to most of the constructive advice, I think he has everything he needs to go forward." In determining a consensus, Mayor Bush said, "I think - Commissioner Miller you would say yes," Commissioner Blake stated, "Was there anything new tonight? Then my position would remain the same." Mayor Bush stated, "That is 'No'." Commissioner Martinez stated, "Yes." Commissioner Sally McGinnis responded, "Yes." Commissioner McLeod said, "No." Mayor Bush summarized that the consensus was, "We will move forward with it." Manager McLemore then pointed out, "What I will need to do is get another proposal, based on what I think your Scope of work is." Commissioner McLeod said, "I would like either the Consultant at present, or Mr. McLemore at present - to give me an idea what the Scope is?" Commissioner Blake added, "What other priorities are we pushing back - are we not going to spend our time and energy working on, in order to do this?" Mayor Bush then said, "We have already got a consensus to move ahead." Commissioner Blake remarked, "I think we need to know what is going to be pushed out, so we can go through this exercise again." Manager McLemore pointed out that "What I heard was you wanted some composite of the different kinds of regulations around here affecting the way that boat docks are built; the materials they're made out of; how big they can be and that type of thing." Commissioner McLeod stated, "If you are going to go forward - what are the composites that they are going to be built with - to last for a period of time." Mayor Bush said to Manager McLemore, "Do you need further direction?" Manager McLemore responded, "What I am going to do is - get with Mike [Dennis] and we are going to come up with a Scope and bring that Scope back to you, and say 'Is this what you are looking for', before we start spending any money. And my understanding was you wanted to see if there are opportunities - existing for us to improve or enhance the level of regulation, relative to the impacts on wetlands." Manager McLemore added, "What I heard was can we enhance wetland protection through some additional regulation; and some ideas about how you build a boat dock, without poisoning the water or contributing to the water quality, at that level." Mayor Bush stated, "Did you sense that that is what he meant - that we wanted to limit the number of boat docks?" Commissioner Martinez stated, "Yes, that is part of it." ,Mayor Bush then added, "Also, the number of boat docks is an issue too - and should be addressed. He maybe can listen to the tape and get a sense. Obviously, he - has heard all of this too. Get him a tape Andrea [Lorenzo-Luaces, City Clerk], so he can review it as well - and then Mr. McLemore bring this back to the Commission as a Regular Agenda Item." Furthermore, Mayor Bush said, "Mr. Dennis indicated that he would also look at these other Ordinances that exist in surrounding communities and give some recommendations based on what you see there."
