REQUEST: The Community Development Deparhnent -Planning Division requests the City Commission conduct a public hearing for the 2nd Reading and Adoption of Ordinance 2008-09, which redefines the City boundaries of Winter Springs to include lands previously annexed by the City and provides for incorporation into the City Charter. PURPOSE: The purpose of this request is to redefine the City boundary description included in the City Charter, so that it is up to date and reflects all lands annexed into the City. APPLICABLE LAW AND PUBLIC POLICY: Florida Statute Chapter 166.031 Charter Amendments. (3) A municipality may amend its charter pursuant to this section notwithstanding any charter provisions to the contrary. This section shall be supplemental to the provisions of all other laws relating to the amendment of municipal charters and is not intended to diminish any substantive or procedural power vested in any municipality by present law. A municipality may, by ordinance and without referendum, redefine its boundaries to include only those lands previously annexed and shall file said redefinition with the Department of State pursuant to the provisions of subsection (2). CONSIDERATIONS: The City Boundary description included as Appendix A of the City Charter should reflect all property annexed to the City of Winter Springs, Florida, since the adoption of the Charter of 1972. Rather than revise the metes and bounds description every time that a parcel is annexed, the City has historically included a listing at the end of Appendix A of ordinances annexing property to the City. This listing begins with Ordinance 2000-08 adopted on April 10, 2000 and now includes 25 annexations that have occurred. As a result, the metes and bounds description included as Exhibit A of the City Charter has become out of date. May 27, 2008 Public Hearing Agenda Item 502 Ordinance 2008-09 includes a new metes and bounds description that includes all annexations into the City, to date, including the most recent, Ordinance 2008-02. STAFF RECOMMENDATION: Staff recommends that the City Commission hold a public hearing for 2nd Reading and Adoption of Ordinance 2008-09, which redefines the City's territorial boundaries and includes lands previously annexed by the City and provides for incorporation into the City Charter. WHEREAS, the City is granted the authority, under § 2(b), Art. VIII of the State Constitution, to exercise any power for municipal purposes, except when expressly prohibited by law; and WHEREAS, section 166.031(3), Florida Statutes, authorizes the City, by ordinance, to redefine its boundaries to include only those lands which have been previously annexed; and WHEREAS, the City has previously annexed land into the territorial boundaries of the City and desires to redefine the City boundaries to include those land previously annexed; and WHEREAS, City Commission deems that this Ordinance is in the best interests of the public health, safety, and welfare of the citizens of Winter Springs. NOW, THEREFORE, THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS HEREBY ORDAINS, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing recitals are deemed true and correct and are hereby fully incorporated herein by reference. Section 2. City Boundaries Redefined. Pursuant to section 166.031(3), Florida Statutes, the City Commission of the City of W inter Springs hereby redefines the City boundaries as set forth in "Exhibit A," attached hereto and fully incorporated herein by this reference. Section 3. File with Department of State. Upon adoption of this Ordinance by the City Commission, the City Clerk shall file a certified copy of this Ordinance with the Department of State, as required by section 166.031(3), Florida Statutes. Section 4. Incorporation into Charter. Upon adoption of this Ordinance by the City Commission, the City Clerk shall forward a certified copy of same to Municipal Code Corporation City of Winter Springs Ordinance No. 2008-09 Page 1 of 2 for incorporation into Article II of the Winter Springs Charter. Section 5. Severability. If any section, subsection, sentence, clause, phrase, word or provision of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, whether for substantive, procedural, or any other reason, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions of this Ordinance. Section 6. Repeal of Prior Inconsistent Ordinances and Resolutions. All prior inconsistent ordinances and resolutions adopted by the City Commission, or parts of prior ordinances and resolutions in conflict herewith, are hereby repealed to the extent of the conflict. Section 7. Effective Date. This Ordinance shall become effective immediately upon adoption by the City Commission of the City of Winter Springs, Florida, and pursuant to City Charter.
