Bush at 5:15 p.m. in the Commission Chambers of the Municipal Building (City Hall, 1126 East State Road 434, Winter Springs, Florida 32708). Roll Call: Mayor John F. Bush, present Deputy Mayor Sally McGinnis, present Commissioner Robert S. Miller, present Commissioner Rick Brown, present Commissioner Donald A. Gilmore, present Commissioner Joanne M. Office Of The City Manager Requesting The City Commission To Review The Terms Of The Development Agreement Between The City And Bryce Foster Corporation Providing For The Operation Of An Outdoor Neighborhood Market On Weekends And Holidays At Tuscawilla Square On Winter Springs Boulevard. City Manager Ronald W. McLemore introduced this Agenda Item and spoke about the Development Agreement. Much discussion. Tape 1/Side B Discussion. Ms. Angela Federici, 752 Night Owl Court, Winter Springs, Florida: as the Coordinator of the Farmer's Market in Tuscawilla Square, Ms. Federici spoke to the City Commission on the various Vendors. Parks And Recreation Department Requesting That The City Commission Approve Resolution Number 2007-51, Increasing Fees And Establishing New Fees To Be Paid By Individuals Or Groups For Use Of City Facilities And Program Participation. Mr. Chuck Pula, Director, Parks and Recreation Department presented this Agenda Item. Discussion ensued on Fees. Tape 2/Side A Further discussion. Mayor Bush said, "I think the Commission has brought up, number one, I think there's at least a Consensus that non-City residents on those activities, where it makes sense to collect it, such as in organized sports." Mayor Bush then stated, "I think raising the cost for the non-residents - I get the sense that is okay with everybody, and it is easy to collect - you collect it one (1) time." Discussion. Mr. Pula said, "We are concerned about the Senior Members that can't -afford the Fee. I have talked with the Senior Board. Discussions have been going on for quite a while. I spoke to their entire membership regarding this and -the perspective Fees coming and scholarships and how important that was to cover Seniors who absolutely couldn't afford - to pay these Fees. We do have a scholarship program in our -Recreation Budget that - is available to be used across the board." Regarding donations, Commissioner Joanne M. Krebs said, "I too, will donate to a fund that would help aSenior - I know how important that is to them." Further discussion. "I MOVE THAT WE ACCEPT THE FEE PROPOSAL FOR `YOUTH SPORTS' AS PROPOSED IN THIS DOCUMENT." MOTION BY DEPUTY MAYOR McGINNIS. SECONDED BY COMMISSIONER GILMORE. DISCUSSION. "I MAKE A MOTION THAT WE ACCEPT THE RATES FOR LAST YEAR AND NOT INCREASE THEM FOR -THIS YEAR." COMMISSIONER MILLER ADDED, "YOU JUST USE THE CURRENT COSTS AND NOT THE PROPOSED INCREASE." Commissioner Krebs asked, "On the current costs for the Football Recreational League is three [hundred] fifty [dollars] ($350.00) and the proposed Fee is three hundred [dollars] ($300.00)?" Mr. Pula stated, "No. That is incorrect. That should be four hundred [dollars] ($400.00). That's an error right there." Mr. Pula added, "That's an error on the PowerPoint." On the next item, Mr. Pula explained, "This is for Field Rentals of the Facilities." Mayor Bush said, "I think the non-resident Fee should be higher here, personally..." Commissioner Krebs said, "...Yes..." Mayor Bush added, "So, if you make a Motion on that, you add in what he would have added to the resident and to tack it on to the non- resident." "SO MOVED." MOTION. SECONDED BY COMMISSIONER MILLER. DISCUSSION. MAYOR BUSH SAID, "THE MOTION WAS THAT THE ADDITIONAL COST THAT YOU WOULD HAVE -INCREASE THE RESIDENT FEE BE ADDED TO THE NON-RESIDENT FEE." DISCUSSION. FURTHERMORE, MAYOR BUSH STATED, "THIS IS TO NOT RAISE THE FEE FOR THE NON-RESIDENT AND RAISE THE NON-RESIDENT FEE BY THE -WHAT WAS ON THE CHART PLUS THE INCREASE FOR THE NON- RESIDENT." Commissioner Donald A. Gilmore said, "Your terminology is `Fee increase' when in fact, it is not a `Fee increase', it is the new rate. When you say `Fee increase' you are taking the Fee, that number and adding it to the previous Fee. So, change that on your slides, please." Discussion. "MOTION TO DO WHAT WE DID BEFORE, KEEP THE CURRENT COST FOR RESIDENTS AND INCREASE THE NON-RESIDENT FEE." MOTION BY COMMISSIONER KREBS. SECONDED BY DEPUTY MAYOR McGINNIS. DISCUSSION. "I MOVE THAT WE APPROVE THE FEE SCHEDULE FOR NON-RESIDENTS AS PROPOSED, AND KEEP THE CURRENT COSTS FOR RESIDENTS." MOTION BY DEPUTY MAYOR McGINNIS. SECONDED BY COMMISSIONER BROWN. DISCUSSION. MAYOR BUSH NOTED, "TO INCREASE NON-RESIDENTS AND LEAVE RESIDENTS THE SAME." MOTION BY COMMISSIONER KREBS. COMMISSIONER MILLER SAID, "HOW WOULD YOU IMPLEMENT THIS - HE HAS TO HAVE A DRIVERS LICENSE?" MR. PULA STATED, "WE WOULD HAVE TO ASK THE ADULT WITH THE GROUP -WHERE THEY LIVE AND TRY TO SHOW US SOMETHING IN TERMS OF WHERE THEY LIVE. WE WOULD POST APPROPRIATE SIGNS AHEAD OF TIME. WE WOULD NOTIFY THE DAY CARES AHEAD OF TIME. WE WOULD HAVE A RECORD OF WHO THEY ARE, AND WE WOULD DO OUR BEST TO IMPLEMENT WHAT YOU DIRECTED US TO DO." Community Development Department -Planning Division Requests That The City Commission Establish The Date Of January 7, 2008 For A Joint City Commission/Local Planning Agency Workshop For The Purpose Of Reviewing And Commenting On The Draft Evaluation And Appraisal Report (EAR). Discussion. "MOTION -FOR [AGENDA] ITEM `604' TO COME BACK..." MOTION BY COMMISSIONER KREBS. SECONDED BY COMMISSIONER BROWN. COMMISSIONER KREBS ADDED, "...ON JANUARY 7TH, [2008], AT 5:15 [P.M.]." Community Development Department Requests The City Commission Provide Certain Clarifications Regarding Its Directive To Amend The Minimum Setback Requirements Within PUDs (Planned Unit Development), As Set Forth In Section 6-86.Of The City Code. Mr. Randy Stevenson, ASLA, AICP, Director, Community Development Department presented this Agenda Item and said, "When we came to you on August the 20th - we are trying to get direction on how to Amend the setback in the PUD (Planned Unit Development) for just zero lot lines." Mr. Stevenson then explained, "Zero lot lines being defined as townhouses, duplexes, quadraplexes -not single family detached family dwelling units." Miller left the Commission Chambers at 7: 40 p. m. Commissioner Miller returned to the Commission Chambers at 7:42 p. m. Mayor Bush called a Recess at 7:42 p. m. Tape 3/Side A Mayor Bush called the Special Meeting back to Order at 7:54 p. m. Mr. Stevenson added, "Basically we just wanted to explain to you and get your authorization to work up some language which will have to come back before this Commission in an Ordinance." COMMISSIONER GILMORE NOTED, "WE ALLOW THEM TO WORK UP THE LANGUAGE AND COME BACK; AND THIS TIME WHEN YOU COME BACK, PLEASE BRING..." MR. STEVENSON REMARKED, "...WITH GRAPHICS..." Community Development Department Requests The City Commission Consider The Hayes Road Plaza Final Engineering/Site Plan, Located On The South Side Of SR (State Road) 434, At The SW (South West) Corner Of The Intersection Of SR (State Road) 434 And Hayes Road. Mr. Brian Fields, P.E., City Engineer, Public Works Department introduced this Agenda Item. CITY OF WINTER SPRINGS, FLORIDA MINUTES CITY COMMISSION SPECIAL MEETING -NOVEMBER 14, 2007 (CONTINUATION FROM NOVEMBER 13, 2007) PAGE 13 OF 16 Mr. Fields stated, "One important condition of the Preliminary Engineering was that the land for the east bound right turn deceleration lane be conveyed to the City in exchange for Transportation Impact Fee Credits, and we have reached an agreement with the Developer for a fair value of that land and that amount was forty-four thousand, six hundred eighty-eight dollars and seventy-five cents ($44,688.75). So, if Approved tonight, that would need to be documented in a Developer's Agreement." Continuing, Mr. Fields noted, "Staff recommends approval to two (2) conditions. The first, as I mentioned is the condition for the right turn deceleration lane; the land be conveyed in exchange for Transportation Impact Fee Credits and the second item is just a minor item that the Site Lighting Plan shall be updated to comply with City standards. We've received the Lighting Plan, we've reviewed it; it just needs some very minor changes to fully comply." "MOTION TO APPROVE." MOTION BY COMMISSIONER BROWN. SECONDED BY COMMISSIONER KREBS. DISCUSSION. MAYOR BUSH SAID, "MOTION TO APPROVE AS PRESENTED WITH THE TWO (2) CAVEATS THAT WERE MENTIONED." DEPUTY MAYOR McGINNIS ASKED, "WHAT IS THE PROPOSED DATE TO BEGIN THIS? BREAK GROUND?" WITH DISCUSSION, MR. FIELDS STATED, "MARK MASSEY FROM THE DEVELOPER COMMENTED, `MID-JANUARY [2008]'." DEPUTY MAYOR McGINNIS SAID, "GREAT." Mr. Kamil Gowni, 701 East State Road 434, Winter Springs, Florida: addressed the City Commission and stated, "Yes I have some tenants actually."
